The Lewis and Clark County Commission took no action Thursday on a previously tabled resolution to join the Big Sky Passenger Rail Authority.
The move leaves the door open for further investigation by county staff, but also buys county leaders time to convince the rail authority s current board members to provide provisions that are more amenable to them, such as the ability for the county to remove itself from the authority. I really want to find a way to support this, County Commissioner Tom Rolfe said. I feel like if we get on now, we are signing a blank check that our tax payers will have to pay, and I really believe what I m hearing from the folks with the rail authority that they would like to put some sideboards on this that we can live with, where we d have some influence over what taxes and what costs there are, and if something goes wrong, we would have the ability to get out.
Kelly
A Helena jury returned the verdict after deliberating for approximately five hours Thursday afternoon. The verdict says the jury found the prosecution proved that Kelly caused the death of Luther. The jury also decided that Kelly was under severe emotional distress at the time of the killing.
Mitigated deliberate homicide is often punished less harshly than deliberate homicide, with a maximum penalty of 40 years in prison and no less than two years. Lewis and Clark County District Judge Christopher Abbott set a sentencing date for Kelly on May 20 at 11 a.m.
Abbott also revoked Kelly s bail and ordered a presentence investigation.

HELENA, Mont. - Former East Helena Police Chief William Harrington resigned from his position March 5 after allegations of sexual assault.
Public records indicate Harrington was placed under paid administrative leave Feb. 3 until a criminal investigation looking into the alleged misconduct would begin.
That same day, the Montana Department of Justice began a criminal investigation against Harrington regarding the alleged sexual assault. The investigation is not yet finished; therefore, Harrington is presumed innocent at this time.
The Montana Public Safety and Training (POST) was notified of Harrington s alleged wrongdoing.Â
The City of East Helena requested third-party firm to investigate Harrington s workplace behavior, public records said.
