southwest airlines cancelling thousands of flights, stranding tens of thousands of passengers. what caused this meltdown? and the spies next door. an fbi sting ensnaring two would-be spies. we'll tell you about a couple accused of trying to sell nuclear secrets in peanut butter sandwiches. we begin with encouraging developments on the pandemic as the u.s. appears to be turning a coroner the fight against coronavirus. the u.s. averaging about 93,000 new cases per day, the lowest daily average in more than two months. hospitalizations and deaths also down significantly. and there's promising news on the vaccine front as well. the u.s. now averaging a million doses administered a day. that's the first time the nation has hit that mark in weeks. and new this morning, merck asking the fda for emergency use authorization of its new antiviral pill, which the drugmaker says cuts hospitalizations and death by half in those with early symptoms. elizabeth cohen, a lot of signs for optimism, but experts like dr. anthony fauci are warning we shouldn't prematurely be celebrating. >> that's right. because, boris, if you can remember just a few months ago, sort of the end of may, beginning of june, we were celebrating a little bit, then delta variant happened. please, god, we will not have another variant like that come around, but we need to be careful. people need to get vaccinated and be sensible about the kinds of activities and the kinds of things they're doing. this pandemic is not over. but having said that, as you said, a couple of promising developments. one of them is that merck applied for emergency use authorization this morning for their antiviral pill. now, there are other treatments for early stage covid, and note i'm talking early stage covid, not in the hospital, but they're tricky to administer. there are monoclonal ant bibodi, and this would be easier if doctors could prescribe a pill, call it into the pharmacy for those with early symptoms. merck has put it out in a press release. it's not been published or peer reviewed. they said they had a clinical trial of 762 participants, again, early stage covid, not in the hospital, and half of them got a placebo, a pill that does nothing. of those folks when they followed them, 45 ended up in the hospital and 8 died. the folk who is got the actual antiviral drug, 28 ended up in hospital and none of them died. if those numbers hold up under fda and cdc scrutiny, that is promising. we don't know a time line for when the fda might do their review. we know from monoclonal antibodies, another treatment, when they apply for emergency use authorization, it took about six weeks for the fda to do the review for that. that gives you a bit of a ballpark idea. boris? >> some good news and a lot to look out for. elizabeth cohen, thank you. joining us is dr. paul offit, a member of the fda vaccine advisory committee and the director of the vaccine education center at the children's hospital of philadelphia. always a pleasure having you on and getting your insight. let's start with merck seeking emergency use authorization for that oral antiviral drug. how does it work? who is is it designed for? how much of a game changer do you think it will be? >> it prevents the virus from reproducing itself, and that's certainly an advantage. it's about 50% effective at preventing hospitalization. remember, the vaccine is virtually 99% effective at preventing hospitalization, so an ounce of prevention is worth a pound of cure. you'd much rather prevent getting the illness than treating it once you have it. the fact it's given by mouth, about 50% effective this preventing hospitalization and on the small numbers, 100% effective preventing deaths, it is an advance, but you'd rather prevent getting infected than treating yourself once you're already infected. >> and fda vaccine advisers meet this week to discuss authorizing boosters for people who got the moderna and j&j vaccine, and for the sake of transparency, you're one of those alleged visors. you'll be part of that conversation. assuming that both boosters receive that fda authorization, how quickly are people going to be able to get those extra doses? >> well, so the advisory committee for immunization practice will be meeting on november 2nd and 3rd to discuss this and assuming that the fda vaccine committee recommends it and the fda agrees with that recommendation and goes to the acip, really within a week, within a week we should be able to have clear recommendations from the cdc on how best to use these booster doses. >> what can you tell us about mixing and matching doses? if it's safe to get a booster shot from the original vaccine received? >> we just need more information. that's the frustrating part here. for example, in september of this year, we had an article that was published in the "new england journal of medicine" looking at the astrazeneca vaccine given to people and then followed with the astrazeneca vaccine, and those with the astrazeneca vaccine following up with mrna vaccines. they're better at inducing antibodies, broader immunity. those kinds of studies need to be done with the j&j vaccines and the moderna and pfizer vaccines to give us more information. when that information is generated, then the cd will give us instructions on how to move forward. right now we're awaiting data. >> doctor, there's been something that's lingering in the back of my meenind and i wa your perspective. does it concern you that the biden administration hasn't yet confirmed an fda commissioner? there's been an acting commissioner for some time. has that had any impact on the agency's ability to respond? >> i don't think so, no. i mean, i think the advisory committees and the fda itself has been able to evaluate data in the same sort of timely and rigorous manner as always. i don't think the lack of a commissioner has made a difference, no. >> doctor, we ran through the latest covid indicators at the top of the hour, cases, hospitalizations, deaths, all down significantly over the last few weeks. we're starting