scott at the astroworld music festival in houston. video from that soldout event shows the moment travis scott pauses and then he looks on in confusion as an ambulance moves into the packed crowd of about 50,000 fans. witnesses described the rush of people squeezing against them leaving them with nowhere to go. >> it was going on for over two hours. it just got worse and worse. you just can't breathe. you feel like there is a weight on you. >> it was so hard to move your arms, to breathe. i was pushing in front of me just to breathe. just breathe. >> i just remember looking up and passing out. and then i was in and out for a little while. i didn't see anything. i could kind of feel what was going on. someone pulled me over a fence. and i was sat in a chair and then i passed out again. when i woke up, i was in a different area in a chair with a water bottle on my lap. >> the houston mayor says there are plenty of unanswered questions tonight and calls it an active investigation. cnn has the very latest for us, rosa? >> reporter: you know, the investigation has really escalated in houston because of the account of a security officer that was at the scene and says that he felt a pick in his neck. then he was treated with narcan and then he was revived. according to the police chief. according to the chief, he was not the only one that was treated with narcan. the chief says now narcotics and homicide division are part of this investigation which started off with them simply looking at what was causing a mass of people compressing toward the stage. well, now, the narcotics division and the homicide division are involved in this investigation and officials are calling for answers. we're also learning the ages of the individuals who died. eight people have died. the ages are between 14 and 27. we don't know the age of one individual. the number of people were transport to the hospital has increased from 23 to 25. there are 13 people who are still hospitalized, five of them are children. i've talked on eyewitnesses, people who were there who say that it was very difficult to breathe during this time. now according to authorities, at about 9:15 is when the crowd started compressing toward the stage. by 9:38, authorities say this turned into a mass casualty event. the individuals that i talked to who were at the scene say that depending on how tall you were is how much oxygen could you get. when you think about the children transport to the hospital, think about that. the individuals i talk on said it was very difficult breathing. the individuals who were taller, the adults, had an easier time breathing because they were able to gasp for air. so a lot of questions still remain in this case. authorities here say that a thorough investigation will be conducted because the families of the individuals here who have died need answers. >> understandably. to think that depending on your height you could breathe or not breathe. thanks to rosa. i will joined by paul, a crowd safety expert. also the founder of crowd management strategies. also, anthony barksdale, former baltimore acting police, nice to see you both. you have started crowd crushes for decades. some call you the marshal of the mosh pit. from your experience, how does something like this happen? >> this is a classic rock and roll tragedy that was preventible. i'm sorry to say the but it was. one of the most dangerous areas at concerts is in front of the stage. that's where tartist is. people want to be close to the artist. if you don't manage the crowd, manage the density, manage the people, you end up with crowd crush disasters like this where people die from asphyxiation or from heart attacks due to strard pressure on the crowd. so this was a preventible situation. it should have been identified in the risk assessment planning for this event and in the emergency plan. in fact, if i mate add, the fire marshal of houston adopted the national fire protection safety code, life safety code 101 2012. in that code, there was a specific section that addresses this exact situation that occurred. the festival seating standing room crowd crush. and leaves and addresses certain steps to take to prevent it. >> and we heard from the officials on the ground that the capacity could have been more than 200,000. they limited it. they capped it at 50,000 based on the ticket sales and everything. but all of that is under investigation as well. i want to bring you in. earlier on cn insure, you had the mayor of houston saying, in the last 30 years, nothing like this has happened in the city. what will investigators be looking at? >> you have a lot to look at. first, what was the clear structure of command, the chain of command. where would a resource be staged? do we have medics in the right place? how can a mobile vehicle move through such a crowd? sometimes in baltimore, we would put medics on bikes or on foot to get to victims faster within a crowd type situation. the spiking, what we're hearing now, is that there is a possibility of spiking where someone may have injected people with a needle. we've heard of that in the united kingdom. they're having episodes of this over there. so do we have that type of claim going on in america now? so we have to look at that angle. there is a lot of work to be done and it requires those who threw this event to look at them's. the police, the security, everyone to examine. where did this go wrong? and i agree this is a preventible type of disaster. >> let me step back and reinforce some of the things that were just said. you start with the risk assessment for the event. what are the things that could go wrong and how will you mitigator prevent them before you decide if you will do the event? one of those things that would have come up is crowd crushing and crowd surge. look. a lot of investigation that has to be done. but the drug part likely subterfuge. this was a failure to manage the crowd and an overcrowded situation in front of the stage that fails to meet national standards, including the national fire protection association standard for festival seating, and running those events properly which says, reduce the capacity, have especially trained crowd managers, and number one, do a life safety evaluation. so we need