there's no exception in the law for kyle rittenhouse. >> all eyes are on kenosha, wisconsin where a jury will deliberate the fate of kyle rittenhouse. the american journalist donny finster is free in myanmar. and president biden taking a victory lap for his historic infrastructure bill, but other issues remain. >> announcer: live from london, this is "cnn newsroom" with max foster. this tuesday, november the 16th, and just hours from now, a jury any kenosha will begin deliberating the fate of kyle rittenhouse. the high-profile trial in wisconsin has stirred debate on racial tensions and vigilanteism in the united states. of rittenhouse is accused of fatally shooting two men and wounding another during anti-police protests last year. the teen has pleaded not guilty to all counts against him including intentional homicide. cnn's sarah sidner has more from kenosha. >> reporter: was kyle rittenhouse practicing vigilante justice or self-defense? >> now you've heard the evidence and it's time to search for the truth. >> reporter: the 18-year-old's fate now hinge ons that question as attorneys make their final arguments to the jury starting with the prosecution. >> a lot of cases were here trying to convince the jury the defendant killed somebody. that's not the dispute here. that's the easy part. the question is does he get a pass? >> reporter: rittenhouse killed two men and maimed a third in kenosha, wisconsin. he was seen on the streets with an ar-style rifle and claiming to be an emt. >> raising the gun. >> reporter: prosecutors opened the video with how he shot and killed his victims starting with joseph rosenbaum. >> you can see from the video mr. rosenbaum is not even within arms reach of the defendant when he first shot went off. and the defendant doesn't stop after the first shot. he tracks mr. rosenbaum's body all the way down, firing three more shots. >> reporter: but the defense painted rosenbaum as an attacker in pursuit of rittenhouse that night. >> he was a bad man. he was there. he was causing trouble. he was a rioter. and my client had to deal with him that night alone. >> reporter: his defense continued claiming prosecutors unfairly portrayed rittenhouse as an active shooter who had to be stopped. >> kyle was not an active shooter. that is a buzz word that the state wants to latch onto, because it excuses the actions of that mob. >> reporter: the the prosecutors countered saying his actions were far from self-defense. >> you lose the right to self-defense when you're the one who brought the gun, when you're the one creating the danger. >> reporter: rittenhouse now faces five charges in addition to lesser offenses connected to the case. the judge allowed today. he has pleaded not guilty to all. the six misdemeanor possession of a weapon under age was dropped after the gun size was found too large to qualify for that charge. >> is it legal? >> it is not a short-barreled shotgun or short barreled rifle. >> either by barrel or overall length? >> correct. >> and count 6 is dismissed. >> reporter: a blow to the prosecution on what could have been their easiest win after eight days of testimony and more than 30 witnesses, acquittal, of course, remains on the table. both sides with clear arguments leaving the jury to decide who is right. the defense leaving the jury with this sentiment. they are telling the jury every person who was shot by kyle rittenhouse was attacking him. but the prosecution and its rebuttal and its closing arguments said that kyle rittenhouse brought a gun to what could have just been a fist fight. sarah sidner, cnn, kenosha, wisconsin. >> earlier cnn asked criminal defense attorney patrick and laura coates federal prosecutor to weigh in on the trial. here is what they told us. >> rittenhouse very easily could have put his weapon down at that point, put his hands in the air and said, take me to the police. he didn't do that. he kept jogging down the street with the rifle. it almost looked at me at one point in time he pointed the rifle at someone who was verbally confronting him which would have been consistent with what the prosecutor was arguing he had done earlier in the parking lot. so i think a jury that looks at that, particularly somebody who came to the box with a strong belief that resorting to lethal force should be the absolute last thing that somebody does, is going to look at that and say, yeah, this guy had other options. he didn't need to resort to lethal force in every one of these situations. >> the idea, was it reasonable in this jury's mind that at the time he felt that the chaotic situation that he perceived enabled him to act this way. and that's why it is such an odd thing to use the use of force expert in the testimony. they are trying very much to align him as if he is some member of law enforcement or somehow an extension of that. and that's dangerous obviously for our society. this is a 17-year-old with an ar-15 who got off with possession over a technicality at this point. that's the theme of their defense case now. >> in the coming hours, 12 people from the jury pool of 18 will be randomly selected to decide kyle rittenhouse's fate. cnn will, of course, follow that story and cover all of the live trial proceedings throughout the day for you. now, we are getting more details about what happened at monday's virtual u.s./china summit. a senior official said talks between president biden and xi jinping were a healthy debate. a read-out from the white house said mr. biden raised human rights concerns in tibet and hong kong and the need to protect workers from trade practices. here's what mr. biden said laid out at stake. >> our bilateral relationship evolved, seems to me we'll have a profound impact not only on our countries, but quite frankly the rest of the world. i think it is important we communicate honestly and directly to one another about our priorities and our intentions. >> well, we are learning there more about the heated words about taiwan as well. for the latest beijing bureau chief live in the chinese capital, will ripley is in taiwan for us as well. will, it is the topic here, seems in tractable as well, what did you learn in terms of progress on taiwan? >> reporter: well, it