>> i'm jim sciutto. there is a possible government shutdown on the horizon. the office of management and budget is now instructing federal agencies in case to prepare for a possible default. lawmakers have just seven days to prevent the government from running out of money. democrats are considering a party line vote to avoid a shutdown as president biden works behind the scenes to keep his two-track budget and infrastructure strategy alive. democratic lawmakers are running out of patience as they remain divided on that price tag, $3.5 trillion for the spending bill. the white house says it's par for the course. >> the president's always been open to negotiations and discussions and knew that he was not going to be alone able to wave a magic wand and pass a proposal. >> cnn's chief congressional correspondent manu raju joins us from capitol hill. i always ask you to handicap these things because you've seen drama there and last-minute deals or failure to reach deals. where to democrats stand right now? is it your sense that they'll find some sort of compromise here to move forward? >> reporter: it's just retailer rh -- really unclear at the moment, jim. the big question is will nancy pelosi go forward with that monday vote on this infrastructure package. that package, of course, $i1.2 trillion. 19 republicans joining 50 democrats, significant investment in roads and bridges, waterways and the like that has not gone to a final vote in the house because liberals have demanded the larger democratic only package move forward at the same time. roughly $3.5 trillion to expand the social safety net, using a different process to approve that. that needs to be approved by straight party lines both in the house and also in the senate. with 50 democrats in the senate, they that means they can't lose one. negotiations are still going on for the larger package. they are not close to getting an agreement among themselves on that. the question for nancy pelosi heading into monday is will she ultimately decide to delay that monday vote. she has said they're moving forward over concerns that progressives may sink that infrastructure bill as leverage to try to get the moderates in the party behind that larger package. it's a very delicate situation for the speaker, who has insisted she'll go forward, and if she does dlae v delay it, that could cost her moderate support for the democratic-only plan. she, chuck schumer, joe biden are discussing the effect. biden last night at the white house was pressed by progressive democrats to push back that monday vote. they contended it was an arbitrary deadline i am told. and then biden said he would have further discussions with the leadership so we'll hear from pelosi later this hour about whether she has plans to delay it. that is one issue. then they have to worry about a potential financial catastrophe looming, dealing with a government shutdown that could occur next week, september 30th. they don't extend government funding. and also that debt default. first time ever if they're not able to raise the debt ceiling by mid-october and that is a fight between republicans and democrats on that and no resolution on those issues. all this, guys, coming to a head at such a key moment for bilden and his agenda. it could all most certainly collapse. >> manu, to be fair, we've been here before on the debt limit, get to the break and pull back. is there any real appetite among democrats or republicans to break it for the first time. >> there's no appetite but no clear resolution yet. one option for democrats is to try to move it on their own through the budget process. that takes some time to move forward. that's a roughly two-week process. at least it opens them up to a flood of controversial amendment votes along the way, which is why the democratic leadership wants a separate process requiring 60 volts in the senate, 50 democrats, 10 republicans. mitch mcconnell is making it clear there will not be ten republicans to do that. they say it's on the democrats to take this politically toxic vote. the democrats say the republicans should own this given the debt that was piled up during the trump administration. so it's unclear what this process will look like, but in talking to democratic members, there is a real feeling they cannot let this default, they control government and ultimately they may have to move it on their own even if they suffer political backlash. >> manu, appreciate the excellent reporting as always. thank you. the u.s. special envoy to haiti resigned. a letter just a few hours ago resigning over the crisis at the border calling on the u.s. to move to deport haitian migrants inhumane. >> all this as cnn learns that officials have been sounding the alarm since june about the number of migrants specifically in del rio, texas. matt rivers joins us from mexico across the border from del rio. matt, what are you seeing there now? is there still a flow towards the border? >> reporter: yeah, there are. and people continuing to cross this morning. we've seen it over the past few hours, not quite the numbers we saw yesterday, but i can show you, you can see some people who are actually coming here from the mexico side going back across to the u.s. they're following that guide rope that has basically been strung across both sides of the border. as of now, they're being allowed to cross back and forth. we can pan around and show you the other side. you can see other haitian migrants who left from the mexican side this morning going over to the u.s. you can also see all the law enforcement over there, everything from department of public safety in texas to border patrol officials, very much allowing this flow of people to go back and forth. they're not het letting them go into the country. when you get to the other side of the u.s., you would make a left and go up the river where thousands of haitian migrants remain. people have been using this crossing to come from the u.s. encampment back to the mexican side because it's easier to get supplies on the mexican side. food, water, diapers for little kids. as of now, this flow is being allowed to continue. border patrol agents allowing people to go back and forth. we do expect that to happen throughout the day today. what we are waiting to see here on the mexican side is are there going to be any enforcement actions taken. we know in and around, haitian myricks have been picked up trying to leave this area. in this park where people are being kept on the