remember, but he says he changed his mind after being blind sided by the subpoena to verizon. >> he came to the conclusion that they are still going to try to question those personal private conversations that i had with the president of the united states and other senior officials in the west wing. and, quite frankly, their scope is way -- >> the court is going to have to determine that. >> committee members note meadows himself gave the capitol riot committee 6000 pages of documents voluntarily but is now refusing to testify about their contents, claiming executive privilege. here's congressman adam schiff. >> it's a very superficial filing meant to try to obstruct and stall. it won't be successful. we intend to move forward and hold him in criminal contempt, and expect and hope the justice department will move with equal a alacrity. i was surprised by the lawsuit. i don't think it will do him any good. >> ryan nobles on capitol hill. >> reporter: there was a lot of news on the select committee. perhaps the most important and biggest news was bennie thompson did say the committee is prepared to move forward with the criminal contempt referral of the white house chief of staff mark meadows as soon as next week. now, this is despite the fact that meadows filed a lawsuit against the committee in d.c. district court on wednesday, seeking injunctive relief from the court to prevent him from having to turnover any information or records to the committee despite their subpoena request. now, meadows just a couple of days ago signalled he was willing to cooperate with the committee. he evenhanded over thousands of pages worth of documents. but something changed in the beginning of the week that forced him to change course and not show up for a deposition that was scheduled for wednesday. now, congresswoman lofgren who is a member of the committee, she told cnn she thinks this attempt by meadows to take this to court is nothing more than a delay tactic by meadows. >> it doesn't look like there is much merit to this lawsuit. but, you know, isn't it interesting that while he's out selling his book for money that includes portions where he talked directly, reveals conversations with the president, he's trying to keep from telling the truth to the committee. it's just not tenable, but, you know, the lawsuit looks to be not very well founded. >> reporter: so the committee will continue to move forward with the criminal contempt referral. as we said, thompson telling us that could happen as soon as next week. meanwhile, they have a number of depositions that are still planned for later this week. the committee still remaining confident that they're getting enough information from these other folks they're talking to, more than 275 people, that even though they are seeing some resistance from these high-profile trump-aligned individuals, they are still going to be able to get the information they're looking for and get to the bottom of what went wrong on january 6th. laura and christine? >> all right. important here, the head of instagram testified before congress on wednesday, questioning claims about the harmful impact of social media on teens. he did say the company is rolling out parental controls and new rules to try to keep users safe next year. concerns about instagram grew this fall after leaked internal documents showed the company knew how it can damage mental health and body image and promoted eating disorder profiles anyway. and those rabbit holes you go down on instagram, that's all for profit. cnn's donie o'sullivan has more. >> reporter: hey, laura and christine, this was adam asari's first time appearing before congress. and despite being zuckerberg -- one of zuckerberg's top lieutenants and running instagram, he has got very little scrutiny relative to zuckerberg in the past. so yesterday was a big day out for him. and we saw a lot of tense exchanges between senators and between masari. have a listen. >> keeping people safe is not just about any one company. we believe there should be an industry body that will determine the best practices when it comes to what i think are the three most important questions with regards to youth safety. how to verify age, how to build age-appropriate experiences and how to build parental controls. >> reporter: and one question that was asked by senator richard blumenthal from connecticut was that even when parents of young people see troubling content on the app, when they see it on facebook or they see it on instagram and they report it to instagram, oftentimes instagram does nothing. have a listen. >> shouldn't children and parents have the right to report dangerous material on youth and get a response? get some action? because we've heard harrowing stories from parents who tried to report and have heard no response. my office made a report and got no response. until cnn made the report to press relations. shouldn't there be an obligation that instagram will respond? >> senator, yes, i believe we try and respond to all reports. and if we ever fail to do so, that is a mistake we should correct. >> reporter: and the cnn reporting blumenthal is referring to there is reporting on how his office set up a fake account purporting to be a teenage girl on instagram, and they followed some dieting accounts, eating disorder accounts. instagram began recommending to that young teenage girl more and more accounts that were promoting eating disorders. this is all supposed to be against instagram's policies, but instagram didn't take down many of these accounts until it was brought to their attention by cnn. there you can see so