apologize for the united states, the last administration. a key piece of the hundred of billions to fighting climate change in biden two signature legislative packages back home. those bills are far from finalized but a potential breakthrough is creating new optimism. house progressives signal that they support the latest framework for the build back better package and while there are still a number of sticking points an agreement could free up the smaller bipartisan infrastructure bill for a house vote potentially even this week so let's go right to phil factually live in scott lapd and lauren fox on capitol hill. few people doubt that the president's personal dedication to this summit, it is quite a change from his predecessor's but in terms of tangible results what has he been able to commit to in front of his international counterparts without that passed legislation? >> reporter: you know, i think, biona, when you talk to white house officials there's two pieces of this right now. there's the leadership piece which you heard the president and very candid remarks apologizing for the last administration pulling out of the paris climate accord and putting the u.s. and the world behind the eight ball and also the way the pendulum has swung over the last three decades between american administrations testing the resolve in terms of how world leaders view what the united states is willing to do. the president has made very clear. he wants the u.s. to be net zero emissions by 2050 and he believes they can cut in half between 50% and 52% of 2005 emissions by 2030. those are goals that he's laid out, and the way they plans to reach the goals is in a series of regulatory actions, regulatory actions as well, but crux of it is as you were noting, the legislative agenda still stalled on capitol hill. however, when you listen to the president talk about that age dark you recognize how critical it was that he release that framework before he left. that $1.75 trillion framework. no, it did not unlock a vote or unlock a final agreement but it put in black and white the $555 billion in that proposal directed towards climate, tax incentives and tacts credits, things without question to be the largest u.s. investment on the issue in the history of the country. the president continues to talk about that, refer to that, show that to world leaders to underscore that. not only is this a very different time from the last administration, this is a clear step by the united states to rally other leaders to try and have more ambitious goals coming out of this shepard yeah, it's notable that we didn't hear from china and, are two of the world's current greenhouse gas emitters, right, because the plans that they have submitted are not as large and not as expensive as the one that president biden has laid out. lauren fox, this brings me to you, the progressives seem to think that senators kyrsten sinema and joe manchin are finally on board with the laernl spending bill but neither has publicly said where they stand. i do hear that we'll be hearing from manchin at some point today. hopefully that will clear things up and that's what he's alluding to. what's the latest on that? on his way into his office this morning he told us the plan is to clarify where things stand later today. i've been outside his office for the last hour and a half. he hasn't emerged yet, but the hope is that he might be able to provide some sense of where the democratic negotiations are right now. it's not clear whether or not he'll come out in support of the entire biden framework or whether he'll come out and announce the key issues with the framework. we know behind the scenes he has concerns about expanding medicare at all because he argues that the whole program isn't solvent as it's structured and, therefore, expanding it doesn't make a whole lot of sense. that's been the argument. progressives did move over the weekend saying that they do plan if pelosi brings both the bipartisan infrastructure bill and that larger social safety net bill to the floor that they would support en masse that infrastructure bill. that is a departure from where they were just a couple of days ago when the president made that forceful push on capitol hill. he came up here making the show before he went abroad, that he wanted both of his legislative priorities to pass. progressives are in a different place today, but is manchin in a different place? that's the question we still don't have the answer to at this hour. bianna. >> i think manu raju will be waiting to hear what he wants to clear up. phil mattingly and lauren fox, thanks for the latest there. we'll turn now to virginia, election eve in a crucial proxy war between the president and his predecessor. democratic candidate terry mcauliffe has linked himself to the biden daj while his republican candidate has courted the trump wing of the gop while trying to keep trump at an arm's length but pay parent lit former president didn't give the memo. this morning he gave the full-throated support for youngkin saying he and youngkin get along well and agree on many of the same policies. joining me now is chief political analyst gloria borger and reporter jeff zeleny. terry mcauliffe was really banking on the passage of the two biden bills and what we see now is he's doubling down on his attacks against trump and really playing defense on social issues like education. does he think that's a winning strategy at this point? >> it's the best thing that he has because the reality is terry mcauliffe and his campaign have been doing one thing above all. looking for those biden voters. a year ago joe biden won the commonwealth by virginia by ten percentage points, so there are millions of joe biden voters out there. yes, they may not be as enthusiastic. yes, they may not like what they are seeing, all of them, in washington with this democratic divide, but that is what terry mcauliffe has been trying to do to make his opponent a trump-like clone, but that has proven to be much more difficult than any democrat expected. that's because glenn youngkin, never run for office and people well know donald trump. he's defined himself again and again and glenn youngkin