increase of covid-19 variants puts the country on the cusp of surge in cases. >> cases are increasing nationally and we're seeing this predominantly in younger adults. >> baylor complete's college basketball's greatest rebound and rebuild with a championship. >> texas, we got a national championship, too! the state deserves it! this is "new day" with alyson camerota and john berman. okay. so, i don't know where jim sciutto came from to win the cnn bracket. i thought that i was winning. >> so to bring people up to speed here, baylor won the college national basketball championship. it was baylor who won. baylor won. gonzaga loss. >> as a result, alisyn camerota did not win the cnn march madness pool. >> how did this happen with this vast sports knowledge, i can't believe somebody leapfrogged over my bracket. >> jim sciutto will not come in the next week and a half. he won. he'll bask in his victory. drinking champagne. also incidentally baylor as well. >> we want to welcome our viewers in the united states and all around the world this is "new day," tuesday, april 6th, 6:00 a.m. here in new york. this morning, in the derek schoen murder trial, the judge will decide whether jurors will hear from george floyd's friend, this man you see here, who was with them when they were confronted by police. in the und of the prosecution's witnesses are expected to take the stand today after another damaging day for chauvin's defense. the minneapolis police chief testifying against chauvin says that the restraint that chauvin used on floyd, kneeling on his neck for more than nine minutes, violated the police department's policy. it was not a trained tactic. >> nearly 80,000 new cases of coronavirus reported overnight as there are new concerns with variants spreading across the nation. but even with that, i want you to look at the ranger's home opener in texas last night. packed. no restrictions. a lot of folks in there. you know, we saw some masks but not universal by any means. a lot of people you can see in this picture not wearing masks. the governor of texas refused to throw out the first pitch, not because of coronavirus. it had nothing to do with that. it had everything to do with major league baseball's decision to move the all star game out of georgia due to voting restrictions. governor abbott apparently didn't like that. so, more on all that ahead. we begin, though, with the chauvin trial. cnn's josh campbell live at the courthouse in minneapolis with what we can expect, josh. >> reporter: yeah, good morning to you. prosecutors continue to build their murder case in the trial of former officer derek chauvin. now, yesterday the focus in court was on how minneapolis police officers are trained, how they're taught to use force. also the requirement that officers render aid to anyone in distress, including suspects in their custody. yesterday's testimony is part of on going pattern we've seen. some of the most damning testimony in this trial is coming from derek chauvin's own former colleagues. >> once mr. floyd had stopped resisting and certainly once he was in distress and trying to verbalize that, that should have stopped. >> reporter: minneapolis police chief arradondo testified monday that he believed former officer derek chauvin did use excessive force when arresting george floyd last may. >> what is the officer supposed to do to a person in crisis? >> it's an attempt to deescalate that situation. >> reporter: arradondo, fired chauvin and the three other officers involved the day after floyd's death, says that chauvin violated the department's neck restraint policy and that floyd's alleged crime did not require that amount of force. >> to continue to apply that level of force to a person proned out, handcuffed behind their back, that that in no way, shape or form is anything that is by policy, is not part of our training, and it is certainly not part of our ethics or values. >> reporter: the police chief agreed during kros examination by chauvin's attorney eric nelson that force is sometimes necessary to deescalate a situation and handcuffed suspects can inflict harm. nelson quoted the reasonable use of force standard defined in a 1989 supreme court decision. >> police officers are often forced to make plit-second judgments in circumstances that are tense, uncertain, and rapidly evolving about the amount of force that is necessary in a particular situation. right? >> yes. >> reporter: npd inspector katie blackwell in charge of police training last may and testified chauvin was taught defensive tactics and proper use of force. her response to seeing chauvin kneeling on floyd's neck. >> i don't know what kind of improvised position that is. so that's not what we train. >> reporter: the emergency room doctor who treated floyd testified that he believed floyd's cardiac arrest was likely due to a lack of oxygen or hypoxia. >> any amount of time that a patient spends in cardiac arrest without immediate cpr, markedly decreases the chance of a good outcome. >> reporter: laingen feld tried to revive floyd for 30 minutes before pronouncing him dead. the prosecution argues that the hypoxia was a result of chauvin's knee on floyd's neck for more than nine minutes. the defense argues it have caused by floyd's drug use. >> certain drugs can cause hypoxia, agreed? >> yes. >> specifically fentanyl. >> that's correct. >> how about methamphetamine. >> it can. >> combination of the two? >> yes. >> reporter: in response, the prosecution dismissed the defense's claims. >> did they