mekxican side immigration officials haven't come in yet. will they be allowed to stay here? a big police presence on the mexican side this morning. are the mexicans going to stop people coming back and forth, will border patrol do the same thing? that's what we'll see happening today. as of now, if you want to cross from the u.s. to mexico along that rope, you're allowed to, especially if you come back with supplies and they're essentially being given out in that encampment on the u.s. >> matt rivers, thank you. we'll be watching that throughout the day. joining us, a democratic congressman, a member of the appropriations committee. good to have you back with us this morning. i want to start first on what we just learned on this resignation saying i will not be associated with the united states' inhumane counterproductive decision to deport thousands of haitian refugees. he calls the approach to haiti deeply flawed and adding surging migration will only go as we add to haiti 's unacceptable misery. your reaction. >> i can understand why he did that on principle, but i can also understand that at least what i understand, there's at least another 30,000 haitians in mexico right now. there ice's another 30,000 in colombia. there's about 15,000 haitians in panama. this surge of haitians is not going to stop anytime soon. are they coming directly from haiti? no. are they flying in from chile and brazil and other countries? yes. and, again, it's a very difficult situation. i've been telling the administration since the transition since december 11th of last year, that there are folks that are getting the impression that this border is going to be opened and they feel that they have an opportunity to come into the united states. >> so clearly something is lost in the messaging there. you and i have talked about this since that in terms of the messaging. this requires more than just the u.s. you point out these tens of thousands of haitian migrants that we know about in latin america, possibly making their way north, hoping to get to the border between mexico and the u.s. in the wake of vice president harris' trip to latin america, what do you think the impact has been? has anything changed? >> with all due respect, no. look, you know, we've been providing assistance to central america since 2014. i was involved with cape ranger and then at that time vice president joe biden to provide the first $750 million to the central american countries. i think since then it's been over $3.5 billion we've appropriated. and, again, it's the assistance, but we've got to work with the private sector to create jobs thoundown there in central america. look, we're focusing on what's happening in the real sector, but down in the lower rio grande valley, we still have people from central america coming. if you look at the sector of del rio, they've had over 200,000 encounters. the lower rio grande valley, you've had over half a million encounters. those numbers are huge numbers. and again, you know, keep in mind that we're only looking at what's happened here at the u.s. border, gave you some numbers of the numbers of haitians and other folks from colombia, mexico, and this is going to go on for a while. >> you know, as we look at what is happening, focusing specifically on what we're seeing this week, because there is so much interest in what's happening at the border there, i'm sure you heard the reaction from your colleague maxine waters. i want to play that for the folks at home in reaction to some of the video that came out of the border earlier this week. take a listen. >> i'm unhappy and i'm not just unhappy with the cowboys who were running down haitians and using their reins to whip them, i'm unhappy with the administration. cowboys with their reins, again, whipping black people, haitians, into the water where they're scrambling and falling down. and all they're trying to do is escape from violence in their country. >> cnn is reporting -- i want to point out the officers were not whipping them, they were twirling their reins to perhaps threaten, move some of the migrants along. is that appropriate? >> well, you know, again, as you know, there is an investigation as to some of the actions that some of the border patrol folks have taken. i certainly have to say that i know a lot of -- i see in my church, the kids go to school, they're good folks. but they'll investigate this. we cannot paint everybody with the same brush. they were not using whips, certainly not using lassos. the horse brigades have been there for a long time. we don't know what the context was, were they running, told not to run? we don't know what the context is until we find out. i don't want to condemn anybody without knowing what the facts are or what the investigation will show. we want to treat everybody with respect, certainly want to treat everybody with respect, but, look, bottom line is this -- if there's an assassination in haiti, is that a reason to come in under asylum? no. if there's an earthquake in haiti, is that a reason to come into the united states under the asylum? no. if there is violence in central and america and other places, does that qualify for asylum? no. we have to look at what president obama and secretary jeh johnson, they treated the immigrants with respect and dignity. at the same time, they enforced the law. what the law says is if you get to stay under the asylum law, you say. if you don't, we unfortunately have to send you back. that's what the law says until we change the asylum law. >> we could talk more about this. i want your take on what we are seeing in washington, what's playing out. you know president biden holding meetings yesterday. you've expressed concern about the overall number of the reconciliation plan. at the same time, president biden pushing mod cats for a number. he couldn't get a number. are you aware of a number they would be comfortable with? is there a number you're comfortable with? >> everybody seems to be focused on a number. the way i want to see this is let's look at this remaking of the safety net that we are actually doing, remaking of the safety net, and look at the programs. i support health care, i support education, i support a clean environment, i support all that, so, you know, some people came up with a $3.5 trillion. i was not in the room when that was agreed on. i want to look at the programs we support, how do we remake the safety net for the american people for the ones that truly need help. i think