the world, this is "early start." i'm laura jarrett. >> good friday morning. i'm christine romans. it is february 12th and it is 4 a.m. in new york. in any other trial donald trump's legal team would face a daunting challenge today fending off a devastating impeachment case against the former president. house managers have wrapped their case now painting trump as a dangerous tyrant who turned his mob on fellow americans laying out in graphic detail how the deadly siege terrorized the rank and file and black police officers called the n word and janitors cleaning up blood and feces left behind by the pro trump rioters. >> house managers tried to link the insurrection to the former president showing how long he tried to undermine the election, how his supporters were conditioned to attack. how donald trump drew them to washington and unleashed them on the capitol. democrats warned senators a refusal to convict could incite more of the same. >> i'm not afraid of donald trump running again in four years. i'm afraid he's going to run again and lose because he can do this again. >> we humbly, humbly ask you to convict president trump for the crime for which he is overwhelmingly guilty of. because if you don't, if we pretend this didn't happen, or, worse, if we let it go unanswered, who's to say it won't happen again? >> house democrats used most but not all of their allotted 16 hours. former president trump's lawyers won't go nearly that long we're told. cnn's jessica dean is live for us on capitol hill this morning. jessica, nice to see you. how is the trump defense shaping up? how are they planning to go about this? >> reporter: first of all, laura, it's going to be much shorter than the 16 hours and much shorter than what the house impeachment managers did. we're expecting them to go at noon and go three or four hours. pretty condensed presentation to the senate. and we also know that last night we saw three senators, senator mike lee, senator ted cruz and senator lindsey graham going in and conferring with former president trump's defense team. these are supposed to be unbiased jurors in this case but they did go in and talk with them. when senator cruz came out he said they were discussing strategy. senator graham didn't stop and talk, he just told all the reporters gathered that he'd see all of us tomorrow. at that point everybody kind of disbursed. we know that trump's defense team is going to try to make the case that democrats have used language similar to what former president trump used. house impeachment managers making the case that that didn't lead to a deadly insurrection at the u.s. capitol on january 6. bruce castor told cnn that he did not believe that trump instructed rioters to come here to the capitol and that he did not believe they were following those orders. but video shows something different. take a listen. >> we were invited here. we were invited. we were invited here. we were invited by the president of the united states. >> i thought i was following my president. i thought i was following what we were called to do. >> president trump requested that we be in d.c. on the 6th. >> we are visiting trump, your boss. >> we also learned that the department of justice is saying that one of the members of the far right group, the oath keepers, said that she was coming here to follow the requests of then president trump so, again, that coming from the doj just yesterday, that they believed that to be true. now as far as today goes, i mentioned it's going to be pretty short in terms of the defense's presentation. right now there's no indications that they are going to call witnesses in this and it is possible that the senators will by pass giving any sort of speeches. now if all of that holds up, laura, this trial could wrap up as soon as saturday or sunday. laura? >> yeah. it will be interesting to see what the questions are for both sides here. jessica, thank you. what we've learned from this trial is that one of the most secure devices in the entire u.s. government was put at risk by the pro trump mob. we showed you video yesterday of then vice president mike pence being evacuated from the senate chamber. watch five people behind him. you see a military officer carrying the so-called nuclear football. military officials were not aware the device was potentially within reach of that mob since they never lost control of the nuclear football, they did not have to deactivate pence's system. >> the city of san francisco filing an emergency court order to force its public schools to reopen for in person instruction. the order calls the school's district decision to stay closed unconscionable and unlawful claiming it violates the constitutional rights of the children. nearly half of the 20 largest school districts in america are fully on line after walking back expectations. the white house says president biden will not rest until every school is open five days a week. that's going to be a challenge. john harwood has more now. >> today we're going to get a clue as to how the biden administration is going handle a key early collision between the public commitment to the american people and the interests of a key political ally. president biden ran for the white house promising to open american schools within the first 100 days of his presidency. that promise is facing push back from teachers unions who are a key part of the democratic coalition. the administration's cdc director michelle wa olinski increased pressure by saying schools could open without vaccinating all teachers but teachers are concerned it's not safe