lost track of brian laundrie at one point thinking his mother was him. resources, money, time all wasted as the lone person of interest in gabby petito's death got away. we begin with elizabeth cohen and this key vaccine meeting going on right now. elizabeth, walk us through what's happening today. the data they are looking at and what happens next. >> anna, all eyes right now on this advisory committee. vaccine experts who advise the u.s. food and drug administration, these are outside experts. they have no skin in this game. they are just wanting to look at the data, so let's look big picture at the same data that these experts will be reviewing and have been reviewing today. so pfizer did a large clinical trial with children ages 5 to 11, and what they found was that the vaccine was 90.7% effective at preventing children from getting sick with covid-19. what they did is took more than 1,300 children in the trial and gave them the vaccine, followed them for a period of time. three of them became sick with covid-19. they gave a placebo, a shot of saline that does nothing to 663 children, a much smaller number, but 16 became sick so many more became sick with the placebo than with the vaccine, so the vaccine advisers will be going over all this data, really picking it up apart are and we expect a vote by the end of the day. so let's take a look at what happens next because i know parents of children this age want to know when can they bring their children in to get a vaccine, so, again today, the advisers will be voting on whether or not to recommend an emergency use authorization for pfizer for children ages 5 to 11. by november 1st, by monday, we expect the fda to give their yay or nay and then november 2nd and 3rd so next week the cdc advisers will meet, and they will recommend to dr. with a lens keir, the head of the cdc, what she should do with this, should she say yay or nay and we expect to hear from the cdc director very soon after november 3rd. what this all boils down to is that dr. anthony fauci says, look, if the fda and cdc give a thumb's up, he's optimistic that children could be getting shots or will be getting shots sometime in the first two weeks of november, so very soon. ana? >> now, before this meeting, i understand one fda official asked this committee to keep the discourse civil today. any fireworks toe sar? why the need to say that? >> yeah. it was sort an interesting admonition. it was a little odd, and it sounded a little bit like he was talking to the members, but when you listen to it again he actually -- it sounds like he was talking to the public. the members of this committee, they are professors, they are mds and they are usually, you know, very, very respectful of one another. you don't usually see them sunshining at one another. however, we know on social media we see lots of sniping and see lots of people who are anti-vaccine giving out misinformation when the truth, is yes, children do tend to not get as sick with covid-19 as adults do, but you never know what's going to happen if your child gets infected. you never know if your child is going to be one of the ones who, unfortunately, gets sick and dies, so why would you want to roll the dice? you should get your child vaccinated to protect them and to protect the people around them? >> more than 700 children have died of covid-19 in this pandemic. elizabeth cohen, thank you as always. let's discuss all of this with dr. jonathan reiner, professor of medicine and surgery at george washington university. doctor, should this panel vote to authorize this advantages own today for younger children? >> yes. the data from pfizer suggests that the vaccine is both safe and very effective. over the last six weeks about a million kids in the united states have been infected with this virus, and as you said we're not just protecting the children who sadly 700 -- of whom 700 have died, but we're also protecting their community, the vulnerable people in their community, people who have not been able to mount an antibody response because of ear co-existing illness, cancer, chemotherapy, other medications that they take, so this is a real important reservoir of the virus right now, about 25% of the new cases are in kids and we have the ability to put that fire out by vaccinating children. >> and the white house says it has enough vaccines ready to go for this age group, for every 5 to 11-year-old in this country. that's about 28 million kids. pfizer's trial though, the size of this trial was just over 1,900 kids. are you confident that the trial size and the data collected is large enough? >> i am, and, again, you know, the -- the folks at the fda are really accustomed to analyzing these data secretary, and over the next two days they will go through this really with a fine tooth comb. look for any deficiencies in the data, and if they find that this vaccine is both safe and effective, the american public should be assured that it is safe and effective and parents should give this vaccine to kids. >> so, you know, i've talked to parents. my friend groups who are vaccinated themselves, but still they have had a little bit of hesitancy about what to do for their children. what's your message to parents who think it could be more risky for their child to get this vaccine compared to the risk that the child faces if infected. >> i think they need to start by talking to their pediatrician. their pediatrician is really the -- most parents have a lot of faith in the doctors that they take their kids to, and that's where i would start. talk to your pediatrician. get the facts from them. don't get the facts from facebook. get the facts from your doctor. that's what i would tell parents to do. >> big picture here. new u.s. daily cases are down 57% since a peak on september 1st, and right now we know there are still protests happening against vaccine mandates. those protests are growing as more places, including schools drop mask mandates. >> yeah. >> society seems to be torn right now whether the mitigation numbers are still necessary. everyone is eager for a return to normal. what do you say? >> i say we can't have it both ways. you can't both refuse to universally vaccinate the united states and also drop mitigation measures, and what i would say to folks, for instance, who really want their kids not to have to wear a mask in school, then vaccinate them. if everyone in your school is vaccinated, there really will be very little reason for kids to wear masks in schools. look