doesn't act like drew. at the end. day, it's long too late for the democrats to pass this agenda. there's more than a million early votes already cast there, so what they are trying to do now is simply fire up the democrats who voted for joe biden and pull them into the fold tomorrow. again, 1.1 million people have voted early. they are expecting potentially up to 3 million people. that would be the outside of the expectations, so tomorrow most of the vote is still going to come in shepard yeah. look, gloria, one can understand why so much attention is focused on this election, but it does beg the question whether this is a bellwether election that should worry democrats given the current momentum that youngkin is experiencing, sore this to be expected in and off-year election where voter turnout for the opposing candidate can be trivialized? >> i think democrats should be very worry about this. this is a state that joe biden won by ten points. his popularity now is somewhere in the low 40s. the democrat voters in virginia do not believe he's delivered for them and he's got to keep the independent voters out there, the suburban women out there. you don't want them to be disappointed, and, you know, youngkin has been clever in this campaign. he's managed to walk a fine line which is to say, for example, that he believes in the so-called election integrity but he's not out there shouting stop the steal, so he's managed to -- maybe because he's not a politician, hasn't run for offers, et cetera, so it may be that he's able to do this better than other candidates, so he's been able to distance himself from donald trump as much as terry mcauliffe wanted to portray him as a clone. he's managed to distance himself, and -- and yet hopefully he believes, you know, kind of attract the trump voters also because he's not a democrat and they hate joe biden shepard and that is a big question, jeff, because given that he's gone out of his way not to offend trump but not necessarily align himself with him, what does that say about what turnout is going to look like? mean, do you think that a lot of trump supporters will nevertheless turn out to vote for him? >> well, that's exactly why the former president is going to be calling in to a telephone rally. we know that donald trump loves his rallies perhaps more than anything else but he's been left to be heard and not scene but he'll be calling into a rally this evening with one point overall trying to energize his voters, the trump voters in rural parts of virginia. even in the suburbs, so it has been a tight rope that glenn youngkin has been walking no, question. up until now fairly successfully, but we'll see how much those trump base voters actually come out and involvement the biggest question overall is how many joe biden glenn youngkin vote remembers out there? how many people out there particularly in the suburbs of washington and in northern virginia who voted against donald trump because they did not like him but they are trying to take a chance on glenn youngkin? i've met a handful of them but we don't know how many crossover voters there are. that will help decide the ration tomorrow shepard biden beat trump last year by ten points in this state shepard yeah. >> gloria, at the end of the day tomorrow, if mcauliffe does pull out this win also, that just be a win for win's sake and democrats walk away relieved, or will they be looking at any sort of lessons that they can learn from this experience? >> well, if mcauliffe wins, it's very unlikely that it's going to be by ten points, so it would be -- it would be a very narrow victory, and i think democrats would have to start asking themselves questions about whether running against trump is enough because -- because what youngkin would have done is to sort of walk that fine line that jeff and i have been talking about, agreeing with trump on some of the social and cultural issues without being bombastic. he looks like an establishment republican, right, and, you know, what kind of candidates are republicans going to start running perhaps in house races, et cetera, and i would be nervous if i were a democrat with a president at 40% popularity rating right now. i would go right back to capitol hill, and would i pass these measures and would start talking about them immediately and what they can do for voters out there and how the democrats have delivered, but in this particular case, you know, unfortunately, for terry mcauliffe, they didn't do it in time shepard instead, they are talking about school books shepard that's right shepard jeff zeleny, gloria borger, our coverage will obviously continue through tomorrow night. thank you very much for this. appreciate it. well, the supreme court today looking at live photos today are hearing two challenges to the most restrictive abortion law in the country, and it appears that the justices have real concerns over the way the texas law was drafted. plus, more than 2,000 new york fire department personnel have called out sick just as the city's vaccine han date for all city workers goes into effect. we'll have details coming up just ahead. how've you been? >> well, bianna, he says that they have the resources. they have the personnel and most importantly they have a contingency plan to make up for the loss in the workforce and staffing issues that they have actually encountered. they are started tone counter over the weekend having to reshuffle some of the resources around to make sure that the calls don't go unanswered and to make up for the roughly 2,300 fifthers that have called in sick for one reason or another. we heard over the weekend from northern's fire commissioner who said that many of the absences are directly linked to anger about the mandate. at this very spot i heard from one of the firefighter's unions early this morning and they said that's not the case. this is no organized effort, but nonetheless, certainly something that they are looking into here. at the same time you also have about 9,000 city employees that's across the board from the various departments that as of this morning have actually been sent home and placed on unpaid leave because they do -- they are not adhering to