is the number one issue when it comes to u.s./china relations from the beijing perspective. i know steven can probably speak more to that. from the mainland's perspective, taiwan is an inseparable part of china. here in taipei, they feel very differently. they've had their own government and their own military for more than 70 years, since the end of china's civil war. they want to forge friendships, if not alliances, with countries that will acknowledge taiwan as an independent self-governed -- you can't say country because china -- it's a red line for them. but in taiwan they call this island, this self-governing island, its own country and they want to be recognized as such. they fall short of declaring independence because they don't want to push beijing over that red line that president xi talked about in that read-out with president biden. china putting out more explicit detail about the taiwan issue. if the u.s. gets too close to taiwan and tries to build a closer relationship with taiwan, it is essentially playing with fire. beijing have said and they reinforced this repeatedly, they will respond if need be. president xi said he hopes for a peaceful reunification, even though again, the communist rulers in beijing have never controlled this island since the end of china's civil war. they still feel they have the legal right to represent all of china including taiwan. here in taipei, they want to know, and they'll be meeting with u.s. officials in coming days to get a read-out of what was actually discussed. here in taipei, they want a closer relationship with the united states. they're buying billions of dollars in weapons from the united states and they don't want to be essentially -- if u.s./china ties were to warm back up, they don't want to feel like they did for many decades, which is essentially ignored even as they made repeated complaints they were, in their view, being bullied by beijing. we've seen military intimidation with chinese war planes flying near taiwan at record pace. the leaders here on this island are concerned, but they are quick to point out they are talking to the united states, they are cooperating with the united states. there is military cooperation, hundreds of u.s., you know, service members or at least civilian contractors brought in by the military are here working with the taiwanese military helping this island continue to prepare to defend itself if things were to cross from, you know, rhetorical escalation to an actual conflict. >> okay. so, steven, from china's perspective, they laid out again, really, didn't they, in this call from what we know about it, the standard position. but what did we learn about the way that was presented to the united states? >> reporter: that's right, max. taiwan is just among a series of sensitive issues the two leaders apparently discussed at length and in a very candid matter according to both governments. you know, in a way, both leaders very much stuck to their governments' talking points with their officials, then cherry-picking the part that would sit best with their domestic audiences after the fact. for example, on taiwan. the chinese very much stressing mr. biden pledging to stick to the u.s. official policy of one-china. but what they did not mention, mr. biden also said that policy was very much guided by the taiwan relations act as will pointed out, that obligates the u.s. government to provide arms to the island to defend itself. and then this is the case on many other issues as well. but the whole point of this meeting even before it began according to many, of course, was to put a floor on this free fall in this relationship that began long before mr. biden took office. but his decision to keep most of his predecessors harsh measures, also building the coalition if you will with like minded democracies to counter a rising and increasing late aggressive china, not sitting well with xi jinping and his government. so the fact that both men who did have a history of personal encounters were able to have some face time, was considered a positive step. at least from what we have seen publicly, there seemed to be a softening in their tones. and here is what xi jinping said in his opening remarks. >> translator: we face multiple challenges together as the world's two largest economies, and permanent members of the u.n. security council. china and the united states need to increase communication and cooperation. we should each run our domestic affairs well, and at the same time shoulder our share of international responsibilities and work together to advance the noble cause of world peace and development. >> reporter: so, a lot of buzz words being thrown around there, but no major breakthroughs as expected because the whole point is to keep this kind of high-level communications open to avoid strategic miscalculation from each other. the best concrete result out of this, max, was now they have agreed to resume dialogue from lower-rank officials to talk about potential resolutions on a series of issues given how low the bar was to begin with. that can be considered progress, max. >> that's good news. steven, thank you very much indeed. will as well. a major win, meanwhile, for the biden administration on infrastructure. >> okay, here we go. [ applause ] >> president joe biden will be taking a victory lap around the country to sell the bill he signed into law to the american people. he'll be making his first stop in new hampshire. the legislation includes money for roads, bridges, trains and broadband. president biden said it will help ease supply chain issues. >> here in washington we've heard countless speeches and promises and white papers from experts. today we're timely getting this done. so, my message to the american people is this. [ applause ] america's moving again, and your life is going to change for the better. [ applause ] >> the bill i'm about to sign into is proof that despite the cynics, democrats and republicans can come together and deliver results. we can do this. the migrant crisis at the border. it adds to the measures of the european union what it claims are the weaponization of migrants by belarus. german chancellor pushed for