enough. jen psaki indicated perhaps the president could meet his commitment if most schools were to open for in-person learning one tai a week within the first 100 days. that's not good enough for all of the teachers concerned about the students falling behind. the cdc is providing official guidance. that will show us how they'll handle this collision of priorities. laura and christ sneen. >> john, thank you for that. keeping kids out of the classroom could hurt the future earnings. a professor at the university said students could see their lifelong earnings cut by 9% unless schools can make up for learning losses brought on by the pandemic. poorer kids with fewer resources will most likely suffer more. keeping kids out of school could have serious effects on the economy. the gdp could be 3 or 4% for the rest of the century. warning that can't be fixed. president biden's coronavirus team plans to have vaccines available for young children as early as this fall. dr. anthony fauci says when schools reopen it's likely schools will be able to get vaccinated in the fall. they're starting off with older age by late july to inoculate most americans. >> and further good news, both companies agree and are now contractually obligated to expedite delivery of 100 million doses that were promised by the end of june, deliver them by the end of may. that's a month faster. that means lives that we save. >> president trump took a shot saying his team was meant there's a lot more vaccine available than there actually was. cnn reported despite the promise reserve supplies and second doses were scarce when president biden was sworn in and they remain that way. >> the number of shots in arms per day has nearly doubled since the inauguration. keeping those numbers up means keeping up the supply. there have been 18 million doses shipped and 14 million doses in arms so not a lot of room for error if logistics or weather delay the shipments. some cities are being forced to cancel appointments because of limited supply. starting today your local pharmacy may have the coronavirus vaccine. the york. more than 100,000 sams clubs and pharmacies will begin administering covid-19 vaccines. the locations in 22 states. walmart worked with the u.s. centers for disease control and prevention to identify pharmacy locations according to factors such as population density and infection rates and medically under served areas. i'm bianna golly dreeg ga in new york. maryland governor larry hogan pledged nearly 1 million covid-19 tests and an unlimited supply of ppe for the state's schools free of charge on thursday. so far the governor said all but two public school districts have either resumed in person instruction for the march date. hogan said he would use any legal means necessary to get students back into classrooms drawing criticisms from teacher's unions. >> reporter: i'm natasha chen. the city of new orleans has announced all indoor and outdoor bars will be closed friday through mardi gras which is next tuesday. bars operating as restaurants will also be closed to the public. liquor stores will be prohibited in the french quarter and all to go drinks will be banned during this time. latoya cantrell said the crowds seen on bourbon street were unacceptable. she'd rather be accused of doing too much rather than too little when it comes to people's health. >> now the health of the commander in chief isn't just a personal issue, it is a matter of national security. when donald trump contracted coronavirus last october, he was much sticker than anyone let on. sources tell cnn his condition deteriorated so rapidly doctors even considered putting him on a ventilator. boris sanchez is live near west palm beach near mar-a-lago. what are we learning about the president's health at that time? >> reporter: hey, good morning, christine. yeah, as his lawyers get ready to defend him in the impeachment proceedings, we're learning donald trump's bout with coronavirus was far more serious than the white house and his doctors at the time were sharing with the american public. and you're right, sources indicating that the president was so ill and breathing became so difficult for him that there were discussions about putting him on a ventilator. we're also learning from "the new york times" that the former president had lung infiltrates. that's one of the hallmark symptoms of covid-19, when you have a buildup of bacteria and fluid in your lungs and that's why breathing becomes so difficult. on top of that, we're learning his blood oxygen levels dipped into the 80s. for context, a blood oxygen level in the 90s is considered dangerous. of course, at the time his doctors publicly tap danced around all of these issues. this is dr. sean conley back in october trying to clear this up for reporters. listen to this. >> reporter: did his oxygen level ever dip below 90? >> we don't have any recordings here of that. >> is there a ventilator at the white house. >> white house, here, anything below 90. >> no. it was below 94%. it wasn't down into the low 80s or anything. >> yeah. so this underscores the disconnect between reality and the trump white house. certainly one of the legacies of donald trump's presidency, but it also reveals just how much he underplayed this virus, not only in himself but to the american people. obviously the commander in chief sets the example for the nation. he received treatment that is not really available to the vast majority of americans, then he exposed secret service agents to the virus in the motorcade he had outside of walter reed medical center all so he could wave