say to you for purposes of caring or given treatment to mr. floyd that they felt he had suffered a drug overdose? >> not in the information they gave, no. >> reporter: now, it's worth pointing out an autopsy said drug use was a serious condition but the cause of death was listed as heart failure during that restraint. the county medical examiner, so much in this case focuses on that cause of death. prosecutors are trying to say it was the actions of this officer holding george floyd down for over nine minutes on the pavement. for their part the defense has been trying to show it's actually george floyd's fault, he was perhaps under the influence on that day and that it was that drug use, not the actions of this police officer. we'll continue to watch that questioning which will be so key as so much centers on the cause of his death. alisyn? >> josh, thank you very much for all the reporting. joining us now cnn political attorney bakari sellers and cheryl dorsy the author of the book "black and blue." great to have both of you. sergeant dorsy, what were you struck by listening to chief arradondo describe policy and the ethos of the police department? >> well, what struck me is number one he said it. that was great. it needed to be said, particularly from someone in his position. but it's a little too late. it would have been nice, afterall, derek chauvin had 18 personnel complaints had the police chief had him ride the desk or saddled him to the kit room instead of allowing him to be out in patrol. now they're still in damage control mode and doing what they have to do to appease the public and the family of george floyd, afterall, the city did pay out $27 million to the family. >> counselor, bakari sellers, the fact of this testimony, the fact of so much testimony from police, it's really unusual. it is really unusual in this type of situation. explain that and explain the likely impact on the juror. >> i mean, it's unheard of in my experience. my experience isn't as vast as some other members of the bar i can say you that much. you very rarely, if ever, see law enforcement officer after officer after officer testify against one of their own. and these are every rank, including the chief coming out and testifying and not only saying that he violated policy but distancing themselves from him. this is like he was thrown out of the blue wall. derek chauvin was just tossed over the blue wall and left to fend for himself. so this is going to be very powerful because law enforcement officers get the benefit of the doubt times ten in cases like this. and so, the prosecutors have to separate derek chauvin from what law enforcement officers are known to do, traditionally do, and what they do under the law because they get a lot of rope. in this case, though, there is going to be a lot of distance between the law enforcement community and derek chauvin and that distance is being driven by other law enforcement officers. and it's pretty refreshing to see. >> bakari one more question about the court case you hear the police chief and the person in charge of training say this violates department policy, it's completely outside the realm of our training what more -- isn't that sort of case closed? doesn't that just sort of destroy the defense case from where you sit as an attorney? >> no. in fact, it's far from it. now, that helps build the case. i think yesterday was the strongest day that the prosecution has had no doubt about it. however, there still is a major argument about cause of death. to those of us sitting on this panel, the knee on the back of george floyd's neck was the cause of death. however the criminal defense attorney is going to make that as murky as possible and say that drugs had a large role to play and that but for the fact that he had fentanyl and methamphetamines in his system, george floyd would be alive today. now, i'm not sure that that's going to fly because i would articulate but for the fact there was a knee in the back of his neck he would be alive today, but that is going to be the argument that the criminal defense attorney is going to make. look, alisyn, you and i and john aren't in that jury room right now. those are wild cards as laura coates always says and only takes one to be steadfast in their belief that george floyd somehow killed himself or contributed to his own death. >> sergeant dorsy, if i can go back to a second to your area of expertise, serving in the police for so long, bakari said derek chauvin has been tossed over the blue wall. what does it take for something like that to happen? what's the significance of that moment? >> violation of policy. listen, when we see misconduct and we don't do anything to intervene and don't stop misconduct, then we acquiesce misconduct and we're committing it ourselves. everyone who took the stand, the sergeant, commander and police chief swore under the penalty of perjury to tell the truth about their training and what officers are expected to do when they encounter citizens. they did that. this is not anything unique or unusual it's just that we're seeing it play out live on television. >> what did you think about the woman who trains the police in terms of use of force to say that's an improvised move. i mean, is that in your experience knee on the neck, would somebody use that? is that something that he came up with? >> it's certainly something he came up with and commander described it properly by saying it was something that was improvised. there is a technique that we use when