humanitarian aid and an end to the standoff. in the meantime, thousands of migrants are stranded at the border and increasingly dire conditions. cnn's fred pleitgen is at the poland/belarus border we very latest for us. what are you seeing this morning, fred? >> reporter: hi there, max. it certainly seems as though the situation there on the border between poland and belarus remains quite tense. in fact, the poles came out this morning and said in the past 24 hours there had been 224 attempts to breach the border including one case, fairly large attempt the poles said they thwarted. polish authorities also put out videos of what they say are belarusian forces actually trying to cut the razor wire fence. apparently they stopped doing that once the polish forces started shining light on them and also started filming them as well. so you can see the situation remains very tense after, of course, you had that standoff that happened yesterday. we are hearing that there might be some commotion also actually going on right now at that border. in fact, what we've seen in the past couple of minutes is an increase in polish vehicles, first and foremost police, but also military vehicles rushing towards the area of the border. it is unclear what the situation is there right now, but you can see the poles continue to take this very seriously. meanwhile, you have that diplomatic full-court press that's been going on by the european union, by european leaders. the e.u. saying there are going to be new and very tough sanctions, not just against alexander lukashenko's regime, but also against anybody who they say has been benefiting from bringing migrants to belarus and then trying to push them across the border. it was quite interesting because late last night, the german foreign minister, of course, most of the folks who are on the border there waiting, wanting to go to germany, the german foreign minister unequivocally said the migrants will not be taken by germany. he said they must remain tough and called it blackmail against the european union by the regime of alexander lukashenko. >> fred pleitgen, thank you. tensions high on the border of russia and ukraine about the military buildup in that area. france and germany are urging russia to be transparent and say any attempt to undermine ukraine's territorial integrity will have serious consequence. nato secretary-general is also warning allies to be realistic about potential aggression from russia. the u.s. state department is condemning russia's an satellite test as dangerous and threatens the satellite over the weekend. the u.s. said the test created hundreds of thousands of pieces of space debris. crew members on the international space station had to take shelter in their docked capsules several hours as a precaution. >> this test will significantly increase the risk to astronauts and cosmonauts on the international space station as well as other human space flight activities. russia's dangerous and irresponsible behavior jeopardizes the long-term sustain ability of outer space and clearly demonstrates that russia's claims of opposing weaponization of states are disingenuous and hypocritical. >> to deliberate the fate of kyle rittenhouse. in 12 hours, 12 people from the jury pool of 18 will be randomly decided to select the verdict. president biden will take a victory lap across the nation selling the benefits of his newly signed infrastructure bill. on monday he signed his $1 trillion bipartisan legislation. lawmakers will now shift their focus to passing the president's build back better deal. in the coming hours, the medical examiner will testify in the ahmaud arbery murder trial. that's after the judge denied the motion but all three defense teams to declare a mistrial. they claim the presence of civil rights leaders might distract and influence the jury. reverend jesse jackson sat with members of the arbery family in court on monday, which arbery's mother called an honor. she also spoke about the gun used in her son's shooting. >> a lot of evidence finally got a chance to see the actual shotgun that killed my son. i often imagine how it looked and i finally was able to see the actual weapon, so that was kind of hard to procession. but i'm glad i was granted the opportunity the chance to see it. >> cnn's ryan young has details on the trial and some testy exchanges in the courtroom. >> i will say that is directly in response, mr. goff, to statements you made which i find reprehensible. >> reporter: the judge presiding over the murder trial of ahmaud arbery, ripping into defense attorney kevin goff today. >> the colonel sanders statement you made last week i suggest may be something that has influenced what is going on here. >> reporter: judge timothy reacting to statements like this one from goff, who is representing william roddy bryant. >> that's it. we don't want any more black p pastors coming in here, jesse jackson whoever was here earlier this week, sitting with the victim's family trying to influence the jury in this case. >> reporter: that comment in response to reverend al sharpton thursday, not jesse jackson, he did apologize, but today. >> we have all these community leaders the city is going to burn down. >> reporter: this time civil rights icon jesse jackson was in the room and goff again taking issue. >> which pastor is next? is raphael warnock going to be the next person appearing this afternoon? we don't know. your honor, i would submit with all respect to the reverend jesse jackson that this is no different than bringing in police officers or uniformed prison guards in a small town where a young black man has been accused of assaulting a law enforcement officer or corrections officer. >> i've heard the motion. i understand what your position is. and if it's simply to point out that an individual is in the gallery, it has been done. >> reporter: all three defense attorneys asking for a mistrial. >> i move for a mistrial. >> based on? >> based on the presence of the people in the courtroom. >> reporter: the judge is denying their request and jackson isn't going anywhere. >> my people are in need and backs against the wall. it's what we do. so we're going to keep sitting with this