the set, standing there in the line of fire when her colleague and friend halyna hutchins was shot by the bullet that was discharged from alec baldwin's gun and killed and that bullet then proceeded to lodge itself in the director's clavicle and injured him. but mamie, being so adjacent to halyna hutchins is certainly traumatised, and physically injured and just emotionally upset by what she saw and heard and what she suffered. 0ur saw and heard and what she suffered. our key legal arguments, the theories of our case have to do with assault, intentional infliction of emotional distress and also deliberate infliction of harm. those are our theories. but throughout all this production there were numerous violations of safety protocols or ignoring safety protocols. it demonstrated themselves in many ways. let's talk about alec baldwin for a moment. the gun, for example, was handed to alec baldwin by the assistant director. according to the safety protocol, guns from motion picture and and for television are never to be handed by anyone other than the p"°p handed by anyone other than the prop master or armourer to the actor. and mr baldwin, an industry veteran knew that the gun in question should never have been given to him by the assistant director and he could not rely on any statement by the assistant director as to whether or not the gun was safe to use because the industrywide safety bulletin for the use of firearms requires that all firearms requires that all firearms are treated as though they are loaded and mr baldwin should have assumed that the guiding question was loaded unless demonstrated to him by the armourer that it was not or checked by him that it was not loaded. and even if the assistant director made an alleged statement to him that the gun he was handing to him was, quote, a cold gun,", mr baldwin should not have relied on that statement. so these are some of the issues in the case involving, you know, guns and ammunition that was supposed to be secured throughout the production. the armourer who was required to keep guns and ammunition locked up or to stay with the guns until used. instead, the armourer was alleged to have allowed guns and ammunition to be left out unintended on a rolling cart. 0utside unintended on a rolling cart. outside the church at midday during lunch break. and it is still a mystery as to how that bullet got into the gun that mr baldwin used. it sounds like according to you, a lot of the blame is at the door of alec baldwin, as opposed to others who were onset you should have been responsible for the safety at the time of filming. first of all, we have sued all of the producers, we have sued also the assistant director, also the assistant director, also the assistant director, also the armourer, hannah, but, again, mr baldwin is very important in all of this because we allege he chose to play russian relate, firing a gun without checking it, without an armoury doing so in his presence, and so that is why we say has behaviour and that of the producers on rust was reckless. from the point of view of alec baldwin, the actor, those working on the set, they haven't made much in terms of comment because, of course, they have probably been advised to say very little, given the fact that lawsuits are under way, but mr baldwin has denied the films that was unsafe. well, you know, you can deny it but the problem is that there is evidence there, for example, there were two mishaps with guns prior to this incident, one in which allegedly one of the crewmembers ended up shooting herself in the foot. another was an incident with mr baldwin's stunt double, a misfire. when it comes to what you can improve, one thing you mentioned earlier is that there needs to be intentional affection of emotional distress. that is something very difficult to prove, isn't it, in a court of law? whereas the other issues such as safety, procedures not being followed, that is more likely to be proved, is it not? well, we do think we have evidence to support our legal theories, all we wouldn't have argued those legal theories in this lawsuit that we are failing. and we do, by the way, have more evidence than we have been presenting to the public. for example, i think another important point is there was nothing in the script of the scene that alec baldwin was going to be filming, and by the way, one that gun was discharged, it wasn't even a rehearsal. a rehearsal is a called rehearsal. no rehearsal was called. also, in the script that he was going to film after rehearsal was called, hadn't been called depot but the gun went off, there was nothing in the scene he was going to be shooting orfilming, i should say to make it clear that called for a discharge of a gun. by him or anyone else. so why was that gun even discharged? it didn't call for that. that is a very good point to make. i am afraid to say we're going to have to stop this conversation here but from her. there was no evidence it was from her, and i think there is a history of any fire scepticism in these sorts of situations with the chinese state media. to the action on court now, another still for this time of year. so another mild and quite breezy day to come on thursday. dry weather for most of us, but not everywhere. we have got this weather front sitting close to the north of scotland, so that'll produce outbreaks of rain mainly for northern and western scotland, but high pressure to the south dominating the weather for most places. and with that high pressure, we're drawing in winds from a south—westerly direction, so bringing the mild air and the orange colours really right across the uk. might be a bit of a chilly start for some southern and eastern parts of england first thing, the odd misty patch around. generally, the cloud will increase from the west through the day, but there will be some spells of sunshine for east anglia and the south—east, up towards eastern scotland, as well. still a bit of rain to come for the north—west of scotland, but the breeze blowing over the mountains is likely to create something called a foehn effect, lifting temperatures to around 17 degrees for