protest august of last year. >> rittenhouse is on trial for five felonfelonies, if found gu of most serious, he will spend the rest of his life in prison. and shimon prokupecz is outside the courthouse. what have we heard from the jury so far? >> reporter: one night this morning they said that they needed copies of the jury instructions. of course there was a lot of confusion during the time that the judge was reading the instructions to the jury, but they are asking for specific information from the instructions. they are asking for pages one to six, some of which has to deal with the self-defense argument by the defendant and then the provocation instruction which the prosecutor asked for on friday, asking for this charge. there were arguments over it and then the judge agreeing to give this instruction to the jury. this was a big win for the prosecution to have this instruction given to the jury. so we can kind of see how the jury perhaps is working through the law, working through these instructions. the other things that they asked for have to do with an instruction on the intent to kill. and then also on the instruction relating to the law surrounding the death of joseph rosenbaum. as you'll recall, he is the first person that rittenhouse shot. he is the man that the defense has been arguing sort of ambushed kyle rittenhouse, started these chain of events. prosecutors have been arguing that kyle rittenhouse provoked the entire attack. so the jury as you said now spending just about over three hours in deliberations. they had a pizza break for about 40 minutes or so. and now we believe that they have resumed their deliberations. and that is all we have heard so far from the jurors. one thing, we don't know how long today will go. the judge said that he would give maybe an hour or two hour public notice for the verdict, that is again not set in stone. as we know with this judge, things kind of happen on the fly. so we will see how that goes. but for now, jurors certainly continuing their work here. >> kyle rittenhouse's mother also made a request. what does she want? >> reporter: she needs money. she said in an email to supporters of kyle rittenhouse, she said that she needs money. that just in the month of november, in this month, and we're not even -- we're kind of midway through the month perhaps. it has already cost them $110,000 in legal fees. and she is asking for help to continue the legal fees. obviously we don't know what is going to happen, but perhaps they are anticipating that they may need to -- some money for appeals and other things. so certainly she is trying to get money off of the last few days. certainly off of the closing arguments. and as this trial has come to an end here, now of course we're just waiting for the jury to reach its verdict. >> shimon prokupecz, thank you. obviously come back when there are any developments. let's bring in now kim walwalg whaley, a law professor, and also we have a jury consultant and communications expert. great to have you both. kim, i just want to play for our viewers what happened yesterday in terms of i think that the crux of the matter of the closing arguments, one for the defense attorney, one for the prosecution, of where i think this things. listen to this moment. >> there is no doubt in this case that the defendant committed these crimes. the question is whether or not you believe that his actions were legally justified. and i submit to you that no reasonable person would have done what the defendant did. >> every person who is shot was attacking kyle. one with a skate board, one with his hands, one with his feet, one with a gun. >> kim, do you have an impression of which will be more convincing for the jury? >> i think it depends on which death the jury is focusing on. 36 pages of jury instructions. so the first person who died, mr. rosenbaum, apparently mentally ill, had just been released from a hospital, was acting erratically and did we saw in the videotape run towards mr. rittenhouse, threw a plastic bag at him and at the same time somebody else shot a firearm. so the question there is, did mr. rittenhouse feel that he was in harm's way. that is i think a little easier for mr. rittenhouse and harder for the prosecution. after that, he started running -- he left this dead body and then started running with a gun. and then mr. huber unarmed with a skateboard went to try to stop what many people thought like it sounded like an active shooter. for there, self-defense i think is much harder and the provocation instruction which in my view is actually quite confusing in the actual jury instructions, but under the wisconsin law, if mr. rittenhouse provoked mr. huber's actions with the skateboard, he can't use self-defense. so that prove provocation argument is much stronger for mr. huber's death because it was really between the i wilkilling mr. rosenbaum and then injuring others that i think that the jury will have an easier time finding mr. rittenhouse's actions unreasonable. >> and let's talk about the jury. these are the first few hours of deliberation before lunch. what are these first few hours like and what do you take away from the first request we received from this jury? >> it is not surprising that they asked for the law. there are so many terms in there, things that they are not familiar with. just hearing it once, it is i will possible. there are ambiguous terms that need repeating. so it is pretty typical to go back over to set the roadmap. and i'm pretty sure this is happening too, that as they start -- they have to unburden themselves, they get to talk about the case. that is one thing that jurors don't get