family. >> reporter: the back and forth in this case -- >> we want to take you to the poland/belarus border. matthew chance has breaking news for us. matthew. >> reporter: it has come to me right at the border between belarus and poland. i'm going to flip the camera around. some very dramatic scenes playing out as you can see. the migrants angry at their reception by the polish authorities and being disallowed from getting into the european union have reacted angrily. they started throwing stones -- oh, my god, we're being blasted with water cannon from the poland side. tear gas as well. flash bangs going off. you can see a helicopter up there. -- advance into this area across -- i should say to push back the protesters who are over here -- in their makeshift camp near the border fence throwing stones, and charging the barricades that are being manned by the polish border authorities. you can see some migrants there actually sort of throwing -- approaching the poles and throwing stones as the water cannon there blasts out what is acrid water, i have to say. it got in my eyes. to push the migrants back. so, a very dramatic situation here. of course, the migrants have been very sort of angry at the fact that they've been stuck in these camps for more than a week in freezing conditions, very little food, very little water. yesterday they marched en masse onto the polish border, but have been refused entry by the polish guards that stood -- this whole crisis is being manufactured by the belarusian authorities. to put pressure -- excuse me. to put pressure on the european union as punishment, as revenge for the economic sanctions that have been imposed against the belarusian state for its human rights abuses. as you can see, there is no sign at this stage of the polish authorities, the e.u., of backing down and allowing migrants to -- this outburst, this boiling over of frustration into violence here on the belarus/poland -- so i'm just wiping -- as i say, it's quite acrid water. i've got some here, i don't know what. it's sort of stinging -- >> okay, we're going to leave it there. obviously they're changing scene. matthew needs to get sorted and get some attention there. we'll be back with him, of course, with any updates once it's safe to bring it to you. american journalist, meanwhile, danny finster is expected to speak in the coming hours after being freed from a myanmar prison. his release on monday was negotiated by former diplomat bill richardson. it comes days after finster was sentenced to 11 years behind bars by military court. he was arrested back in may. one of dozens of media workers detained in myanmar since february's coup. for more we're joined by senior cnn international correspondent ivan watson in hong kong. he did come out more quickly than everyone expected, ivan. >> reporter: he did. it was friday that finster was sentenced to 11 years in prison for three different charges and he had yet to be formally prosecuted for a much heftier potential charge of violating myanmar's counterterrorism law which could have gotten him life behind bars. suddenly monday this announcement which was clearly brokered in part by the former new mexico governor, ambassador bill richardson that finster would be released. now, he was first detained back at the end of may when he was trying to fly out of myanmar back to his home state of michigan. he was the managing editor of an online publication called "frontier myanmar," and he is just an example of more than 100 journalists that have been detained since the military staged a coup overthrowing a civilian-elected government on february 1st. now, when he touched down for his layover in doha alongside bill richardson what look like a private plane, he did speak briefly to journalists. take a listen to what finster had to say. >> i'm feeling all right physically. it's just the same privations that come with incarceration, you go stir crazy. the more it drags on the more worried you are it's never going to end. that was the biggest concern, just staying sane through that. >> reporter: he said he wants to keep the focus on others who still remain behind bars. meanwhile, i just want to point out the u.s. secretary of state anthony blinken put out a tweet saying he had spoken with the american journalist who is free from prison in burma and will reunite with his family in the u.s. he shared the very best wishes from all of us at the state department, and looks forward to welcoming him home. a happy ending for a journalist -- for one journalist. the u.n. says there are still dozens languishing behind bars and it is effectively a crime under the current military regime in myanmar to practice journalism in public. cnn, we know, of journalists who have gone into hiding or have even fled the country since the february 1st coup. matt? >> absolutely, ivan, need to keep the attention on those guys still stuck. thank you. breaking news out of uganda meanwhile. blasts rocked kampala, 10:00 a.m. near the central police station. the second blast went off less than 30 minutes later near parliament. cnn's layrry maduro joins us frm cnn. the early days, what more do we know? >> reporter: max, there is more we don't know than what we do know. there were two explosions within 30 minutes of each other in the heart of ckampala, in the heart of uganda capital. one at the parliament. they are sitting, telling them not to go to parliament because the security forces have corr cordoned off that area. we have seen social media video which appeared to show some bodies lying on the ground. there have been ambulances ferrying people who are injured from the scene to hostels around there. and that's as much as we know right now. there's been nobody claiming responsibility for this attack as yet. we don't know if it's a bomb or some other kind of explosion at this stage. police have not yet given a statement. they said they will be having a comprehensive update later on. obviously we'll have more information at that stage. but some important background, max. a month ago there were two other explosions in kampala, one at a bar and another on a bus that ferried people to other parts of the country. and police at the time said they