to see vaccinations tick back up. dr. anthony fauci as we noted earlier warning this weekend about letting our guard down too quickly. let's listen to the sound bite. >> we have to just be careful that we don't prematurely declare victory in many respects. we still have around 68 million people who are eligible to be vaccinated that have not yet gotten vaccinated. and even those who have been vaccinated, i mean, you want to look forward to holiday seasons and spending time with your family and doing those sorts of things, but don't just throw your hands up and say it's all over. >> doctor, when you look at the data, do you have any indication that we'll see a spike in the near future or another potential surge? >> you worry because this virus is a winter respiratory virus like influenza. look at last winter, october, november, december, that's when it took off. it's nice the numbers are coming down. you'd like to be cautiously optimistic, but this is a winter virus so keep your guard up. it is frustrating. we're celebrating getting to a million doses a day. we were 3 million doses a day a couple months ago. if we'd stayed on that course, we could have been looking in our rear-view mirror at this pandemic. but we just didn't. we hit a wall because there was a critical percentage of people, about 65 million people, saying they didn't want to get vaccinated, hence the mandate. it is frustrating. we had the vaccine, had enough vaccine, it was free, we were able to find distribution centers where we could have vaccinated everybody, but we just hit a wall in this country. it is sad. >> it is sad. important to keep that context in mind when we think about the number of people that have died, so many of them the last few mos, ultimately preventable because the vaccine is out there and accessible. dr. offit, thank you so much for the time. thank you. >> thank you. we also have an update on a developing story this morning. southwest airlines cancelling more than 2,000 flights over the weekend, leaving tens of thousands of travelers stranded. the airline is trying to play the blame game, blaming air traffic control problems, but the faa is pushing back. cnn's pete muntean is live at reagan national airport with more. pete, what's behind this discrepancy between southwest and the faa? >> reporter: really a massive operational mess here, boris. you know, it's not like southwest can flip on a switch and get things back to normal right away. this is really more akin to unplugging the operation and plugging it back in again because it says all of these problems began on friday. it pins the blame on whetheathed air traffic control issues. but the federal aviation administration put out a rare statement saying it was not a problem on saturday and sunday when southwest experienced the lion's share of its cancellations. look at the numbers here. 800 southwest flights canceled on saturday, 1,100 on sunday. that's about 30% of southwest total schedule for the day, but 350 flights canceled for today, about 1 in every 10 flights. a memo to southwest employees explains this ripple effect that this had on the operation, people and planes put in the wrong spots, some flight crews didn't have hotels. this really all trickled down to tens of thousands of passengers who were stranded by this whole mess. they were scrambling to find new flights. they were waiting in those long lines that you have seen. they were waiting on hold for hours and they are not happy about it. >> i was dealt a devastating blow that my flight was canceled, and they sent me a link to rebook. there were no other flights available at all on southwest or any other airline actually. and that's when i just began to cry. i was devastated. >> reporter: also interesting in this memo to southwest employees, the airline lays out this was actually made harder because most of these problems occurred in florida, which is so central to southwest's operations. also because the airline is smaller than it was back before the pandemic, about 7,000 fewer workers, which is making it harder for it to recover. one more important note about workers. pilots for southwest have issued a statement saying this was not on them. there were rumors flying online over the weekend that there may have been some sort of protest by pilots against southwest's recently announced mask mandate. they say that is not the case, there was so such protest, and they're putting all the blame on southwest saying it's the airline that was managing all of this, boris. >> none of the other airlines had issues of that sort, that magnitude. >> reporter: very true. >> thanks, pete. coming up, an undercover fbi agent, u.s. nuclear secrets and covert messages in a pb&j. an american couple accused of trying to spy for a foreign country. want some more of it♪ ♪i try so hard, i can't rise above it♪ ♪don't know what it is ''bout that little gal's lovin'♪ ♪but t i like it, i love it♪ applebee's. now that's eatin' good in the neighborhood. with qualility that's guaranteed for life, bath fitter doesn't just fit your bath, it fits your high standards. why have over two million people welcomed bath fitter into their homes? >> it certainly reads like something out of a spy thriller, boris. they got tipped off because this u.s. navy nuclear engineer had been stealing government sclets about nuclear-powered warships for years and the fbi said that in 2020 he reached out to a foreign country, we don't know which one, it's not in the complaint, but he offered to sell these secrets to the country and the country turned it over to the fbi and that's what started this months-long undercover fbi operation. so this nuclear engineer, his name is jonathan toebbe, he is now under arrest along with his wife, and they were picked up over the weekend attempting what was a third dead drop of this top-secret information in west virginia. now, they had already been paid more than $100,000 in cryptocurrency, this by an fbi informant, over several months of this operation. so this really all started in june when the fbi