to know if the city of houston did a life safety evaluation for that address that would have dealt with festival seating, standing room environments. the victim, the people who died. they're the victims of this disaster. they're the people put into a crowd, into a crowd environment beyond their control. who manages the crowd? not 16-year-old susy, not 18-year-old johnny. the people who organized it. the facility operator, the promoter, the people who approve it. we also need to see the crowd management plan, the emergency plan. and see who was involved in those aspects. that's where you find what went wrong and why it went wrong. >> it is just so, so awful. thank you for helping us understand what they're now investigating. and what you view as what could have been preventible in this case. just heart breaking. we appreciate it. >> thank you. >> thank you. we're also following breaking news out of new orleans this evening. that's where a federal appeals court, the fifth u.s. circuit court of appeals has put a temporary halt to president biden's vaccine mandate for larger coils. certain health care workers and federal contractors. 27 states have already filed lawsuits to challenge that mandate. i will now bring in jennifer rogers who joins us to break it down. what is your reaction to this? >> in the first place, the fifth circuit has issued a stay which is of no moment. the rule wasn't supposed to take effect until january anyway. so what it means, the fifth circuit will evaluate this after briefing an argument. the question is, will they actually strike down this rule? if they do so, they have to do it on either statutory or a constitutional basis. the order said they had concerns about both. i don't see any problem here unless they can identify specific statutory failure like the process was problematic. which they said is not the case. i don't see any constitutional issues. either the fifth circuit will reverse and it find there was no problem or if necessary it will go to the supreme court. >> the government argues this is about workplace safety over which the government has broad powers. what do you think? do you foresee it being overturned on constitutional grounds? >> definitely not on constitutional grounds. the government does have a broad ability to pass rules to ensure the public safety and to ensure workplace safety. the pandemic continues to kill over 1,000 people a day. the vast majority of whom are unvaccinated. so no question there is a rational basis for this rule. then the question becomes, does it unconstitutionally discriminate against protected classes of people? [uplifting music playing] ♪ i had a dream that someday ♪ ♪ i would just fly, fly away ♪ ok everyone, our mission is to provide complete, balanced nutrition for strength and energy. whoo hoo! ensure, with 27 vitamins and minerals, now introducing ensure complete! with 30 grams of protein. now to a new headache for the jikt committee. it has 20 subpoenas signed and ready to go. enforcing the ones so far has already proven to be a big legal struggle. jeffrey clark is a former trump administration justice department official who the committee says is a key witness. but clark has now refused to answer any questions and promises, he won't until a court compels him to. here with me now, cnn legal analyst norm housen who served during president trump's first impeachment. nice to see you. so there's no legal basis for clark's claim, right? >> thanks for having me back. that's exactly right. there is no basis for him to refuse to answer questions. he got a lawful subpoena like anybody else in the united states. if they receive a subpoena, they have to appear and answer questions. he claim he is exerting executive privilege and other privileges. but we only have one executive in the united states. the one who decides whether or not there is a privilege, whether information is confidential and questions have to be answered or not is the current president. joe biden. so when biden has said that through his justice department, that there is no privilege as to clark. clark must answer. >> the bottom line is steve bannon has been fighting this and doj is now looking at the situation. doj has not done anything though. as far as we know. are you surprised that we don't have anything from doj about whether or not they'll prosecute for not complying with the subpoena? >> i'm not surprised. it has only been a couple of weeks. this is a momentous decision and i think that there is a certain amount of process that doj needs to maintain. it's not unusual to have a delay of a couple weeks. i do believe it is a clear case. i believe the doj will act. when do we put into sales, she signaled the judge who last week heard donald trump's executive privilege claims, and essentially pro announced them as a bunch of hoo-ha. a two-week delay in this kind of case is not unusual. >> so what does the committee do now? do you expect other trump administration officials to do the same? >> so far to the best of our knowledge, the only two individuals who have taken this defiant stance against the committee are steve bannon, the subject of the criminal contempt investigation by doj that i believe will result in charges, and now clark. the others are negotiating, and pamela, remember, the committee has interviewed, according to its vice chair, republican congresswoman liz cheney, over 150 people. they're going full speed ahead. i do think that we'll see that next batch of subpoenas. there have been just shy of 20 so far. another 20 waiting to go. i think we'll see those including building on what they've heard from that first 150 people. undoubtedly, some responding to subpoenas, some volunteer and we know they've talked on other trump administration officials including clark's colleagues at the trump d omp j who resisted his efforts to support president trump in baseless attacks on the election. so the committee will continue full steam ahead. so far they're making good progress. >> as you pointed out, they're working at a furious pace from the reporting out there. who do you anticipate them on bring in next and what will they try to learn? >> well, the evidence that has been coming to light has su suggested that the vice president, his lawyers