that mandate. it requires that all employees be vaccinated already. when it comes to the resources that they are having to move around. as we heard from mayor bill de blasio saying they have seen the impact here. they have had about 18 fire companies that have been temporarily taken out of service, but for good context, that's out of 350 city weighed so the mayor saying this is a department that is massive. there's plenty of resources. shepard we know right now, fire houses are open. no fire house closed. response time is normal. the fire, ems and nypd this. mandate was the right thing to do and the proof is in the pudding. we now see it worked. >> reporter: finally, let's take a look at the latest vaccination number, especially some of those that have to deal with public safety. we talked about the fire department already seeing a significant increase with about 80% of their members of the department in compliance of this mandate. they are partners over the police department. that number at 85%. right now according to the numbers released not too long ago by city officials, bianna, that's 34,000 out of 35,000 uniformed personnel at the nypd currently on unpaid leave and overall all city department 91% of them are vaccinated and in compliance so we certainly have to see if the rest them can potentially make an impact in terms of any lack of manpower later in the coming days. >> it's so important. thank you for putting it into context showing that the majority of these work verse indeed been vaccinated or at least received their first dose of vaccine. thank you so much. with us now is dr. william schaffner, professor of infectious disease at vanderbilt medical center. doctor, it always great to have you on. we know this isn't just impacting cities like new york. other cities like chicago are dealing with this as well and you call mandates like this a reasonable request, so what is your reaction to what you just heard from paolo and his reporting here in new york city? >> well, first of all, i'm very glad that the vast majority of public workers in those cities are being vaccinated, but you're talking to a doctor here in our medical center. everyone from the custodian through the "c" suite has to be vaccinated and we do that because we think it's an ethical and human responsibility. i also firefighters and police to think of this as your responsibility. we're fighting a war against this virus. so far we've asked volunteers to roum their sleeves and fight and then the virus got re-enforced by delta and now our society is asking to draft people in. we're asking people to be obliged to do that. it's a societal contribution. it's ethical. it's professional. we all ought to get vaccinated shepard look, there's a lengthy amount of research at this point showing that these vaccines are indeed safe so many months into this now, but this week, speaking of vaccines the cdc is expected to give its recommendation for pfizer vaccines for 5 to 11-year-olds. of course, it was given emergency use authorization last week by the fda. the cdc could recommend it as early as tomorrow. do you think a mandate for children in school is the right policy as well as we just talked about with regards to city employees? >> that's right, bianna, and on that decision it comes down to perception in this case and that's why prosecutors felt that one in particular is soy crucial. he hasn't anyone use the word victim during the point ever this trial. that's when it matters the most. touring this jury selection process that we've seen so far over the course of the day, is well, for one, kyle rittenhouse and his mother are in attendance as the proceedings play out. 179 prospective jurors are here, and the goal is to whittle it down to 20 total jurors which would include eight alternates, and then there is a small chance for the jury to be sequestered over the course of this trial. the judge bruce schroeder said he couldn't rule that out. in the first set of questioning, prospective jurors, they are being interviewed en masse by the dozens, and it's our understanding that those who aren't dismissed after that line of questioning would then get interviewed individually by the lawyers to then try and get to that process, of course, of eight alternate and jurors. both parties ask that juror questionnaires be sent out but that was denied. the judge wants this to happen pretty quickly. it's the goal to get a seated panel of jurors is less than two days with the trial length expected to last two weeks and sort of the parameters he's been giving to these jurors is saying that you are going to have a front row seat to exactly what happened and warned those who aren't on board with deciding strictly based on this evidence should say so, and that's sort of what they are using to whittle down, again, to that magic number of 20 shepard omar jimenez live in ken sharks thank you. for more let's bring in jennifer rogers, the cnn legal analyst and former federal prosecutor. jennifer, always great to see you. let's start with what's happening right now and what we've just heard from omar. jury selection, the judge denied requests from a jury list. what do you make that have? >> i find it very troubling. this is a political case. kyle rittenhouse has been adopted by the right wing, i think he's a hero and the left wing think he's a vigilante and this has become very political charged so the fact that the judge would not use a questionnaire is really problematic and what the judge needs to be done with the jury and i don't think it can be done accurately in two days is to weed out people who have political views about this and who cannot be fair and impartial so the notion that the judge wants to rip through this and to not use questionnaires is really troubling for that reason shepard given how politicized this has become, how do you expect prosecutors and the defense to approach this claim of self-defense and the notion that rittenhouse felt empowered by local police that night? >> well, it's very complicated because, of course, the prosecutors have the burden of proving the elements of the offenses beyond a reasonable doubt. that won't be too hard to do given that he obviously fired