many holes in their moderation policy and how they catch -- how really if they have any control at all on their platform. laura and christine? >> donie, thank you for that report. some significant news on the booster front this morning. a third shot of pfizer's covid vaccine can reduce infections and deaths by 90% or more. 90% or more. that is according to two separate israeli studies. the research also found that while covid deaths and severe cases were already low among fully vaccinated people, booster shots lowered them even more dramatically. and pfizer now has new evidence that boosters are critical in the fight against the omicron variant. here's our senior medical correspondent elizabeth cohen. >> reporter: laura, christine, when the omicron variant was first identified, there was a lot of concern that the vaccine might not work so well against it because this variant has so many mutations. but pfizer has done a study in their labs that finds that the vaccine does work to a great extent. now, it did take a hit. the variant is tough and it did manage to outsmart the vaccine to some extent, but still, two doses are effective in many ways, and three doses are even better. and pfizer's news, well, this actually seems to jive with what researchers in south africa found when they did their own lab studies. so let's take a look at what these studies show. these studies, which are in a lab and are preliminary suggest that two doses may not provide sufficient protection against infection with omicron. in other words, you might have two doses of pfizer and still get infected with omicron. now, the question is how sick will you get. so, these studies also seem to show the two doses may still give significant protection against severe disease. in other words, you might get infected. you might get somewhat sick, but it does seem that the vaccine will give protection against the kind of disease that will put you in the hospital, or that could kill you. but pfizer says that their lab work also shows that a third dose, what some people call a booster dose, may give more robust protection. so, in other words, omicron is what scientists call an escape variant to a certain extent. it did manage to escape the vaccines, but this is much better news than what many people had feared. christine, laura? >> all right, thank you so much for that, elizabeth. suggesting to cnn one-third of all parents in the u.s. still fear vaccinating their children according to a kaiser family foundation survey. 30% of parents say they will definitely not vaccinate their 12 to 17-year-old children. 13% said they will wait and see. 30% say they will get their kids shots. when 2 comes to age as to 11, the hesitancy arises only 20% of parents say they will vaccinate their 5 year olds. according to the cdc more than 2 million people are fully vaccinated. you see the hesitancy, but we know in the last week or so there has been a rush to vaccinate. now, 60% of the american public is vaccinated. certainly not leading the world, but you can see the news of the omicron variant spurred people to go out there and finish the two courses of vaccines and the boosters. >> and get those boosters. that was the big news of yesterday. got to get the booster. all right, still ahead for you, the mother of daunte wright killed by police officer kim potter opening the trial on day one. >> i was like, what's wrong? and she said that they shot him. >> the attorney for daunte wright's family tell cnn the defense argument that potter made a mistake and wright should have surrendered just doesn't fly. >> this was not a mistake. she intentionally -- she knew that she was grabbing her gun. and she was going to still use a taser on somebody who was unarmed and not a threat. i mean, it was really ridiculous. >> we get more now from cnn's adrienne broadus in minneapolis. >> reporter: good morning, christine and laura. today will mark the second day of testimony in the trial against kim potter. on wednesday, compelling opening statements from the prosecution and the defense. the prosecution focusing in on potter's training, saying she'd been a police officer longer than daunte wright was alive. also saying that her job and her duty as an officer is to protect life and not take life. by contrast, the defense saying what happened that day in april was a mistake. >> oh, my god! >> reporter: and that's the voice of the rookie officer potter was training that day anthony lucky. you hear him tell her, you are not going to prison. he also testified about why officers wear their service weapons on the opposite side of their duty belt. he testified it's so officers aren't confusing their firearms with their taser. laura and christine? >> adrienne broadus, okay. the jury trial in the jussie smollett case continues with day two. there are six felony counts against the former empire actor saying he essentially staged a hate crime and gave a false report to police. in closing arguments they said smollett lied to jurors from the stand and they made the same claim about the two witnesses against him. cnn's sarah sidner has more from chicago. >> reporter: christine and laura, the jury will begin again deliberating this case in the next few hours. we heard, of course, closing arguments from both the prosecution and the defense and the rebuttal argument from the prosecution. the prosecutors going after jussie smollett not just saying his words on the stand were inconsistent, but saying that he was a liar. here's how prosecutor webb put it. he said that in january 2019, mr. smollett developed a secret plan to carry out a fake hate crime. he