to do. so in people's lives there, is nothing akin to having to sit through a week, two weeks, system, witnesses, all this and you can't say a word about this. so what i've ghnoticed in mock jury deliberations and talks with jurorses, right out of the gate, they start talking about did they like this witness, did they not like kyle rittenhouse on the stand. it is unburdening. and so once that happens, personalities start to emergeia be a fascinating dleb eliberati. >> and so the jury instructions were in-comprehensivable. so who shepherds the jury through trying to figure out what all of that meant? >> there is only so much that the judge can do. even though we've seen that he is sometimes willing to insert himself. one or two jurors will have to step up and focus in on certain parts of the instructions that they think are relevant and have to build consensus. they will have to try to derive some meaning from the different aspects of the instructions and then go from there. it is an arduous task and they have their work cut out for them. >> and kim, back to you. i want you to listen to what judge schroeder said in charging this jury. and the political element that were part of these instructions and then we'll talk on the other side. here is the judge. >> you will pay no heed to the opinions of anyone even the president of the united states or the president before him. the founders of our country gave you and you alone the power and the duty to decide this case based solely on the evidence presented in this court. >> i've never heard anything like that. what do you make of that? >> i think that that might be partially in response to the defense's argument that this is a political prosecution, that essentially wisconsin, the state, was looking to have a scapegoat for what happened in kenosha in august. i mean, there are political implications here. many of them. of course there is racism is that is a big issue. i think many people would rightly believe that in mr. hitten hohit h rittenhouse were a person of color, it could have been handled differently. the point where he is just walking past police officers, people calling out that person killed someone and they let him walk away. the second thing i think has to do with wisconsin's open carry law. this is really a bizarre clash of legal principles here. on the one hand we have the second amendment which i think that many people believe is unlimited, not true actually as a matter of constitutional law, but also we have this self-defense that is built into wisconsin criminal law. so sure, we have self-defense, but you you also have open carr laters with an ar-15 and mr. rittenhouse who testified that he had no idea what the gun's capabilities were or i'm p paraphrasing or what the ammunition capability was. and the governor of wisconsin has 500 national guard troops at the ready with the expectation that either an acquittal or a conviction could cause some serious chaos or maybe even more violence in the streets. >> and about that, alan, how much do you think that the individual jurors' feelings about gun rights will play into the decision here? >> i'm sure that it was thoroughly discussed in voir dire and all the parties asking the questions, prosecution and defense. so they know really well. voir dire was somewhat limited so they didn't get to delve into as many topics as they would have wanted to, but they have a pretty good sense of the attitudes about guns and things related to that. >> all right. thank you both. house committee investigating the january 6th insurrection drew a hard line with steve ban nonoibannon, but debating on whether to hold mark meadows in contempt as well. and also republican party cutting ties with liz cheney for speaking out against former president trump. just turn us into subway® ads? >> reporter: haven't heard anything yet, but hopefully we'll see some of the members of the committee here in the next hour or so to get a readout as to what they talked about. but what we've learned from our reporting is that the situation with mark meadows is a little bit more complicated than it is with steve ban non. steve bannon attempted to say that he was protected by executive privilege which is the reason that he didn't come before the committee, but he wasn't even an employee of the executive branch at the time that the committee is interested about learning more. mark meadows was chief the staff. so perhaps his privilege claims are a little stronger. but still the committee believes that it is his responsibility to come before the committee and answer the subpoena and at least attempt to answer some of the questions that they have had before him. what the committee now will have to figure out exactly how do they compel that testimony. and of course they have said that criminal contempt is an avenue that they could go down with meadows. they all but threatened that on friday. they have an issue not only with his role but also the calendar, the house's schedule to wrap their business up before the thanks giving holiday on friday, they won't be here at all next week. so to pack all that work that they have to do to move forward a contempt referral before thanksgiving seems unlikely. so it seems a decision that how to handle meadows will come after the thanksgiving recess. still at the end of the day, what the committee wants is not a big legal fight with mark meadows. what they would prefer is for him to come in and answer these questions, hand over the documents and get that information. what they are trying 20 figure out right now is the best way to make that happen. >> ryan nobles, thank you. and with us now, we have