we approach a felony prone suspect who is laying down on the ground from the head. you put your knee between the shoulder blade only long enough to put handcuffs on. once the handcuffs go on, you get up off that person and that should happen fairly quickly. it didn't in this case, it lasted for over nine minutes and she attested to that. >> bakari, you're saying thousand prosecution is trying to block in some ways all the defense outs that they're going to try when they get to present their case. and you talk about the importance of the drug use, the feintntanyl and maybe methamphetamine. and you used the phrase but for, but for the presence of the knee on the neck, what's the importance of that? and why will the prosecution lean into that? >> i mean, the prosecution will lean into the fact because they have to show that the knee in the neck was a substantial factor in the death of george floyd. i mean, now, there can be multiple causes of death. however, this knee has to be the substantial cause of death of george floyd. and so, you know, when you use words like but for, the prosecution is going to say, look, there was a knee in his neck. i can literally hear the closing argument right now in my head. derek chauvin did have his knee in his neck. he did use improper training. blah blah blah blah blah. the list goes on and on and on. but, george floyd had drugs in his system and but for those drugs, george floyd would still be alive today. that's going to be the argument that the jury is going to take back in the room with them. he's also going to try to throw up things like derek chauvin was kind of fearful because there was a crowd. we all know that to be b.s., but still those arguments are not going to be central to the main argument which is about cause of death. that is going to be the crux of the criminal defense argument moving forward. this is still a long way to go. it's not like the prosecution gets to make their case and we go home. the criminal defense attorney is going to have a week or so to put forth his case and it will be interesting to see with whether or not he's able to do that successfully and whether or not derek chauvin testifies. >> uh-huh. bakari sellers and sergeant dorsey, thank you very much. the largest sports gathering in the u.s. since the pandemic began. we bring you the details next. it's my 5:52 woke-up-like-this migraine medicine. it's ubrelvy. for anytime, anywhere migraine strikes, without worrying if it's too late, or where i am. one dose can quickly stop my migraine in its tracks within two hours. unlike older medicines, ubrelvy is a pill that directly blocks cgrp protein, believed to be a cause of migraine. do not take with strong cyp3a4 inhibitors. most common side effects were nausea and tiredness. ask about ubrelvy. the anytime, anywhere migraine medicine. priceline works with top hotels, to save you up to 60%. these are all great. and when you get a big deal... you feel like a big deal. ♪ priceline. every trip is a big deal. ♪ cases are increasing nationally, and we are seeing this occur predominantly in younger adults. this is why you've heard me so clearly share my concern. we know that these increases are due in part to more highly transmissible variants, which we are very closely monitoring. >> the director of the cdc warning that highly contagious coronavirus variants fueling the surge in cases. overnight, michigan reported a new large spike in cases. cases are four times higher than they were in michigan last month. look at that spike. joining us now is cnn contributor abdul el say yesterday. you wrote a op-ed in the washington post about this about michigan. what we're seeing there and why and basically your thesis is get ready, america. >> that's right, john, unfortunately. i hate to say it but this is not a single issue. single cause. spike in michigan. what we're seeing is a con influence of a number of bad things that are unfortunately happening everywhere. we just have them first here in michigan. b.1.1.7 is on the rise. we had the highest per capita rate of b.1.1.7 cases in the country for some time now but b.1.1.7 is everywhere. early reopening, aggressive reopening more eat-in dining, more athletics, more gyms reopening and all of those things together are sending the message to folks that, well, covid is over. but it's clearly not. that's happening almost everywhere. and then you have the fact that right now vaccines are on the way. people are getting vaccines. that's amazing. but, we only have about 25% coverage and in order to really get a handle on this pandemic, we all know that we need to get in the 70s. that's not going to happen for some time even at this pace. that's happening everywhere. >> if we put up the graph of michigan, it tells the story, the green. it looks like sort of wave, tsunami and then another one coming. >> i just want to keep watching you paint the graphics there. >> i mean, look at that. and also, in addition to the complicated factors in michigan, i read in your op-ed, that you say that there's more vaccine hesitancy in michigan. what's that about? >> yeah. i think it's a function of our demographics. we have a highly rural population and then we have a city that has been traumatized by decades of structural racism. and we know that conservatives often driven by the former president are hesitant about this vaccine and we know that people of color have often been hesitant given the history of exploitation but given our demographics in michigan and the fact that we're a state that includes large concentrations of both of these groups, it follows that we might have higher vaccine hesitancy. that being said, we're seeing the numbers go down particularly among african-american residents of the state, and that's really good news, but in order to get there, all of us have to do our part. and we have to be focussed a lot more on that moment when the supply outstrips the demand and the issue with getting people vaccinated is people don't want to get vaccinated. not that they can't get one. that has to be a prime focus and that's coming any day now. >> i want to put up a picture of the ranger's game yesterday in texas. 