at your county. look at your -- at your school board. understand how prevalent vaccines are in your community. if your community is very well vaccinated you can get to the point that kids can take the mask off. i live in such a community in montgomery county maryland but in other parts of the united states where vaccine hesitancy is high and vaccine rates are low, you can't take your masks off in crowded places and kids should keep their masks on in schools. >> dr. jonathan reiner, always appreciate your guidance. thank you for sharing your expertise and your time with us today. >> my pleasure, ana. >> we turn now to disturbing new details in the shooting death of a cinematographer on the set of an alec baldwin movie. "the rap" is reporting hours before halyna hutchins was killed some crew members were using guns with live ammunition for target practice to pass the time. this is according to person with knowledge of the set. cnn's lucy kafanov is joining us from a indwe santa fe, new mexico today and we're also learning about spent casings and ammunition found on this set. tell us more about that. >> that's right, ana, and i have to say there's a reason why they film the western films out here, high desert out here and cnn has obtained court documentslition some of the items that authorities seized from that santa fe, new mexico movie set. they include things like a fanny pack with ammo. three black revolvers, spent cases as well -- casings as well as boxes of ammo. now i have to stress that we simply don't know at this point whether the ammunition that authorities seized was real bullets okay, you know, blanks or dummies. that wasn't vesified in these court documents, a sheriff department official told cnn that they are still awaiting the coroner's report and that might shut some light on what the projectile was that eventually ended up dig el killing 42-year-old halyna hutchins. it doesn't appear, however, that there were all kinds of safety concerns on that set. we're hearing this from a variety of sources. one interesting recent bit of news that came out there was a long im hollywood prop master who spoke to the "l.a. times" who says he actually refused the job of being prop matter of on the movie "rust" because it was, quote, an accident waiting to happen and that dovetails what what we've been talking about. i spoke to a hairstylist who was offered the hairstylist position on the film "rough" and she turned it down for safety concerns. take a listen. >> in negotiations they told me the terms were non-negotiable of, you know, housing, which was -- i'm in albuquerque. it was being shot on the ranch in santa fe. i felt like at this point that we needed to think about safety, and i felt like the housing was important and also my rate was being negotiated, and they said it was non-negotiable, so at that point i -- there was just a few other little glitches that just felt very funny to me. i'm a 22-year member. >> and the housing issue is important because they were keeping crews in albuquerque 50 miles away from santa fe which meant long drives, long, working hours and people potentially making more mistakes if they are sleep deprived and the hollywood prop master says he thought producers were valuing cost over the production value racing against time trying to get president biden's social spending and infrastructure bill across the finish line. once again, this is a crucial week for the biden agenda and some major sticking points still stand in the way. one key issue remains how to pay for the expansion of the social safety net. an update on where things stand with cnn's white house correspondent phil mattingly is with us along with congressional correspondent lauren fox. a billionaire's stacks this new proposal to pay for increases spending, but even democrats aren't united on this. this morning house speaker nancy pelosi made it clear that there was still not agreement or legislative tax on how the so-called billionaire's tax would work. one of the ideas circulated or the past couple of days is senator sinema was concerned on the idea that you could tax billionaire assets that would affect 700 or 800 families around the country that make this much money. many democrats complained after the meeting this morning that we're in the midnight hour. these are the closing hours of this negotiation or they are supposed to be and yet we still don't know exactly how this provision would work. it's complicated and a couple of democrats told me this is more of a pr stunt than actually an option. part of the frustration has been the tension between the house and senate. democrats in the house said they did a markup in the house ways and means meeting and they already had plans to cover the cost and there's attorney like people in the senate. some of this is tension and some sour greats over whether or not the democrats will have the financing that they need to cover this bill and that's one of many sticking points that remain as the democrats are trying to get a frame ofwork on the big social safety net. >> and the president has said that the pay fors will be there, that it will be paid for in its entirety and president biden wants a framework agreement before he leaves on his trip on thursday. that's about 48 hours right now. what is he doing right now to try to get this plan over the finish line? >> no pressure at all but that to some degree is the pitch here, that they want to pressure and keep their foot on the gas because they know in congress deadlines actually help focus the minds and that's what they are pushing for at this moment in time and one of the things that the president is doing, over the course of the last six or seven weeks, the real focus of white house staff, their policy team has real been on the two outstanding sen trust senators, senators sinema and manchin. today they are broadening it out and bring over the leaders of several key caucuses inside the house democratic caucus. you're talking chairs of the congressional black caucus and at congressional equality caucus, the api caucus and the hispanic caucus and the women's caucus. these are all critical constituencies inside the house democratic caucus or inside the democratic party writ large. they will be coming to the white house. they will be meeting with the president's senior staff. his key negotiators as they kind of map through the key elements of the economic and climate package. hakeem jeffries the democratic chair will attend. i think this is a critical