and his colleagues have come under, came under intense pressure to do the wrong thing, to violate the law, and to overturn legitimate choices in the election of 2020. so i expect the vice president, former vice president's circle will be included in this next batch. and others indicated to have information by the 150 formal and informal interviews so far. these court cases are moving quickly and i think we'll see doj action as they complete their deliberations as well. >> all right. we'll be waiting to see what happens. thank you. >> thank you. a quote, death trap. how people who were caught up in the deadly houston concert stampede describes surviving the chaos. you're in the cnn newsroom. heartiness? yes! living life to the flavor-fullest? heck yes. panera. live your yes. now $1 delivery. >> the history is that it is really hard to translate legislative success in your first year into political success in your second year ronald reagan passed the tax cuts in '81. republicans lost the votes in the house in '82. religionon johnson, probably the most productive with medicare, medicaid and they lost about 45 seats in 1966. of course, obama passed the affordable care act and lost seats in 2010. that does not mean this is without value for them. i think fair you'll to expose them to even greater risk. if they can supplement it with the broader agenda that he has on the table and which looks now like it finally cleared for landing, it is highly likely it could help them by 2024. how long does it take to feel it? one year is a little narrow. three years, plenty of time. >> i'll go to you. just to get your take on it. on the outside, as you know, there was so much back and forth over the infrastructure bill. it finally passed in the house. we're all looking at the spending bill. this dysfunction is normal, they said. this is how the sauce is made. this isn't necessarily dysfunction within the democratic party. how do you see it? >> well, it's clear. look. this infrastructure bill is a good thing but it should have passed two months ago. they should have had it done in august. they could have been selling it. these mid-terms are usually driven by the party of the president. it is the president's approval rating that impacted the races the other day in virginia and new jersey. the social services spending bill, the bull back better, still has many problems. they may pass it out of the house but it is not clear what it will accept. and frankly, i think the bigger issue for democrats is what is on voters' minds. they're worried about rising prices, supply shortages. the afghanistan failure is also still front of main for many people. it seems to me the build back better legislation is still too big and it is not being sold well. and i think that will represent problems going forward. let's talk about the races. republicans won in virginia. that is a state that joe biden won by 10 percentage points. glenn youngkin also kept some distance from trump. i sat down with white suburban moms who vote for trump in 2016 and against him in 2020 and that, voted against trump in 2020 that that, part of the appeal of youngkin's appeal was that he focused on education. that's not something normally republicans focus. on listen to what one mom told me about the warning about trump joining at events. >> i said you bring donald trump over into virginia. i'm not helping you. there is no way that i can get on camera or the radio and support that. >> but he heard us parents talk to him at these events. he met with us. and that's when he changed his focus. >> that's really telling, too, that he heard us. and listened. so that made me realize. >> so you were sold. >> absolutely. >> three of the four voted for biden and then for youngkin. and then on the flip side, you have carrie lake. is trump a king maker or a spoiler? >> the answer is some of both. first of all, history is clear. it is easier for candidates to win in states that vote the other way for governor than for senator or the house. there are republican governors in maryland and massachusetts and vermont and there are democratic governors in kentucky and louisiana, in states that the other side, that their party could never carry any presidential election. and i think the governor races are somewhat insulated from the intense partisan level. they do turn on different issues. . in sense, i think that trump is going to be more relevant in 2022. both in terms of influencing republican primaries but also, with democrats, i think, having a better opportunity to tie republicans to him. having said that, virginia like new jersey kind of captured the normal problem that a party faces in mid-term elections. all but three since the civil war, they lost the house and the reason is their voters feel less urgency about turning out than the side that's locked out of the white house and furious about everything going on and all the problems are compounded when the president's approval rating declines. in 2022, the key or the democrats is conditions on the grounds improving in people's lives. the perhaps are about 2024. but mid-terms are about the here and now. i think the share of the country that thinks biden has a handle on the economy, covid, the border and crime, that's what has to go up for the democrats to have a relatively successful 2022. >> and chris christie delivered a stern and sobering warning to fellow republicans that the 2020 election is over and it is essential to focus on the future. let's listen. >> we can no longer talk about the past. and the past elections. no matter where you stand on that issue. no matter where you stand, it is over. every minute we spend talking about 2020 while we're wasting time doing that, joe biden, kamala harris, nancy pelosi and chuck schumer are laying ruin to this country. we'd better focus on that and take our eyes through rear view mirror and start looking through wind shield again. >> he defended himself as a trump supporter but backed away from trump's endless kroeg of the big lie. what do you think about that? >> well, i think that kriss kriss is correct. in republicans need to focus on the future and make the mid-term about the party in power. the problem is how destructive will donald trump be in the coming primaries?