38,000 people with no restrictions inside the stadium there. we see a few people with masks. as a doctor, epidemiologist when you look at this, doc, what do you think? >> i just really worries me. look, i get it. i am sick and tired of not being able to do the things i love doing. i'm sick and tired of not being able to be out and among people. those are the joys of life. i get it, particularly now a year in. but let's hold on just a little bit longer. vaccines are on the way but they're not quite here yet. i'm willing to guess that most of the people in that park yesterday were probably not vaccinated. let's do the right thing. let's not get ourselves in a position where every state ends up looking like michigan and we're back in mass lockdown because we're seeing kids and young adults getting hospitalized and potentially dying. we don't want to get there. we don't have to get there. if we can hold on a bit longer perhaps we can do that kind of thing safely soon it's coming. >> i think when the history of this pandemic is written, one of the astounding things will be how precious little we knew throughout this whole year. you know, how little we knew when it hit and what we thought we were doing to be safe and how the guidelines changed. i was just reminding john, he used to go home from work everyday -- >> why are you saying me? >> this is really a mark of how serious you took it. john, would go home and take off all his clothes and wash them immediately. >> i'm uncomfortable with you talking about me taking off my clothes. >> we want ratings. is it in our hair? maybe we should be wash our air everyday. we have to clean surfaces constantly. disinfectant services. now there's this guidelines from the director of cdc about surfaces. here it is. >> disinfection is only recommended in indoor settings, schools and homes where there has been a suspected or confirmed case of covid-19 within the last 24 hours. >> totally different than what we thought a year ago. >> that's right. early on in the pandemic we were struggling to make sense of how this virus was spread. i remember pulling in my groceries and putting them in this sort of no-go zone before they got wiped down and wiped down every banana before i ate it. thankfully what director walensky is saying is that this is spread via the air. that's why masks are so critical but good that the cdc has formally changed their recommendations on this. i'll also add something to what you said, alisyn. it's not just how little we knew, how little we learned what we actually knew. we contrast with what we saw at texas at the ranger's game yesterday. what kills me is that, yes, we know now we can't -- we don't have to wipe down every piece of groceries. that's great. but, we also know that this is spread via air sols. if you get a lot of people in a close range space and some are positive, it's going to spread but it's not like we're learning that lesson. my hope is we can learn the lessons and follow the science and get ourselves out of this thing and then look back and say, wow, wasn't it funny we had to wipe down every banana for a while. >> i have three crates of disinfected wipes i can give you. >> i'm done with wiping down card board, too. done. >> dr. el-sayed, thank you very much. >> thank you. congressman matt gaetz, refusing to resign in the face of justice department probe for potential sex trafficking. that's coming up. to prove our aa battery is the world's longest-lasting, we tested it against our competitor's best battery. first pitch at major league baseball took a stand against georgia's new voting law. governor abbott says it's shameful it's being influenced by perpetuating false political narratives. joining us now is errol louis. what is governor abbott doing. is this really about the voting law in georgia or preemptive strike because similar voting laws are under way in texas? >> yeah, that's the key, alisyn. they've got a whole raft of legislation and rules changes teed up in texas where what had been an 800,000 vote margin for republicans back in 2016 shrank to 650,000. they see the handwriting on the wall down there, the republicans do. they know that without some aggressive gerrymandering they would have lost quite a lot more power. so greg abbott is trying to align himself with what looks like a national effort by republicans to try and suppress the vote because in these swings of urban counties and in these big democratic-leaning cities they simply can't win and they're starting to see states and georgia being a prime example starting to flip. and so, that's what this entire fight is all about. it certainly has nothing to do with major league baseball itself. >> look, you can tell that there are some republicans who know they have a problem here in terms of corporations and the business world now weighing in major league baseball because mitch mcconnell