aberdeenshire. widely 1a or 15 the top temperature, and compare that to the average temperature this time of year of only about 9 degrees, so well above average. it'll be windy again particularly in the north—west, with gusts of wind about aomph, but lighter winds further south. so through thursday evening now and heading overnight into friday, it'll be a pretty cloudy picture. a bit of low cloud and hill fog likely, some drizzle around some coastal hills in the west once again. but it will be a very mild and certainly frost—free start to friday morning, but we've still got that rain continuing across the western isles and northern highland, as well. into friday, no great changes — there's that weather front across the north of scotland, there's the high pressure in charge for most places. so quite a cloudy picture, i think, but predominantly dry through the day on friday, away from the north and north—west of scotland where we've got that weather front continuing to bring outbreaks of rain. temperatures again getting up to 1a, 15, even 16 degrees, bit of a foehn effect once again through the east of scotland. it won't last forever, this mild weather, though — into the weekend, saturday, we'll see a cold front moving south across the northern half of the uk. into sunday, that slips its way further south, and it'll introduce the blue colours, the colder air mass with these northerly winds moving across all areas. so gradually through the weekend, things will be turning colder. we'll still look at temperatures in double figures through the day on saturday, but by the time we get to sunday, things will be noticeably cooler — maybe time to dig out the winter coat. bye for now. bullet got into the gun that mr halyna hutchins. the film's supervisor, mamie mitchell alleges that the script didn't call for a gun to be fired. her lawyer accused alec baldwin of "playing russian roulette" when he fired the gun some of your comments already as to the feeling that you say a lot baldwin was playing russian roulette when he fired the gun onset without checking. from a legal perspective, what are your key the set, standing there in the line of fire when her colleague and friend halyna hutchins was shot by the bullet that was discharged from alec baldwin's gun and killed and that bullet then proceeded to lodge itself in the director's clavicle and injured him. but mamie, being so adjacent to halyna hutchins is certainly traumatised, and physically injured and just emotionally upset by what she saw and heard and what she suffered. 0ur saw and heard and what she suffered. our key legal arguments, the theories of our case have to do with assault, intentional infliction of emotional distress and also deliberate infliction of harm. those are our theories. but throughout all this production there were numerous violations of safety protocols or ignoring safety protocols. it demonstrated themselves in many ways. let's talk about alec baldwin for a moment. the gun, for example, was handed to alec baldwin by the assistant director. according to the safety protocol, guns from motion picture and and for television are never to be handed by anyone other than the p"°p handed by anyone other than the prop master or armourer to the actor. and mr baldwin, an industry veteran knew that the gun in question should never have been given to him by the assistant director and he could not rely on any statement by the assistant director as to whether or not the gun was safe to use because the industrywide safety bulletin for the use of firearms requires that all firearms requires that all firearms are treated as though they are loaded and mr baldwin should have assumed that the guiding question was loaded unless demonstrated to him by the armourer that it was not or checked by him that it was not loaded. and even if the assistant director made an alleged statement to him that the gun he was handing to him was, quote, a cold gun,", mr baldwin should not have relied on that statement. so these are some of the issues in the case involving, you know, guns and ammunition that was supposed to be secured throughout the production. the armourer who was required to keep guns and ammunition locked up or to stay with the guns until used. instead, the armourer was alleged to have allowed guns and ammunition to be left out unintended on a rolling cart. 0utside unintended on a rolling cart. outside the church at midday during lunch break. and it is still a mystery as to how that bullet got into the gun that mr baldwin used. it sounds like according to you, a lot of the blame is at the door of alec baldwin, as opposed to others who were onset you should have been responsible for the safety at the time of filming. first of all, we have sued all of the producers, we have sued also the assistant director, also the assistant director, also the assistant director, also the armourer, hannah, but, again, mr baldwin is very important in all of this because we allege he chose to play russian relate, firing a gun without checking it, without an armoury doing so in his presence, and so that is why we say has behaviour and that of the producers on rust was reckless. from the point of view of alec baldwin, the actor, those working on the set, they haven't made much in terms of comment because, of course, they have probably been advised to say very little, given the fact that lawsuits are under way, but mr baldwin has denied the films that was unsafe. well, you know, you can deny it but the problem is that there is evidence there, for example, there were two mishaps with guns prior to this incident, one in which allegedly one of the crewmembers ended up shooting herself in the foot. another was an incident with mr baldwin's stunt double, a misfire. when it comes to what you can improve, one thing you mentioned earlier is that there needs to be intentional affection of emotional distress. that is something very difficult to prove, isn't it, in a court of law? whereas the other issues such as safety, procedures not being followed, that is more likely to be proved, is it not? well, we do think we have evidence to support our legal