a former special security analyst. and i don't know if you saw the spectacle yesterday of steve bannon, but he seemed to be enjoying it it. he didn't have to make a statement, but he took every opportunity to go up and have that bully pulpit and make threats. do you think that his reaction is coloring the way that the house select committee will approach mark meadows? they don't want another spec spectacle. >> i don't think that it will color the way that the committee approaches mark meadows because i think as ryan mentioned, there are a few different things happening there. but i think that it will affect steve bannon's own criminal case. he is basically admitting that he defied the subpoena willfully which is exactly what the department of justice has to prove and it is important to note that the indictment really does layout that steve bannon made no effort, no even show of good faith to communicate with the committee in an effort to, you know, try to accommodate or even make any semblance of being responsive to the subpoena which is what makes the case against him very strong in addition to the fact that he didn't have an official position. so i think what happens with mark meadows is really going to depend on whether there will be teeth if they make a criminal referral for the department of justice to follow through on it. you don't want to do a criminal referral and not have anything happen. and maybe meadows' lawyers will make more of at least some kind of superficial good faith effort to try to be responsive in at least a minimal way that bannon was not. >> and one more quick beat on steve bannon. his defiance is a pr move, right? but he also said that they are going going on the defense legally. is there a plausible offense -- i should say offense legally that matches the pr that we saw yesterday? >> i don't think so, victor. i suppose he could suggest that he was relying on the advice of his lawyer to kind of counter the idea that he was willfully trying to defy congress. but even then i think a lawyer would know better and would be trying to negotiate this kind of compromise with congress. he did not have an official position. many of these documents and testimony that this committee is looking for were really outside the scope of even his conversations with trump. this is about his personal contacts. i think this is steve bannon's way of trying to break the system. >> and the more we learn from reporters about what was happening in the days after donald trump lost the election, you know, it just gets more chilling. and jonathan karl has done some deep reporting into new things that we haven't heard yet. and one of them is that michael flynn was calling over to the department of defense to try to enlist officials there and their help in overturning the election results or the coup or whatever. he ended up getting a hold of one of the officials who described flynn as sounding manic. and he said come on, you've got to -- basically you've got to do something. you know, we need to get the ballots, they need to be seized. and the department of defense official said it is over, time to move on. but, you know, again, you just see at every turn how if one person hadn't been a guardrail, what could have happened. >> and i think that this latest reporting really illustrates why using the term attempted coup is not, you know,hyperbole. this is going even beyond using some sophisticated legal, you know, argument like the john east man n memo to justify not counting all the eeleleleleelec college votes. this is trying to enlist the military in keeping trump in office. that is what coups are. they subvert the justice system and co-op law enforcement. and i'd like to remind everybody that this was at one point our national security adviser for two weeks. so i think that we dodged a bullet big time. >> really the reporting even on sydney powell bizarre where she says that the cia director is in custody in germany, she's been injured, we have to get her back. all of it was made up. >> and very unhinged. just hard to know what they were doing. >> thanks so much for being with us. let's bring in or political director david chalian. thanks for being with us. let's start with what the wyoming republican party decided would be their future with liz cheney. they have voted that they will not recognize her as a republic republican. and we've known for some some time that any criticism of donald trump is the pejorative of the republican party. so what does it mean for her and the party? >> liz cheney knows that she's in the political fight of her life. she's in that republican prooi primary that takes place next august to try to get reelected to the house seat that she currently has. and she understood when she made her stand, all of this related to the president's be schaffer a -- behavior of january 6 and her decision to join the select committee and be vice chair, all of that she understood could be a political death knell for her. she believes that she will make the argument why it shouldn't and that that could be successful. i think that there are four republicans in total running and donald trump has already endorsed one of heropponents. and the republican party of wyoming saying that they don't consider her a republican after she censured her. so they keep separating her from the rank and file republicans clearly trying to put their thumb on the scale not wanting her to be the nominee of the party come next august. >> and you contrast that with how republicans have dealt with or not dealt with congressman paul gosar who put out that violent creepy video in which he is killing, i guess, alexandria