to his supporters. >> back to we have never seen before. how did the managers find all of that material? done o'sullivan reports. >> the social media platform parler which touted itself as a free speech platform was actually full of misinformation and hate and a lot of pro trump misinformation and false claims about the election was being used by a lot of the people who came here to washington, d.c., on january 6th and took part in the insurrection. they were posting a lot of video, a lot of evidence to the website from that day. in the days after the insurrection amazon which was hosting parler on the servers announced it didn't want anything to do with this website and that it was pulling support for parler essentially taking it offline. that's when a quick thinking computer programmer swung into action. she realized there were so many videos from that day, so much potential evidence she began downloading them. in total she got 30 terabytes of data, 30,000 gigabytes. she posted them publicly to download. pro public cla and now we're seeing the house impeachment managers. take a look at this. >> guys, we're here at the capital right now. we're going to go back in. >> i'm the only one with a show. i brought one just in case. >> make sure if you ever take over the capitol or any other big place, make sure you bring a shield. you can't get this anywhere except for -- all right, guys. thanks for watching. >> important to point out that that video has not been used in the house impeachment trial but it does give you a sense of how boastful people were being on this platform about their role in the insurrection and how that could be used as evidence and is being used as evidence in the trial and also by the authorities. now it is important to point out that this hacker who goes by the name of crash override on line this anonymous activist pointed out everything they pointed out was publicly available. they did not hack into any systems for this. >> so interesting. done o'sullivan, thank 30 minutes past the hour here in new york. so if donald trump's impeachment were a real trial with an unbiased jury, the defense team would face an uphill battle today. a devastating case chock full of video evidence and an unremorseful client f. this were a real trial, he wouldn't have the defense attorneys openly conspireing with the jurors or going on tv in the middle of this case, but this isn't a real trial. house managers wrapped their case painting trump as a dangerous autocrat who turned his mob on a co-equal branch of government and did it on purpose. if this were a real trial the defense would have to confront all of the graphic detail, how the deadly siege terrorized the rank and file at the capitol including the black police officers repeatedly being called the "n" word by the mob and janitors having to clean up the mess. >> they offered a prebuttle of sorts and saying whipping up a frenzied mess. >> january 6th was not some unexpected radical break from his normal law abiding and peace fill disposition, this was his state of mind. this was his essential mo. he knew that egged on by his tweets, his lies, and his promise of a wild time in washington to guarantee his grip on power, his most extreme followers would show up bright and early, ready to attack, ready to engage in violence ready to fight like hell for their leader. is there any political leader who believes donald trump would stop inciting violence to get his way? would you bet the lives of more police officers on that? would you bet the safety of your family on that? would you bet the future of your democracy on that? president trump declared his conduct totally appropriate. so if he gets back into office and it happens again, we'll have no one to blame but ourselves. >> jessica dean is live on capitol hill this morning for us. good morning, jessica. how is the trump legal team planning to rebut this? >> reporter: good morning to you, christine. we know this is going to be quite concise. they have indicated they want to get through this as quickly as possible. just a reminder, they have a full 16 hours over two days to make their case, but we're told they expect to do so in three to four hours, so wrapping up later this afternoon. we know in addition to the constitution at question, which the senate actually voted on, that it is constitutional, but that has been an argument that it's unkconstitutional to impeah a former president. they're going to talk about former president trump's first amendment rights. we know they're going to try to make the case that democrats have used language similar to what former president trump used. now of course the house impeachment managers making the case that there was an insurrection after this language, after what former president trump did, that he was directly responsible for inciting violence here on january 6th that resulted in deaths and a lot of trauma for so many people who were here on that day. yesterday we heard from former president trump's -- one of his defense attorneys, bruce castor, who told cnn the rioters were acting -- he did not believe the rioters were acting on the former advice of trump but if you listen to the video, they use a lot of the former language the president did. listen. >> stop the steal. >> stop the steal. stop the steal. >> that's treason. that's treason. >> treason. treason. treason. >> mike pence, i will tell you right now, i am not hearing good stories. >> mike pence [ bleep ]. >> the democrats are trying to steal the white house. you cannot let them. >> they don't get to steal it from us. >> we're bringing