falsely reported it and i told you that is a crime. mr. smollett failed to tell the truth and made many false statements. he lied under oath to you jurors. he lacks any credibility whatsoever. he was tailoring his testimony. as you know, there were two men who took the stand who were very important witnesses in this case. and that was the osundaiaro brothers. both of them testifying they indeed were paid by jussie smollett to carry out this fake hate crime against him in order for him to get more media attention. that that's what they said on the stand. smollett's attorney went after the osundaiaro brothers. the relationship between the osundaiaro brothers and smollett was a one-way friendship. they are not who they say they are. the brothers are the wolves disguised as sheep in a hen house. strong words from both sides, but now the jury just has to look at all of the evidence and make a decision. christine, laura? have swelled to 120,000. that includes additional army, air force and naval personnel. the president will also speak to the bucharest nine, a group of nato-flanked allies that includes the czech republic and slovakia. cnn's matthew chance joins us from kiev this morning. matthew, good morning. what does president zelensky want to hear from president biden when they speak today? >> reporter: well, it is an important call, of course, for the ukrainian leadership. remember when vladimir putin of russia and president biden had that video conference call, they were talking about the future of this country, the future of ukraine, and the ukrainian delegation was not in the room on the call. they are anxious to hear exactly what was discussed, what assurances if any president biden passed on to his russian counterpart. they haven't had that call yet. it is coming tonight in six, seven hours from now they say they are expecting this call from president biden. there's already been some general comments coming from vladimir zelensky from ukraine. he said it meant that president biden was now personally involved in resolving the conflicts of russian backed rebels in the country. he said he considered it a victory for ukraine that the united states continued to support ukraine's sovereignty and territorial integrity. and so that's good. it was a good thing as far as they're concerned. what they want to hear, though, is what are the details. what, if anything, is ukraine expected to do in order to avoid russia pressing the button on the plan which it says it doesn't have to invade ukraine. so it is a very anxious moment here in the ukrainian capital. >> matthew chance, thank you for that report. new cases of covid are on the rise, but the senate voted to block hour. time for our top stories to keep an eye on today. today president biden will speak with the president of ukraine via secure video link about the huge buildup of russian troops just across the border from his country. in his two-hour call with vladimir putin tuesday, the white house says mr. biden emphasized u.s. support for ukraine's sovereignty and that territorial integrity. this morning former senate majority leader bob dole will lie in state at the u.s. capitol. dole, of course, served for 27 years in congress, but is probably best known for his unsuccessful bid as the gop candidate for president in 1996. he died sunday from lung cancer. president biden paid tribute wednesday to his long-time colleague. >> we didn't agree on everything, but i always admired and respected him and his willingness to work with anyone, any party when it mattered most. u.s. navy is investigating the death of seal team commander brian. the 43-year-old officer was injured in virginia beach during a rope repelling training exercise and died on tuesday. he leaves behind a wife and five children. republican congressman brett guthrie of kentucky testing positive for coronavirus. he is the third member of kentucky's congressional delegation to test positive for covid. he says he is experiencing mild symptoms and is glad he decided to get fully vaccinated. british prime minister boris johnson launching an investigation after a video leaked showing senior staff members jokesing about a downing street christmas party at the very same time london was in locked during the pandemic. one of johnson's advisers seen in this video has resigned. it took three tries, but a bill banning conversion therapy in canada is now the law. the bill makes it a crime to subject any person of any age, consenting or not, to the practice that tries to change sexual orientation or gender identity. promoting or advertising gender identity is outlawed. the ban takes effect in 30 days. scott peterson convicted to life in prison without parole for killing his wife lacy peterson in 2002. peterson spent 15 years on death row after his initial conviction. california's state supreme court overturned his sentence last year ruling jurors in the case were dismissed improperly. new zealand plans to outlaw smoking for the next generation. a bill -- proposed bill would raise the minimum age for buying tobacco year by year so that people age 14 when the law goes into effect will never be able to buy it legally. now, this legislation does not cover vaping, which is dangerous and remains popular among new zealand's young people. all right. now to this. the senate has voted to block president biden's covid vaccine mandate for large businesses. two democrats, joe manchin of west virginia, and jon tester of mont i montana voted with republicans 52-48 to repeal the mandate. delta omicron and numbers increasing daily. cnn's daniela diaz joins us live from capitol