felt the need to come out and say something. listen. oh, we don't visit. mitch mcconnell made a statement outloud you'll have to take my word for it suggesting that businesses, corporations should stay out, he said, of politics. he wouldn't be saying this unless he knew, he knew they were vulnerable. >> i'm not so sure about that. i think this might be an attempt bravado and back down some corporations. of course, what mitch mcconnell is missing these are gigantic global brands. major league baseball has offices in beijing and expanding into latin america and europe and everywhere else. ditto for delta which owns stakes in european airlines and latin american airlines. you know, coca-cola, global brand for 100 years. they're not going to be scared by mitch mcconnell threatening to maybe move a couple of tax exemptions here or there. they're engaged in long-term thinking. they know where the world is going. they know that these narrow attempts to try to suppress the vote are going to damage their brands and they're simply not going to play along. >> let's talk about matt gaetz in the latest errol. he put out an op-ed defending himself against the allegations that he was involved somehow in sex crimes or trafficking of an underage woman. here is part of what matt gaetz has to say. he says to this point there are exactly zero credible or noncredible accusers willing to come forward by name or state on the public record i behaved improperly in the manner democratic governor andrew cuomo has ten accusers. we should point out that matt gaetz is accused of paying these women and sometimes giving them presents in the form of travel and such. so when you pay people they don't speak out against you. so where are we now with this case? that's just the accusation. >> we're at the beginning stages of this. a lot of what has be fallen matt gaetz stem from joel greenberg who is a man in a lot of trouble who just had un -- new charges filed against him in the last couple weeks, who is apparently implicating his friend matt gaetz in some really untoward behavior. joel greenberg is in a lot of trouble for identity theft and a number of other things. what we're going to see is that matt gaetz is going to continue apparently in this sort of trumpian fashion, accuse everybody of everything. it's a remarkable op-ed if you read it because he says i'm innocent, everybody has the right to say, but then lash out at everybody. of course, missing from that op-ed is the fact that it was the trump justice department that launched this investigation. it was bill barr, the attorney general under president trump who first noticed that there were these charges out there to be pursued and that's the source of all of his problems. >> it is a remarkable op-ed. the whole thing is remarkable. in fact, the last sentence got me and i know we have to go. he says as for me, i'm going to fight like hell for my constituents and the country i deeply love. you deserve no less, especially right now. i forgot he had constituents. until i read that, oh my gosh, he's a congressman with constituents. i had forgotten because every other line in it was about how he's fighting this justice department, cancel culture, cnn, and then i was like, oh, right. he's supposed to be serving constituents. >> he's a two-term member with very few accomplishments in a lot of trouble and his question we always ask ourselves is, what are the moments that are going to matter most to the jury? cnn legal analyst elie honig joins us now. a former state and federal prosecutor and we heard from two police officers yesterday including the chief. so what was the main take away from the testimony? >> john, a big question yesterday and throughout this trial, did derek chauvin use excessive force against george floyd? we've now heard from three witnesses not just any witnesses, though, the three who would know this issue is best. last week we heard from the most senior officer in the entire police department. yesterday we heard from the chief and the training officer all three of them have said unequivocally this force was excessive and it was not even a close call. let's listen to that. >> what is your view of that use of force during that time period? >> totally unnecessary. >> that in no way, shape or form, is anything that is by policy. it is not part of our training. and it is certainly not part of ou our ethics or values. >> i don't know what kind of improvised position that. it's not what we train. >> both of witnesses yesterday i think came off as very credible, measured, experts in their field and i thought they really connected with the jury. now, the defense lawyer tried to undue some of the damage in his cross-examination. >> there's limitations on the use of force, right? >> yes, there are limitations, yes. >> and it's situation by situation, right? >> yes. >> the use of force has no precise objective, singular rule. it's different in every case? >> yes. >> and this is where the defense is going. look, you can have these rules on the books but out on the streets it's subjective. things are happening quickly. you can't second guess after the fact. the problem is that doesn't mean anything goes and the witnesses yesterday were clear that what chauvin did was far over the line. >> and so there was also this dispute about the exact placement of derek chauvin's knee. why is that so critically important? >> yeah, alisyn, looked for a brief moment like the defense lawyer almost had this perry mason a ha moment. here is what