theories, all we wouldn't have argued those legal theories in this lawsuit that we are failing. and we do, by the way, have more evidence than we have been presenting to the public. for example, i think another important point is there was nothing in the script of the scene that alec baldwin was going to be filming, and by the way, one that gun was discharged, it wasn't even a rehearsal. a rehearsal is a called rehearsal. no rehearsal was called. also, in the script that he was going to film after rehearsal was called, hadn't been called depot but the gun went off, there was nothing in the scene he was going to be shooting orfilming, i should say to make it clear that called for a discharge of a gun. by him or anyone else. so why was that gun even discharged? it didn't call for that. that is a very good point to make. i am afraid to say we're going to have to stop this conversation here but in tennis concerning chinese player peng shuai. she hadn't been heard from for a while, after making allegations of sexual assault against the country's former vice premier. chinese state tv has since published an email, which they claim is from peng directed at womens tennis bosses. it says: "i am not missing, noram i unsafe... "i've just been resting at home and everything is fine." but the chairman of the wta, steve simon, responded by saying the statement, "only raises my concerns as to her safety and whereabouts". he says, "the wta and the rest of the world need independent "and verifiable proof that she is safe". the tennis journalist ben rothenberg has been following this story, and feels the sceptism is justified. i think ithink so, i think so, reading that post i was immediately very dubious. it doesn't sound like something she had written. we see this very long, detailed emotional post from her on her social media in her own words that was quickly covered up and it does didn't seem like this message, you know, put out on state media was anything that should be trusted as being authentically from her. there was no evidence it was from her, and i think there is a history of any fire scepticism in these sorts of situations with the chinese state media. to the action on court now, another semi—final spot is up for grabs, in the season ending atp tour finals in turin later on thursday. alex zverev and jannik sinner are looking to progress from the red group. they'll be looking to follow the lead of the world number one, novak djokovic, who beat andrey rublev in straight sets — two wins out of two for him now in the green group round robin phase. djokovic is hoping to win the the feeling the pressure to perform well, to secure university placements, jobs and even future relationships. 0ur korea correspondent, laura bicker, has been documenting the preparations of three korean students. the big day has arrived. so much depends on this one exam that parents can't help but watch and worry. and make sure their loved ones have everything they need. for the last 100 days, we are three students to record their thoughts as they prepare for this life changing test. she goes to school on an island with only 19 has to go to the mainland. good luck, somebody shouts as she leaves. next. don't go anywhere, see you in a moment. hello there. the weather isn't changing in too much of a hurry over the next few days, because high pressure keeping things dry, settled, and very mild still for this time of year. so another mild and quite breezy day to come on thursday. dry weather for most of us, but not everywhere. we have got this weather front sitting close to the north of scotland, so that'll produce outbreaks of rain mainly for northern and western scotland, but high pressure to the south dominating the weather for most places. and with that high pressure, we're drawing in winds from a south—westerly direction, so bringing the mild air and the orange colours really right across the uk. might be a bit of a chilly start for some southern and eastern parts of england first thing, the odd misty patch around. generally, the cloud will increase from the west through the day, but there will be some spells of sunshine for east anglia and the south—east, up towards eastern scotland, as well. still a bit of rain to come for the north—west of scotland, but the breeze blowing over the mountains is likely to create something called a foehn effect, lifting temperatures to around 17 degrees for aberdeenshire. widely 1a or 15 the top temperature, and compare that to the average temperature this time of year of only about 9 degrees, so well above average. it'll be windy again particularly in the north—west, with gusts of wind about aomph, but lighter winds further south. so through thursday evening now and heading overnight into friday, it'll be a pretty cloudy picture. a bit of low cloud and hill fog likely, some drizzle around some coastal hills in the west once again. but it will be a very mild and certainly frost—free start to friday morning, but we've still got that rain continuing across the western isles and northern highland, as well. into friday, no great changes — there's that weather front across the north of scotland, there's the high pressure in charge for most places. so quite a cloudy picture, i think, but predominantly dry through the day on friday, away from the north and north—west of scotland where we've got that weather front continuing to bring outbreaks of rain. temperatures again getting up to 1a, 15, even 16 degrees, bit of a foehn effect once again through the east of scotland. it won't last forever, this mild weather, though — into the weekend, saturday, we'll see a cold front moving south across the northern half of the uk. into sunday, that slips its way further south, and it'll introduce the blue colours, the colder air mass with these northerly winds moving across all areas. so gradually through the weekend, things will be turning colder. we'll still look at temperatures in double figures through the day on saturday, but by the time we get to sunday, things will be noticeably cooler — maybe time to dig out the winter coat. bye for now. bullet got into the gun that mr