his we whon he did. the issue is self-defense and the first one thing did he really feel for his life and safety? did he put himself in that situation when he had no one to protect and after he shot the first man -- he try to stop them. there's all sorts of very complicated questions here. i'm just worried that the judge and parties won't be able to kind of accurately get through the bias of these potential jurors in the time that the judge seems to have allowed for this process shepard well, given the complexities from the jurors perspective, how are they able to sort out the legal standards and as we heard from omar, the judge hopes to get this started as soon as possible? >> this is an ever green process because we have the jury situation because we drefs citizens to listen to the testimony and use their common sense. the jurors also have to listen to the legal definitions that the judge gives them, find out what the facts are and then apply the facts to the law using their common sense. i mean, that's what jurors have to do every day, and it is extremely challenging, especially in a convoluted case like this one, so we'll have to see how they do shepard as you know, common sense isn't something that many people use on a daily basis, and it adds to the complexity of this trial. jennifer rogers, thank, as always. well, a new law this philadelphia will ban police for something vehicles for minor traffic ryelations. why it's being done and is it putting anyone at risk? chase. make more of what's yours. if you smell gas, you're too close. leave the structure, call 911, keep people away, and call pg&e right after so we can both respond out and keep the public safe. one of the most important things you can do is to make sure you call 811 before you dig. calling 811 to get your lines marked: it's free, it's easy, we come out and mark your lines, we provide you the information so you will dig safely. traffic stops are the most common interactions between police and the public. we're talking tens of millions per year in america, but now one city is trying to reduce that number. a new law will make philadelphia the first major u.s. city to ban police from making low-level traffic stops. part of the reasoning for the law, those stops disproportionately target people of color. here to discuss is former philadelphia police commissioner chief ramsey. this was your city. so what do you make of this new policy? is it a good idea? >> well, i mean, it's interesting. it will be very interesting to see long term any impact this has on public safety. it really does eliminate traffic stops for things like broken taillights, for example. if you've ever been behind a car whose brake lights aren't working properly, that can cause a serious accident but we'll see whether or not this is something that's really remarkable. of course, you can mail a ticket to an individual or a warning based on the information that i've gotten from this bill. so we'll see how it all plays out. shepard right, and i want to further go into that because, as you've said, this could impact other drivers with a broken taillight and what have you. what is the significance for other drivers if in fact many would not be pulled over for these type of infractions? . >> well the longer this go, the more frequently you'll see things like that. but more important is some equipment issues on vehicles. you know, we don't know the impact it is going to have on individuals whose licenses are suspended and revoked and knowing the police aren't likely to stop them. and we're going to have to track this very carefully and hopefully they're keeping data to show whether this is causing a negative impact on public safety or if it is something that ought to be replicated elsewhere. >> you described this as irning. how do you think officers in jinl will respond to this policy? >> tear not going to be happy with it. >> why. >> for the most part. well cops change, but when i was police commissioner in fill dwdy, i focused on violent crimes and than traffic. but traffic is an important part of public safety so you can't minimize it. some polices will be okay with it. others will maybe push back. but again everybody needs to just wait and see how this plays out long-term. because right now nobody really knows. i do have a problem, however, with city council, state legislatures, you know, passing laws that really restrict the ability of police to do -- to do their jobs fully. i think that training holding officers accountable if they are inappropriately stopping people, on a pretext just to, you know, search the car or what have you, which could be illegal, there is ways of dealing with that other than changing the law. so i think it should be careful with that. >> and i think the reason why this is gained interest is because of the names, philando castile and scott and killed after the traffic stops. one explanation that is being given for these alarming statistics relates to how police are initially trained to stop people. do you agree with that and what does that current training entail? >> well, there does need to be some additional training. officers are trained on how to make a felony car stop, which is high-risk. but the majority of traffic stops you make are not high risk. they are not felony stops. they're simply for the broken taillight or making a bad left turn or something of that nature. and officers need to adjust their actions accordingly. and so, that needs to be emphasized over and over again. and it is unfortunate. there have been instances where traffic stops have led to tragedies. bup you said at the beginning, there are tens of millions of traffic stops made and yet we're talking about half a dozen causing laws to be changed and so we just need to think about these things before we take that kind of action. >> we need to think about these things and remember these victims' names as well. >> we do. >> chief ramsey, we'll follow what happens in philadelphia, closely. we appreciate you joining us. >> thank you. well more travel chaos for american airlines. they just canceled 300 more flights after a very messy weekend for their ticket holders. so what is behind the mass cancellations?