our country back. >> we want our country back. >> this is our country. >> this is our house. this is our country. our country. >> reporter: now we're also learning from the department of justice, they have come out and said that a member of the far right group, the oath keepers, said that she was responding to what former president trump had told her to do. that is coming now from the department of justice. now as we look ahead to today, again, they'll get started at noon as they've been doing throughout the week. right now there's no indication that house impeachment managers were called for witnesses and it's possible that the senators will by pass their typical speeches that they would give at the conclusion of both presentations from both sides. and if they keep that time frame going, christine, this trial could wrap up as soon as saturday and, again, at this point all indications point to an acquittal. just a reminder democrats would need 17 republicans to join them to get a conviction. >> jessica dean at the capitol for us. thank you, jessica. let's bring in cnn's senior political analyst, john avlon. if this were a fact-based trial, a trial based on substance, the defense team would be in an awfully tough spot but we know it's not the case. this is not a real trial. they know it, too. the defense team previewing they're only going to need three hours even after their abysmal performance earlier this week. so what's their strategy today? >> reporter: their strategy is going to be to try to ignore the evidence, say the evidence doesn't exist. to say democrats are hypocrites, put the onus on them, and what that all sounds like is basically just ripping a page from donald trump's playbook. denial and deflection. they're not going to want to deal with the evidence because they don't actually have any answer for it. they're going to probably try to argue it's unconstitutional even though they're going to try to take it off the table. they're going to say there's never been another attack in america's history in politics. finally they will try to say and argue that you can't connect the rioters with the president's intent. they may have understood this to be the presidential order, but it wasn't trump's intent. that may be the strongest argument they have. >> remember, it wasn't just democrats who said trump wasn't responsible. listen. >> yeah. >> mr. president, you have got to stop this. you are the only person who can call this off. call it off. >> pretty simple, the president caused this protest to occur. he's the only one who can make it stop. >> the guy that knows how to tweet very aggressively on twitter, you know, puts out one of the weakest statements in one of the saddest days in american history. >> how persuasive is the argument that if trump isn't convicted, this could happen again? >> very because you're basically giving a green light. you're saying there's no accountability even in the eyes of history. this isn't about removing a president. that 2/3 bar is pretty high. it's not about removing a president, it's about inciting violence against our democracy is not allowed. and one thing, you know, among that litany of republicans who were trying to appeal to the president directly and indirectly to tell the mob to stand down was house republican leader mccarthy, and that pattern suggests that republicans were admitting on that day in real time that only donald trump could turn back the crowd. that seems to me to be a very relevant piece of evidence in terms of the cause/effect of incitement of insurrection. >> it's amazing how much can change in one month. you felt the sense of urgency and now it's so much silence. i've been saying all morning that this isn't a real trial. one of the more glaring reasons are some of the jurors aren't bothering to seem impartial. last night trump's team caught in a room with lindsey graham, ted cruz and mike lee. the senators are both jurors but they're also victims and arguably complicit themselves to the extent they also participated in fueling the big lie. >> yes. >> how should people see this? >> look, at the end of the day even though alexander hamilton, the founder, said that impeachment is a political process not for something that is a statutory crime, the senators are jurors. they all took an oath to do impartial justice under the constitution. counselor, i have a question for you, laura. typically if jurors were conspiring with defense attorneys -- >> they'd be thrown off the case. >> reporter: would they be pulled off the case? >> yes, immediately. part of the problems, one of the jurors is the judge. this whole thing is turned on its head. how is the judge going to throw them off the case? he's a juror. >> reporter: just because this is an unprecedented situation, doesn't mean certain standards apply. they took an oath to do impartial judgment, they're doing the opposite. >> thanks for dropping by. the economy is still struggling, but confidence in the recovery is growing. renewed optimism over vaccines and impending stimulus from washington even as fears of coronavirus variants are rising. economists and major banks have boosted their gdp forecast for the year with one economist calling for a summer mini boom courtesy of the fiscal stimulus. oxford economics expects 5.9% growth. goldman sachs raised to 6.8%. if this is true, it would be the fastest growth since all the way back in 1989. jobs recovery has stalled. the economy added just 49,000 jobs in january. unemployment claims are still stubbornly high. another 793,000 americans filed for the first time for jobless benefits