tracked toebbe and his wife as they traveled to a dead drop location in west virginia where they actually left this sd card with these government plans and government secrets contained inside a peanut butter sandwich. there was also another dead drop handoff in august. that's where toebbe allegedly handed over these schematic designs for the virginia class subm submarine, a nuclear-powered cruise missile fast-attack sub. then it was this past saturday. toebbe was attempting a third dropoff of information, again all the while believing he was interacting with a foreign government agent and not an undercover fbi agent. that's when he was arrested along with his wife in west virginia. toebbe, he thought he would get away with this. in fact, he told the undercover agent at one point, i was extremely careful to gather the files i possessed slowly and naturally in the routine of my job so nobody would suspect my plan. we received trainings on insider threats, made sure not to display a single one. i do not believe any of my former colleagues would suspect me if there is a future investigation. but little did he know that it wasn't a future investigation. this had been an ongoing investigation for more than a year communicating with this fbi undercover agent. over the weekend they moved in to arrest him. he and his wife are scheduled for a court appearance tomorrow. boris? >> wild details. jessica schneider, thank you. tensioning this morning are rising between taiwan and china. during a speech celebrating taiwan's national day, the president said they would not bow to pressure from beijing as chinese aircraft repeatedly entered taiwan's air defense zone. will rippley is live in taiwan. will, xi jinping has called for peaceful reunification between china and taiwan, taiwan saying they don't want the reunification, making the chances for peace slim, right? >> reporter: this letter was first reported by politico. as you mentioned, it bears repeating, it claims two top u.s. capitol police officers failed to act on january 6th as this violence descended on the capitol. the letter also says that former acting chief pittman lied to congress earlier this year. the whistle-blower says in the letter a former high-ranking officer of 31 years with the capitol police and they came forward was the assistant chief pittman and acting assistant chief sean gallagher played a role in disciplining officers for the actions they took on january 6th but were not themselves fully held accountable on a personal level. this letter takes aim at pittman and gallagher and accuses congress of failing to investigate those missteps for us. . >> one major issue that was raised in the allegation is that assistant chief pittman hasn't been honest about how threat intelligence was shared among agents. >> reporter: right. and the threat intelligence sharing with rank and file, with command staff, was one of the big sticking points for rank and file who feel like there was intelligence out there but they were blind-sided and that is the fault of their leadership. specifically, the whistle-blower takes issue with what pittman told senate investigators. now, according to a senate report, pittman said the department had intelligence that showed that they knew as early as december 21st that people were commenting on a blog about confronting lawmakers and bringing weapons to the rally at the capitol on january 6th. she said that that information was shared with command staff. the whistle-blower says that is not true. here's the quote from the letter -- never shared wit the rest of the department, particularly those commanders with real operational experience. if provided, this information would have changed the paradigm of that day. a spokesman denied to politico that pittman lied to congress, boris. >> whitney, very serious allegations and there's a lot to parse through. what else did the whistle-blower say? >> reporter: it's a 16-page letter, extremely detailed. another significant allegation is once the fighting broke out neither pittman nor gallagher took significant action. the whistle-blower claims to have been inside the command center for some time on january 6th and said, another quote from the letter, what i observed was them mostly sitting there blankly looking at tv screens showing realtime footage of the officers and officials fighting for congress. a law enforcement source defended the two officials saying that they were focused on protecting lawmakers, they were doing their job, and pointed out that in the end not one member of congress was hurt. overall, the u.s. capitol police executive team, which includes pittman and gallagher, told cnn a lot has changed since january 6th, a lot of the problems that were outlined in the letter were addressed and are continuing to be adredressed under the new police chief. >> whitney wild, thank you so much. the big lie meantime continues to fester. the second highest ranking republican in the house repeatedly refusing to answer whether he believed the 2020 election was stolen from former president trump. listen to this. >> at the end of the day, are we going to follow what the constitution says or not? i hope we get back to what the constitution says but clearly it states they didn't follow those legislative rules. >> you think the election was stolen? >> what i said is there are states that didn't follow their legislatively set rules. that's what the united states constitution says. >> do you think the election was stolen or not? last time, i promise. i understand there were irregularities. do you think the election was stolen? >> it's states that did not follow the laws set which the constitution says they're supposed to follow. >> let's get some perspective now with cnn political commentator and former republican congressman charlie day. good morning, charlie. always great to get your thoughts on things. as we watch steve scalise squirm out of repeatedly telling the truth, the fear of crossing trump is evident. it's on his face. and it strikes me that he's someone who was the