hill. daniela, this probably isn't going anywhere in reality because republicans don't have the votes in the house. do i have that right? >> reporter: you have that right, laura, but the bigger picture here is house majority leader steny hoyer and nancy pelosi probably will even put this to a vote in the house. they decide what goes on the floor and they won't support this. and even if they did pass this, president joe biden would just veto it anyway. but really the bigger picture here is it shows the bipartisan opposition to the president's vaccine mandate for larger employers. now, remember, this was a mandate that he directed the labor department to enforce this vaccine mandate for any companies that have 100 employees or more. and republicans oppose this because they say that this already puts a strain on struggling businesses, and they believe that vaccines are a personal choice, which is why they did this. now, this effort was led by senator mike braun of indiana. and as you said, laura, it did have two democrats in favor of this bill. it was actually, as you said, jon tester, moderate democrat from montana, and joe manchin, a moderate democrat from west virginia. but the rest of the democrats in the chamber, of course, opposed this legislation. but as i said, really the bigger picture here is, laura, it sends a message to these republicans back home that voted these senate republicans into office, that they are listening to them and this is why they wanted to vote for this. laura? >> daniela diaz, thank you. mark meadows is suing nancy pelosi and the house select committee investigating the capitol riot. donald trump's former chief of staff is asking a federal court to block enforcement of a subpoena the committee sent him as well as the subpoena it issued to verizon for his phone records. but the committee is still moving forward with a criminal contempt referral against their former house colleague. it's time for three questions in three minutes. let's bring in aaron blake, senior political reporter for the "washington post." thanks for joining us on "early start" bright and early this thursday morning, iron. nice to see you. >> good morning. >> meadows may be suing the january 6 committee to stop the house from getting his phone records, but we know that lawmakers already, aaron, have plenty of -- significant evidence, including a text meadows sent another member of congress saying, quote, i love it, about the possibility of appointing alternate electors in november 2020. where does this go next? >> well, i think there are two points here. one is that the effort to sue the january 6th committee is an effort to move this into civil court. we saw during the russia investigation that's more fruitful as far as drawing things out. maybe when congress comes with a contempt referral for the justice department, meadows' lawyer will say, hey, this isn't civil court. we're litigating this right now. let that process play out. i think that's a big part of why this lawsuit was filed. the other thing i thought was interesting was the letter sent by bennie thompson, the chairman of the committee yesterday, basically laid out the argument that meadows had been cooperating substantially, had turned over some very intriguing things. and now suddenly got cold feet. it basically argued that there are things that he has turned over that they want to ask him about. he can try to assert executive privilege then. but i think it's difficult to separate all this from what happened this past week, which is that meadows' new book and its disclosure of a positive covid test for president trump before a debate in 2020, has really alienated the president and has put pressure on meadows to toe the line like so many have. >> he knew all that was going to come out which is curious. he knew his text messages would come out and yet he's fighting this anyway. leave that there for another day. i want to ask you about what is going on in georgia. david perdue has thrown his hat in the ring for governor there. he says had he been in charge in 2020, he wouldn't have certified the georgia election results. in any other time, i think it's fair to say that would be disqualifying, given there has been no evidence of widespread voter fraud anywhere, much less georgia. but somehow now that's seen as sort of a plus for him, i guess in the trump book. >> well, and the weird thing about this is as your colleague ryan nobles noted yesterday, david perdue was asked this question about certifying the election in georgia back in, and confirming the results back in january of 2021. he basically punted on the issue saying he didn't know if he would actually be in the senate when it came time to accept these election results. so one of the most curious things about this is that david perdue is essentially running on brian kemp's handling of the 2020 election results, the things he did before the election. but these were not things that david perdue said beforehand. i think that shows there is a perceived benefit in republican primaries. of course, this is very demonstrated, at least aligning with president trump on these false claims and saying things that maybe don't go as far as the president, but hint in that direction which is a lot of what we've seen from david perdue in recent days especially. >> aaron, listen to what former president barack obama said yesterday on gop redistricting efforts. >> their plan is to control state legislatures and congressional delegations before a single vote is cast. that's not how democracy is supposed to work. and our democracy is essential to who we are. it is what