ocasio-cortez. what is the upshot there, what will happen to paul gosar? >> actually it might not be the first of its kind. merck might come out first act actually. they are several weeks ahead of pfizer here. but if they get authorized, these two pills, which seem to have very similar results, could be coming out to be treating early covid-19 and that is the key. early. for example in the pfizer situation, folks in the clinical trial took it within five days of having symptoms. that is how quickly you need to take it. let's take a look at the results that pfizer got when they did their clinical trial. so they had about 775 people in their clinical trial and they split them in half. half of them got a practice she b s placebo and seven died. who got the pill, zero died. so a huge difference.she placebo and seven died. who got the pill, zero died. so a huge difference. we'll have to see more details on the safety data. but if this works, it and the merck pill would be a very big deal. right now the only treatment is shot or infusions. this pill would be a game change if they get authorized. >> absolutely. and tell us about the eight deaths at a connecticut nursing home. do we know the vaccination status of these people? >> we know that many of the folks who died in this connecticut nursing home outbreak, many were vaccinated, but they had not yet received boosters because this outbreak started sort of end of september when boosters were just coming out. so they hadn't gotten boosters yet. so let's look at the data in that outbreak. in this nursing home, 89 cases among residents and staff. many of them were fully vaccinated but they had not gotten a booster. eight of the residents died. and when looking at this, i don't know if you guys feel the same way, but when i saw it, i felt like we were at the beginning of the outbreak. and this just tells us that nearly two years in to this, this is still happening, immunity from vaccines does wane particularly for these folks who probably got their vaccines very early in the rollout. immunity does wane so it speaks to the argument for boosters. >> and let's talk about the kaiser family foundation poll which drives home that the political party is a huge indicator of whether people will be vaccinated. or are vaccinated. what have we learned? >> that's right. and in fact the folks at kider looked at all the various indicators. do you live in a rural area, sub suburban, are you white, are you black. and the biggest predictor was political party. so who is not vaccinated in the united states? >> reporter: hi, there alisyn. certainly a lot of commotion as that was going on with matthew there, of course, at the border as it happened. the polish for their side say that it wasn't the migrants who started throwing rocks at the polish security officials who, of course, are at that border and have that barbed wire set up and said those migrants aren't coming through. one of the other things, by the way, the pols are saying and showed videos that the migrants all of a sudden were armed with stun grenades that they also threw at the polish border guards and the polish border guards are saying those stun grenades could only be provided by belorussian security forces. saying lek shane koe had a hand in this. that melee, of course, lasted for a very long time. we also had a lot of military vehicles go past here at the check point that we're here at as the pols were re-enforcing their side of the border. they came out just a couple minutes ago with new information saying that 7 polish police officers were actually injured in those clashes that took place, two of them severely injured and needed further treatment in hospital. as you can see, really the situation there heating up a great deal. as you guys said at the beginning, i think this is very important, those migrants apparently have now been escorted to a warmer place on the other side of the border on the belorussian side of the border, so at least they're not out in the cold anymore. one of the things that we always have to point out is that it is getting colder by the day here. really it's already freezing at the time that we're out here right now. the pols for their side and the european union say they're not going to budge. that border will remain shut. one of the things that's due to happen in the next couple of days is that iraq is sending some planes set to pick at least some of those people up who might want to go back to their home country, guys. >> fred pleitgen, thank you so much for the reporting. woodstock, new hampshire, now, president biden is taking a victory lap standing on a bridge that will be rehabbed thanks to the $1.2 trillion legislation. >> as an issue that many small businesses here in new hampshire focus on. i might add parenthetically, one of the things that's going to happen, we have another bill that's coming along here that has money for education in it, and it has money for education to provide for money that's directly for community colleges and for apprentice programs and pell grants to allow people the colleges to train for what is needed in the work force. to train for what is needed in the work force, including major apprentice programs so you can hire new hampshire folks to do this work. folks, annie custer is an old friend and how many times did we talk about new hampshire's parents during the pandemic who are worried about not having high speed internet at their home, children learning remotely, especially here in rural new hampshire. every time this issue came up, you were there. reminding us and making the case. she did -- as she did in every element of the