that will be something to look at. i understand there is a gap between the progressives and the moderates. we need to fill that because we're all democrats. and i feel we'll get there eventually. >> we will be watching to see what happens. appreciate your time, congressman. thank you. >> thank you so much. dive teams back at a florida swamp, a florida nature reserve looking for brian laundrie. new details about an argument that was witnessed in the final days before gabby petito was killed. and pfizer says vaccine shots are available for people 55 and older. will the cdc agree? >> listen, i'm not disappointed at all. i'm a realist and i never believe that this thing is going to pass. tim scott said from the beginning that qualified immunity was a nonstarter. he did talk about holding an agency accountable without individual officers. we've heard just lip service. the president and his vp have forgotten the people who put them in office. look what they're doing on the border, sending out flights of haitians, seven to nine a day. it's disgusting how, you know, they are treating us and how they are feigning that they want something done. everyone is clutching their pearls. but the attorneys representing the family named this bill after george floyd understood with this the $27 million history breaking settlement after that and a chauvin conviction little more would be done. >> as we look at this on the heels of this and congresswoman karen bass said is next step is the biden administration needs to act in whatever way they can even if that that's executive order. what is the reality of that happening? what do you think the white house would do even? >> the white house and the justice department have some latitude to move in terms of executive action. that's the principle way they could move laterally. the other thing the president can do is put pressure on his own party, put pressure on joe manchin and democrats to eliminate the filibuster so they can pass this bill even without republican support. you know, joe biden would not p be president of the united states if not for black voters. yet here is a bill that george floyd justice and policing act, which has been in negotiations for six months now and the democrats have control over the white house and both houses of congress and still can't get it passed. black voters will be very disappointed if we say we can't get this done because republicans wouldn't let us do it. we have a procedural rule that prevents us from doing it. i would urge joe biden and the white house to do those two things, take executive action and push his own fellow democrats in the senate to make this happen. >> some republicans noted that the rise in crime happening in the midst of this is one reason they pulled their support. it seems that that's going to be part of the political message going into the midterm elections, sergeant dorsey. and i wonder what the democratic response to that should be. >> well, listen, you can always find a reason to not do a thing, but we understand that as long as police officers are not held accountable and that's whey they don't want qualified immunity to be a part of this package, they'll continue to misbehave. look what we just saw. officers on horseback rounding out of play black haitians as if they were cattle. and so that's why it's imperative that we have qualified immunity and without that this bill is toothless. >> keith, to your point that the administration and the president could do, how much appetite do you think there is right now in the white house to get something done? look, there's a desire, right, because they are facing multiple crises at this point and there is not a lot of movement and certainly not wins that can be pointed to. do you think there is, though, realistically the appetite to move this forward? there is a real push for it among americans and yet when we look at what's happening in washington, we certainly don't see it. >> yeah. there should be appetite for this. many of the provisions are very popular including in the previous administration. donald trump supported some of the provisions in the bare basic minimum proposal that tim scott, the black republican from south carolina, rejected yesterday. so there's no reason why the white house shouldn't push on that, not to mention the fact if they want to motivate democrats to come out to vote, particularly black voters to come out in the midterm elections and the next presidential election, they're going to have to deliver something. we have three major pieces of legislation. they're all sitting in the united states senate waiting for something to happen with a democratically controlled house and senate and president. that's unaccepted for black voters to see this and throw up their hands, democrats to throw up their hands and say we can't do anything because of an old procedural rule. i think it proves the biden administration, even if there is no appetite, to make an appetite to make this happen. >> sergeant dorsey, if you had the ear of president biden now as he considers wielding his executive pen, what would be the first priority for you? >> reporter: well, they described something that some people seem to find quite disturbing. this witness, her name is nina angelo. she spoke with cnn. she said that she and her boyfriend were eating at a tex-mex restaurant in jackson, wyoming, called the merry pig lets, jut south of the grand teton national park. she said that gabby petito was in tears and brian laundrie, her fiance, was visibly angry, so much so that he was walking in and out of that restaurant, directing his anger at the staff inside. she so even said the waitress who was serving her and her boyfriend was visibly shaken from this incident between the two of them. here's how she describes what she saw that day on august 27th on a post on instagram. >> they were fighting with the hostess. she was hysterically crying. she walked out and she was crying and staying on the sidewalk. i was watching the whole thing unfold. he walked back in the rest and he's fighting with the hostess. i didn't know what happened. i don't even if they got kicked out but they, like, left abruptly. she was standing on the sidewalk crying and he walked back in and was, like, screaming at the hostess, walked back out and walked back in like four more times to talk to the manager and tell the hostess off. >> now, that manager also spoke to cnn. she declined to give her identity but confirmed that an incident did