makes america exceptional, and it shouldn't be a partisan issue. >> aaron, is he right? >> well, certainly this is one of the most under sold stories in american politics. last time we had a census, i focused on this extensively. i went through the maps. when each state was doing this, i looked at how they were changing the partisan makeup of the districts was changing. republicans have gotten much more of an advantage from this because they've been much better at winning governor's races, winning the state legislatures. it's kind of a self-reinforcing cycle which they then draw the maps that allow they have to continue to control those things. certainly both parties, gerry gerrymander extensively. republicans have more opportunities to do it. what that means is the playing field is a little bit more slanted towards republicans whether it comes to the 2022 elections. >> aaron blake, so nice to global leaders promoting democracy over autocracy. china calls it hypocritical. hillary clinton delivered the speech she hoped to deliver in the 2016 election. it was part of a master class released on the topic of resilience. she became emotional when reading the part where she paid tribute to her mother. >> i dream of going up to her and sitting down next to her, taking her in my arms and president of the united states. >> the speech also outlined her vision for america, rejecting u.s. versus them countries, saying, quote, the american dream is big enough for everyone. i mean, that now joining the u.s. in this diplomatic boycott of the 2022 winter olympics in beijing. official representatives of those nations will stay home, while the athletes will still compete. all three countries cite china's human rights abuses. when the spokesman of the foreign ministry was asked, he said, no one would care whether they come or not. kristie lu stout is in hong kong. it sends an important message, i mean, i think when you have diplomats from around the world coming to your country and city for the olympics, it's an important moment to have major companies or countries, rather, snubbing china. i guess i'm not surprised the response. >> reporter: yeah, and it's a moment of intense national pride for china. so this is a form of an official snub. but we just learned that france will not be participating in a diplomatic boycott of the beijing olympic games. other european nations are considering it, including the netherlands. that's why we're seeing these forceful statements come out from china of the boycott of the winter games. china saying they will pay the price. on wednesday we heard from the british prime minister. the uk will take part in the diplomatic boycott. you have the uk along with australia, canada and the united states. again, this is not a full boycott, so their athletes will be free to compete and to participate in the beijing winter olympic games. it was on monday earlier this week when the united states formally announced its diplomatic boycott citing human rights concerns, especially charges china is committing genocide in its xinjiang region. china was very quick to push back and say the united states will pay the price, that there will be repercussions. early today at the daily ministry of foreign affairs briefing, we heard the spokesman said that other nations taking part in this diplomatic boycott will also pay the price. take a listen to this. >> translator: the united states, australia, united kingdom and china's ministry of foreign affairs spokesman saying the u.s., uk, australia and canada will pay the price for taking part in this diplomatic boycott. china has yet to articulate what that price would stocks so far this week. the dow has added more than 1100 points in just three days. as we learn more about the omicron variant, there is growing relief in markets. stocks are right back near their record highs. look at the dow. it is up 25% this year. there is evidence inflation may be peaking and signs that workers are the winners in the covid jobs market. we know another 4.2 million americans quit their jobs in october, down from that record set the month before. but a sign that workers are confident enough to quit for better pay, better jobs, or to start their own businesses. record new business creation in the u.s. right now. critical new inflation news comes friday with consumer price data. in this 2022 outlook from jpmorgan got my attention. it is predicting a full economic recovery next year, telling clients, our view is that 2022 will be the year of a full global recovery and end of the pandemic and a return to normal economic and market conditions we had prior to the covid-19 outbreak. our 2022 price target for the s&p 500 is 5050. for context it closed at 4700. more good news for energy prices which have been the key energy driver. they are predicting a drop in price next year because of plenty supply, omicron and volatility. gas prices are starting to pull back a bit, down another penny since yesterday. >> what's driving jpmorgan to be so bullish like that? >> they're looking at bigger up take on vaccines and they're looking at moving ahead. it's been two full years of this covid economy, and they are seeing light at the end of the tunnel here. i mean, it's so interesting when you look at consumer sentiment surveys. people are exhausted by covid. they're exhausted by high gas prices and inflation. you look beyond those numbers, and there's some hope that next year things will get better. i keep pointing out, too, social security recipients will have a 5.9% increase in their checks accounting for inflation this year. if inflation starts to come