happened. >> would you agree that from the perspective of officer king's body camera, it appears that officer chauvin's knee was more on there employed's shoulder blade. >> yes. >> that seemed like a very important moment. was chauvin's knee actually on george floyd's shoulder blade, not on his neck. but then the prosecutor got back up on redirect examination and watch what happened then. >> so the knee of the defendant was on mr. floyd's neck up until the time you just pointed out? >> yes. when i viewed that video portion, that is the first time that seen the knee on the defendant on the shoulder blade area. >> that was a really costly moment for the defense counsel. not only did he lose the actual point, it was clear that the knee was on the neck up until that very last moment. but he damaged his own credibility in the jury's eyes. going to try a move like that stunt like that and it backfires the jury is going to remember that when they're assessing your credibility as a lawyer. >> something peculiar is going to happen this morning, a friend of george floyd who i believe was with him at the time. the judge wants to question him and try to figure out about whether this testimony is admissible. what's going to happen here? >> the prosecution wants the testimony from george floyd's friend is invoking the fifth amendment. he is not charged with a crime. any person has the right to remain silent invoke if their testimony can be used against them in future proceeding. judges bring people in that situation in and question them. this will happen in private to make sure it's legitimate invocation of the fifth amendment to make sure they have some basis to invoke it. once in a while people fudge it or fake it to get out of testify mchg the judge will make that talks with iran to revive the nuclear deal today. tell us all this background, fred. >> reporter: hi, there, alisyn. they have these ten individuals they 2k50i789ed after the shooting of the ukrainian passenger plane early last year. all this happened right after the u.s. killed iranian revolutionary guard soleimani in a drone strike. the italians retaliated by shooting ballistic missiles at the u.s. base in iraq and they feared there would be u.s. retaliation and they mistook that ukrainian plane for a possible u.s. missile and shot it down. obviously they said a lot of failures there in the entire chain of command and now we hear ten individuals have been indicted and they're saying a military court will deal with them. very tough negotiations but also very important negotiations. two sides aren't talking directly to one another. the europeans are talking about the iranians, to the iranians about getting back into full compliance with the iran nuclear deal. of course, the iranians have enriched a lot of yuranium and higher grade. so europeans said the iranians should get back in compliance with that. at the same time, at a different den venue talking about possible sanctions. both sides say they want to get the u.s. back into the nuclear agreement. they want to get iran back into full compliance, want to salvage this deal. the big question here, however, is who is going to move first and what are the background moves going to be in all of this, john. >> it will be fascinating to see who moves first or if they core graph a movement at the exact same time. great to have you there. >> growing concern about the health of russian opposition leader alexei navalny in prison said to be on a hunger strike. cnn's matthew chance is where navalny is being held, matthew. what have we learned. >> reporter: hey, john. this is prison camp penal colony number 2 in a small town about two hour drive outside of russian capital moscow. you see alexei navalny is behind those sort of metal fences over there. we're not being allowed to go any further by these prison officers that have been posted outside to keep all the journalists and the various people, protesters come out here today to protest against the fact that alexei navalny has not been given the medical attention he's asked for. he's been quite sick since he was moved into this penal colony and complaining about a bad back and that pain spread to both of his legs. doesn't sound that serious, does it, when you consider that back in august alexei navalny was poisoned with a suspected nerve agent, there's a strong chance according to doctors it could be linked to some kind of neurological damage which is why alexei navalny's doctors want to give him a proper, thorough examination. there are other complications as well. hunger strike, first of all, he lost quite a lot of weight to protect the fact he's not getting the doctor he wants to see. also, he's within the past 24 hours reported a very high temperature and a cough which is obviously very concerning in this time of covid. but he also says that it may not be covid, it may be ta burr cue low sis. his health is now very serious concern to all of those who are watching developments of alexei navalny, john. >> what an interesting report and the mere image of you standing there. it does not smell of transparency the picture of you there surrounded by russian law enforcement/military, does it? >> reporter: no. but there has been some video funny enough that's come out over the past couple days showing alexei navalny inside this penal colony. it's closed circuit television, pictures of him sleeping in bed. he complained he's suffering from sleep deprivation, woken up every hour. showing him fast asleep in bed. you can see him
