In the latest motion, Arrick said the application to reopen Grate s case will be filed March 30. The appointment of counsel for the application to reopen is currently contingent upon this court determining that there is a genuine issue as to whether the applicant was deprived of the effective assistance of counsel on appeal, Arrick said in the motion.  There can be no equal justice where the kind of trial a man gets depends on the amount of money he has, Arrick added. An attorney other than those handling original direct appeals is appointed so claims of ineffective assistance of appellate counsel can be included in the application, said Ashland County Prosecutor Christopher Tunnell.

UPDATE: Ohio Supreme Court upholds death penalty for Grate

ASHLAND On Thursday, the Ohio Supreme Court unanimously upheld the conviction and death sentence for Shawn Grate in the murder of two Ashland women.  Grate, convicted of killing five women in Ashland and elsewhere, was sentenced in 2018 to death and a minimum of 90 years to life in prison for the local murders of Stacey Stanley and Elizabeth Griffith. He was later additionally sentenced to life in prison without parole in Richland County for the murders of two Mansfield women and again in Marion County for the murder of a Louisiana woman. Thursday s decision was a result of an automatic, direct appeal to the Ohio Supreme Court. These appeals triggered in the wake of any death sentence.