victim of political violence. he survived being shot by a crazed fanatic. does he not appreciate the danger of peddling the big lie and not telling the truth? >> well, let me first say, boris, steve scalise is a friend, but it was painful for me to watch that. it's also embarrassing that leaders in the house and congress are afraid of a small segment of population that refuses to deal in reality. i suspect that he hand the other leaders saw what happened to liz cheney when they pushed back on the big lie, when they spoke truth. you know, liz cheney was ejected from the leadership. i think this is all about fear. they see the treatment that mitch mcconnell gets for refusing to go along with trump in the certification process of the election. mcconnell investmented to certify, of course. this is what happened. they need to push back in larger numbers. i've been saying this for a long time. silence and denial is not a response to what's happening in this country, particularly the former president. >> let's listen to something the former president said in a rally in iowa over the weekend about mitch mcconnell. >> mitch mcconnell didn't have the courage to challenge the election. he's only a leader because he raises a lot of money and he gives it to senators. that's the only thing he's got. that's his only form of leadership. he should have challenged the election. this bill is a sinister combination of job killing, tax hikes, and fascism that will destroy our nation. and to think that we had 11 republicans go along with an exte extension. headed up by mitch mcconnell. can you believe that? mitch mcconnell. >> he's attacking mcconnell for making a deal to raise the debt ceiling which trump effectively did multiple times during his administration. but i'm curious, charlie, from your perspective, with these attacks being sharper than some of those trump has launched in the past, does the threat of trump factor into mcconnell's decision make at all? should it be a concern for him? >> well, look, it was no shock that mcconnell was attacked by donald trump. there's no question that mcconnell has to be just livid with donald trump because trump attacked -- he basically undermined the senate republicans in the georgia runoffs back in 2020, back earlier this year. we saw what happened. trump basically undermined. he took the legs out from under the republican candidates down there, costing senate republicans the majority. so mcconnell, you know, he's been very clear about where he stands with respect to trump's election lie. he's right. and for the former president to stand up there and then condemn mcconnell for acquiescing on the debt ceiling is, you know, hypocrisy at a titanic level. the former president can't feel any shame. i voted for debt ceilings with republican and democratic presidents and to condemn mitch mcconnell for protecting the country from going into some kind of catastrophic economic situation is ridiculous that the former president would make these claims. he stirs up people for no reason. he's pitting americans against each other. and i seriously worry about further civil strife and potential violence because of this type of reckless, incendiary behavior by donald trump. >> yeah. the fear is that january 6th was simply a prelewude of what's to come. trump with a huge 91% approval rating in the state of iowa. of course he's not actually governing but it shows he doesn't have much competition when it comes to republicans in iowa. it could be a state critical in 2024. in your mind, is there anybody who would be able to stand up and challenge him in a primary race? >> well, first of all, good morning, boris, nice to speak with you on national coming out day, how a pro. well, you know, netflix it's interesting that they have no comment, when you know, it's certainly okay for them to accept gay coin and have gay content and not yet be accountable for this display what we're seeing. they knew what the cut was before this went to play this. wasn't a surprise, that wasn't something that was happening, to see all of this before had. that's just one clip that you could show because there's so many that are just so harmful, and especially as a black man, you know, we have to really kind of be a united front when we have everybody else coming at us, so why does it have to continue to be in your dialogue to not only rip in but it's harmful what you do, your words. they -- they have accountability. like, for instance, a caucasian comment, comedian, you know, who who constantly be speaking about derogatory things about afro american people, you know, it's really like that, it's kind of back and forth and you've got to be how theful of those things. trust me. i'm a goofball all day. i love foolishness and there's a point and especially where we're living today put it on mute when it comes to stuff like that. >> he does argue in his special that if his content offends you don't have to watch it and i've also heard the argument that we shouldn't look for comedians to morality, somebody whose job it is to incite an emotional response. what do you make of those hargts? >> i 100% agree to a certain extent. what i do have a problem is because we're speaking about netflix, you know, when there is content of, you know, the lbgtq plus community, you have to take that into accountability. listen, we don't need everybody to be on the same page but at the end of the day we kind of do need the respect, and the respect that is not there you can't expect to have that brought back to you if you're not giving it to other people. comedians have a certain pass in a sense but not when it becomes harmful and also to have a whole real of people applauding the tom foolery. the show wasn't even fin, data. >> let's talk about the data and the harm that you're noting that the national black justice coalition says this year is on track to be the deadliest year on record for transgender people in the united states and the majority of whom are black transgender people. what do you think needs to be done to address that?