bill. chris, he was a key member of the committee that got this bill across the finish line. because the truth of the matter is, getting big ideas and actual bill is hard work and technical data is required, requires getting into the nitty-gritty and details without losing the big picture. and that's exactly what you did, chris. always remember the big picture and always making economic case for the investments in how they're going to matter to real people across the country, particularly here in new hampshire. and how clean water, access to the internet, rebuilding bridges and everything in this bill matters to individual lives are real people. this is not something abstract. folks, it's not hyperbole to say that your delegation is laser-focussed on your needs, the people of new hampshire, the concerns that are discussed around our kitchen tables. this isn't es oteric. it's about what happens to ordinary people. conversations around the kitchen tables that are both profound as they ordinary. how do i cross a bridge in a snowstorm? think about it. you know, you're in a situation. what happens when the bridge collapses and fire on the other side, lit take ten miles longer to get to the fire. people could die. i mean, this is real. this is real stuff. what does it mean if a school bus or water treatment trucks or logging trucks can't cross? that means jobs. it means time. it means energy. more broadly, how do we emerge from this pandemic not just with a little breathing room but a real fighting chance to get ahead? further things to take place at the kitchen table where i grew up and where all of you -- everybody is living, maggie, jean, annie, chris and me, we all ran for office to help answer those questions. the questions at the kitchen table. i used to get kidded because i spent so much time commuting everyday between moving to delaware after my wife and daughter were killed to back to washington, every single day, 260 miles a day. i would ride home and look out the window, this is the god's truth just outside of washington. i go through long stretch of residential neighborhood and i could see the lights on in the kitchens and in the dining rooms. i wonder, what is it -- what are they talking about? what are they thinking about? because that's why i reason. that's why these folks ran. it's about building, taking care of their legitimate needs and to make sure democracy delivers for everybody. you know, we promised that we couldn't just build back what we had before. we had to build back better. that's an environmental requirement. a highway gets washed out, you can't build it back to what it was before, used to be the measure, we have to build it higher. even if we gain control of the climate, we're still -- it's not going to go back to what it was before. it's not going to be that way. despite the cynics, democrats and republicans, we can work together. we can deliver real result. we can deliver real people results that are going to affect their lives. and that we're taking a monumental step forward in building back better for this nation. my message to the people of new hampshire is simple, it's this, because of this delegation, new hampshire and america are moving again. your life is going to change for the better. that's literal. for example, the bridge here, i just walked across, opened in 1939. 82 years ago. this may not seem like a big bridge, but it saves lives and solves problems. let me tell you why, businesses depend on it. like the local propane company or the sand and gravel company or the logging trucks, public services depend on it, school buses, waste water trucks cross it everyday. it's essential to woodstock fire station about a quarter mile away. without these bridges i said earlier, 10 mile detour to get to the other side. having had a house burned down with my wife in it, she got out safe god willing, having a significant portion burned, ten minutes makes a hell of a difference. it makes a big difference. folks, every mile counts. every minute counts in an emergency. and folks, this is a bridge that has been structurally deficient for years. i'm preaching to the choir here, i know. but the fact is it used to be able to carry 40 ton trucks. now the bridge is down to 20 ton restrictions. and a couple weeks it will be closed to put steel plates down over -- excuse me, down and over the weekend for sections of this deck. that still plays basically like putting a band aid on a major wound. this is going to make a bumpy for drivers, difficult for snowplows and still dangerous for bikers. and when that's done, the bridge may need even more weight restrictions. the state has already spent a quarter of a million dollars in band aid repairs on this bridge alone. and right now there are 215 bridges in your state, 215 bridges deemed structurally unsafe. in new hampshire alone. many of them are less trafficked bridges. they're often overlooked when decisions are being made about where and how to invest and rebuild. these bridges are essential in small towns, rural areas, farmers and small businesses like in my state of delaware. not only about 700 -- you have about 700 miles of highway in new hampshire that is listed in poor condition. cost new hampshire drivers estimated extra 476 dollars every year per person driving in gas and repairs and longer commute times. that's $476 in hidden tax on new hampshire drivers. as a result of deteriorating infrastructure. but thanks in infrastructure law we're going to make the most significant investment to modernize our roads and bridges in 70 years. law is going to speed up replacement of bridges by the year and allow new hampshire to invest i
