KOTA KINABALU: Warisan has filed a suit in the High Court on Wednesday (April 7) against Sebatik assemblyman Hassan Gani Amir, seeking a decision to compel him to vacate the seat as pledged prior to the election.
The writ of summon was delivered to Hassan s residence in Manggatal here by Warisan s lawyers Liaw Kee Siong, just two days after Hassan submitted his membership application to join Sabah Bersatu.
Among other declarations being sought from the courts was a declaration that Hassan breached his oath to remain with Warisan until the end of the term of the current assembly.
In court documents, Warisan claimed that Hassan was picked as a candidate for Warisan, on the condition that he remained loyal to the party.

KOTA KINABALU: The 10-party ruling Gabungan Rakyat Sabah coalition will ensure that there will be no friendly fights between its components in the next general election.
GRS chairman Datuk Seri Hajiji Noor said that he was confident that an understanding will be forged between the various component parties to ensure that they are united as a single front in facing the opposition in the coming national polls. I hope that the GRS consensus will be able to bring us together to ensure that there will be no clash of seats between all the component partners in the GRS, he said in his speech to mark the two year anniversary of Sabah Bersatu on Monday (April 5).

Kota Kinabalu: Lawyers doubt the effectiveness of a pre-signed letter by Sebatik Assemblyman Hassan Gani Amir
(pic), which states that he would deem to have vacated his seat after he left Parti Warisan Sabah.
The lawyers said the letter would likely not be enforceable by court due to freedom of association laws in Malaysia, and that the State Assembly can choose to disregard the letter.
“As we know, any contract which prevents switching parties is unenforceable. Any promise he made to resign cannot be enforced against him because it violates Article 10, which provides for freedom of association – it is an unenforceable promise,” said lawyer New Sin Yew.