occur at the time. she did not describe exactly what happened. but she sid did say she called the fbi on friday after human remainings were found, those of gabby petito. we want to mention the fbi is also declining to comment on that incident citing privacy. back here at the carlton reserve, as you were mentioning, the search for brian laundrie, that big question remains -- where is brian laundrie? we also want to mention an update. we are told by the sarasota sheriff's department that the dive tam was not requested for assistance today so it looks like there are no divers here looking for evidence at this time. but law enforcement saying that they're committed to searching every acre of this 25,000-acre reserve. back to you. >> a dawning task, no question. amara walker thanks so much. as gabby petito's case gains national attention, the family of the man who went missing in the arizona desert is trying to raise awareness about his case. you're looking at a picture of 24-year-old geologist daniel robinson, missing for nearly three months. he was last seen leaving his work site in buckeye, az ast, on june 23rd. >> his jeep and some of his belongings were found in ara screen after what appeared to be a rollover crash, but authorities say no foul play is suspected. his brother says they should not have to wait months just to get some answers. >> had they been quick about it in the beginning, you know, we wouldn't be here three months later sill erge is delivering for my brother and looking for answers. we shouldn't have to depend on other stories or other cases to push our own story, and we just want answers like anyone else. i think my brother or everyone else's brother or father, siblings, whoever may be, they deserve the same attention. >> a painful way for the family. they've hired an independent investigator and a volunteer search tam because they feel police aren't making enough progress. just in, state department employees suffering from havana syndrome being denied treatment at walter reed. that accusation comes from bipartisan senators, demanding an investigation from the secretary of state. >> havana syndrome causes a strange combination of symptoms that include sudden vertigo, nausea, dizziness, headaches, hearing loss. officials are not certain exactly who or what causes it. it's been a long investigation. kylie atwood is here with us. cnn obtained a copy of the complaint. this is remarkable. it's been showing up in a number of countries around the world with really damaging effects. why is walter reed not treating them? >> can you describe what that means, a framework? >> that means we are proceeding. we've made great progress and we're proceeding. we now went further because there were some specifics. if we are in a situation of lamb eat lamb, there are so many good provisions, what is affordable and what is effective and what gets the best results as soon as possible. so we've made great progress this morning because it's in the writing. you know, you hear everybody come in, talking about one thing or another, but we are writing legislation. and when you're writing legislation, you have to be specific. and this took us a long way to a framework. now, again, we always socialize what we're doing and see among some things what works better and what our actual needs will be. we'll get more estimates as to how much money comes in on certain things, but we know that we can cover the proposal that the president has put forth to build that better, his vision for our country well beyond the budget bipartisan infrastructure framework. i'm very excited about this. it's all good. we have a saying in appropriations, it's lamb eat lamb. let me tell you thats a you know this week we passed legislation to keep government open and lift the debt ceiling to remove all doubt that full faith and credit for the united states of america is not in question as the constitution of the united states says. the congress has taken up a tradition of having to vote on that. there's some doubt as to whether that should be the case. but in the here and now, we put forth a proposal. the senate house republicans vote against keeping government open, which we need to do by september 30th, and voted against the full faith and credit of the united states of america. it's quite appalling because when republican presidents were there we always had bipartisan support for that. we sent that bill over the senate. depending on what happens there, we will keep government open by september 30th, which is our date, and continue the conversation about the debt ceiling. even any -- not for long because any discussion even test out and when that happened before, when the republicans threatened not to support the full faith and credit when president obama was president, even the doubt they castelloered our credit rating. it's not good for our country, for our families, and it has an impact on the global economy. whatever it is, we will have a cr that passes both houses by september 30th. we're very pleased that in that same legislation, which the republicans rejected, we had our assistance for the natural disasters afacting some of their own regions, which they voted against, but, again, necessary to immediately meet the needs of the american people in time of disaster as well as the legislation, the appropriations for afghan evacuees to further welcome them to our country, meet their needs, and to do so in a timely fashion. we've gotten a tremendous response from areas affected by hurricane ida, the legislation to say ida struck and you already are putting forth funding to make our communities come as close to whole as possible. very grateful. again, when we talk about the debt ceiling we're not talking about future spending. it's important to note this is to pay incurred cost. last year democrats and republicans together incurred costs for covid that need to be paid for. this is a credit card bill that we owe under president trump. only 3% of the costs that -- only 3% have occurred under the biden administration. this is largely under the trump administration. and, again, democratic, republican president, we have to lift the debt ceiling. so when trump was president, he increased the debt by $7.8 trillion. we take participation in the covid expenses but not the tax scam that added at least $2 trillion to the national debt. so again, we've worked in a bipartisan way. it's always been bipartisan. and that's how we want to keep it. again, it could -- it would cost 6
