On March 29, the Biden Administration unveiled the broad strokes of a comprehensive, multi-agency plan to “accelerate and deploy offshore wind energy and jobs” in furtherance of President Biden’s twin priorities of fighting climate change and rebuilding America’s infrastructure. The ambitious plan aims to deploy 30 gigawatts (30,000 megawatts) of offshore wind generation capacity by 2030. Utilizing a “whole of government” approach, the plan involves coordinated action by the Departments of Interior, Energy and Commerce to open new lease sales on the continental shelf while protecting biodiversity and promoting co-use.
Recently, the Supreme Court released its decision in
Rutledge v. Pharmaceutical Care Management Association. The case considers whether the Employee Retirement Income Security Act of 1974 (“ERISA”) preempts an Arkansas state law regulating pharmacy benefit managers’ (“PBMs”) generic prescription drug reimbursement rates. The Supreme Court reversed and held that Arkansas’ state law regulating PBMs is not preempted by ERISA, clearing the way for stricter regulation of PBM pricing which may differ from state-to-state.
What Are PBMs and What Does This Ruling Have to Do with ERISA?
Insurance companies that issue fully insured ERISA group health plans and employer plan sponsors of self-funded ERISA group health plans frequently contract with PBMs to manage and administer the prescription drug component of the plan benefits.

On December 15, we published a QuickStudy outlining considerations for employers to contemplate as COVID-19 vaccines become available. Among other factors, we suggested employers determine whether to require vaccinations, and we addressed the legal parameters thereof. We also raised the points that not every employee will agree to be vaccinated, the available vaccines may not prove effective for for all employees, and there is no understanding yet of the length of time for which the vaccines will be effective.
On December 16, 2020, the Equal Employment Opportunity Commission (EEOC) issued its guidance with regard to employee vaccinations. Our advice and the considerations outlined in the December 15 QuickStudy align with the EEOC’s guidance. This updated Quick Study highlights key provisions in the EEOC’s guidance and supplements the December 15 QuickStudy.