element as these really intensive negotiations are going on about the thorniest issues that lauren was just talking about ensuring that every kind of element of the democratic caucus is in the senate and in the house feels like they have got part of this process, feels like they have equity and feels like they are comfortable about the direction things are going selling it to everybody, socializing it and making sure when an agreement does come, if it comes, that everybody is on board to actually move it forward. it's a critical piece of things and the white house is kind of stepping up their efforts on that front today. i'm told it's likely it will continue tomorrow and at some point there will be meetings in the oval office with the president, potentially a trip from the president to meet on capitol hill depending on how things g.everything is on the table which underscores the moment that the cnn, at least five former trump administration staffers have voluntarily spoken with the house committee investigating the january 6th attack at the capitol, and the committee has reached out to others hoping they will talk as well without a subpoena. many are refusing and former president trump tried to prevent another batch of documents tied to january 6th from being turned over to congressional investigators, and for the second time now president biden rejected the request waving executive privilege. trump has already sued to keep the first set of documents secret, but those could be handed over to the house panel as soon as november 12th. let's bring in cnn's senior legal analyst and former federal prosecutor elie honig. lawsuits don't get much bigger than this assuming that trump adds this second batch to his suit. what happens next. will this just languish in the courts. >> let's hope not, ana. let's hope the courts have learned their lessons from prior cases that lang warrened months and years. right now they are in the district court which is the trial level court. there's oral arguments scheduled for next week and then the district judge should be able to issue a ruling really within weeks if he recognizes the imperative of this. whoever loses at that stage will go up to the court of appeals which is the mid-level appellate court. you have the right to do that. that will probably take at least a couple of months and then whoever loses there will try to get the case to the u.s. supreme court. of course, nobody has a right to do that. it's up to the supreme court what case they hear, but really what's the most important thing is that judges recognize that time is of the essence, that they cannot delay. no reason that this needs to take six months or more. >> we don't know the specific request regarding the contents of these records so broadly. what might be of interest in these documents? >> well, we do have a couple of important clues as to what might in there. first of all, these national archives documents meaning they are internal white house communications or communications between people in the white house and people outside the white house, so if we're trying to figure out what was happening inside the white house, what was donald trump doing and saying and thinking at those key moments before and during january 6th, these documents will show that. the other thing we know about these documents is donald trump has singled them out. he's fighting for just a handful. really a few dozen out of thousands that have been requested so that would tell me that there's something in there that donald trump is worried about coming out. >> is it safe to assume that the biden white house team that seen the contempt of these documents and by moving to release them does that suggest to you that there is incriminating stuff in there by that action, their actions? >> the biden team certainly has seen these documents. otherwise they wouldn't know whether they wanted to exert executive privilege or not. they have looked at these documents and decided that executive privilege is not appropriate here. one of the situations where executive privilege is not appropriate is in something involves communications relating to wrongdoing or criminality. >> i want to circle back on the news that cnn has learned that at least five former white house staffers are now talking to the january 6th committee voluntarily despite trump's efforts to have everybody stonewall. what's the significance to you? could this give the committee some new momentum? >> yeah. i think it will. there's really two categories of witnesses here moving forward and even looking back at what the committee has done already. there's those who really put their patriotic duty above duty to loyalty or to one individual person and have come forward with the truth of what they have. that's really important because the committee is trying to get a full view on what happens here, but then there are other witnesses who have put up a fight like the steve bannons, potentially like meadows, patel and scavino and some of the people who are likely to put up a fight are likely the ones who will be in the best position to really know what donald trump was truly doing saying that's the inner circle witnesses and that's where we'll see the most intense legal battles playing out. >> real quickly. are you surprised the doj hasn't made any kind of decision on whether to prosecute steve bannon for criminal contempt of congress yet? >> not just yet. they formally got the case just thursday, a few days ago but they have known this is could. i'll give them a little bit of leeway. -maker garland has nope this is come. needs to be prepared to move more decisively and quickly and we heed to ask somewhere this decision very soon. >> thanks. >> thank, ana. >> more internal documents will have facebook in full damage control. they show that >> they very well might have. let's take a look at the history of what's been happening in texas. for many years, the map changes, they are required -- the department of justice or federal court to preclear those, to basically say, okay, we think you're not trying to cut out groups of people of color and make them less powerful politically. you're not doing that. it had to be precleared. but then in 2013, the supreme court basically gutted the voting rights act and said, it doesn't have to happen that way anymore. and many people back then said this is what's going to happen and now these are the results that you seem to get. and so if you look forward, what do we have coming up next?