last week alone. that is still among the worst levels of the great recession. the white house is set to hold a meeting with major airline executives today. telling cnn the industry is in an uproar over the possibility of testing domestic travelers for coronavirus. airlines have been financially crippled by the pandemic and are weary of new restrictions. last month the cdc required a negative test for international travelers before boarding a flight. law enforcement officers who while the statewide mask mandate is allowed to expire today, the governor said that local communities may continue to enforce their own mandates. he says he will continue to wear masks and encourages all residents to do the same. >> reporter: i'm athena jones. ohio governor mike dewine allowed the state's curfew to expire at noon on thursday citing a sustained decrease in covid-19 hospitalizations. the move comes as the state's hospitalization numbers dropped below 2500 for seven consecutive days. governor dewine said it was crucial ohioans continued crucial safety protocols and if hospitalizations begin to rise, they may reinstate the curfew. i'm evan mcmorris santoro. new york city restaurants will reopen for indoor dining starting on friday. restaurants will be limited to 25% capacity. the reopening was expected to come on sunday, valentine's day, but this week new york governor andrew cuomo pushed the reopening date back two days to give restaurants time to prepare for a day they all hope to be very, very busy. restaurants were closed to indoor dining back in december as pandemic numbers surged here, but those numbers have come back down leading officials to relax certain restrictions including this one on indoor dining. >> thanks to all of our correspondents for those updates. president biden prepared to roll back a controversial policy against migrants at the southern border. priscilla alvarez is live with us. what more are you learning? >> reporter: officials are telling us the biden administration is freepg admit migrants along the southern border and were subject to a trump era policy that forced them to remain there while they claimed asylum. this addresses the more than 20,000 migrants who were forced to remain in mexico as their immigration hearings continued in the united states. the biden administration has slowly begun to draw down the program by stomping in. officials tells us this is going to be by no means a quick process, it will be gradual. they will look at vulnerable migrants first as well as those initially put in the program, some of whom it could have been at least two years ago. so this is all going to be a process that plays out slowly on the southern border. it will not be across the entirety of the border, but rather at select ports of entry. now one of the biggest challenges the administration is going to face is how do you communicate to the migrants when it's their turn to come to the border. this is a problem because frankly there's a lot of misinformation. that can happen across platforms, facebook, whatsapp, twitter. the critical part is going to be communicating to the migrants. when they should report because otherwise what we're seeing is migrant smuggling networks are really starting to move up along the border. that's because we're in this unprecedented situation where we have thousands of migrants who are waiting there. so as the biden administration begins this roll back, they will in st. louis are looking for a funeral home van that was stolen with a body inside. the white cargo van was taken thursday morning when the driver stopped atz a convenience store leaving the vehicle unattended and the car running. police want to question a man and woman seen on surveillance video inside of the store. felony charges against two buffalo police officers who pushed an elderly protester to the ground have been dismissed. they pleaded not guilty to second degree assault. 75-year-old martin eugeneo suffered a skull fracture during the fall. both officers remain suspended from the force due to a surprise. >> the video is shocking even now. looking at markets to end the week. markets in china and hong kong closed for the lunar new year. the u.k. economy contracted 9.9% last year, the largest annual fall in u.k. economic growth on record. the pandemic has effectively wiped out economic growth in the u.k. over the last seven years. moving to wall street, futures down a little bit. the dow fell short hitting a new record high thursday but the s&p managed fresh highs. good news for homeowners. home prices rosa cross the country. price gains were widespread. home prices rose by double digits all across the country. credit record, low mortgage rates, strong demand for families moving for more space and not a lot of supply to choose from. record low inventory right now. it's made it hard for buyers to find homes. they're rising higher than the income of the average working family. the large swings in prices could start to sideline potential buyers. master card is bringing bitcoin to the checkout counter. master card says its crypto partners will convert the digital currency into traditional currency and transmit it over its network yet. earlier this week tesla announced a $1.5 billion investment in bitcoin and said it will accept it as payment for vehicles. disney+ smashed expectations in the quarter. it has 95 million up from 86 million in december. it shows just how vital disney+ is to the company. revenue in the parks division fell 53%. many are still closed or operating at reduced capacity. when the parks reopen, that depends when
