Idaho Senate Passes Bill (SB 1218) To Ban Marijuana Advertising Friday, 07 May 2021
In a move that could limit the options of advocates promoting cannabis legalization initiatives, the Idaho Senate approved a bill on Wednesday that would ban advertising for marijuana in the state. The Senate passed the measure, SB 1218, with a vote of 21 to 14, sending the legislation to the state House of Representatives for consideration.
During debate on the bill, Sen. Scott Grow, the sponsor of the measure, said that billboards in western Idaho advertise cannabis businesses just over the border in Oregon, where recreational marijuana is legal for adults.
“People are being encouraged to violate the law,” Grow said. “They’re being encouraged to go over and get something they know is illegal in Idaho.”

The Senate on Wednesday approved legislation that would prohibit commercial advertising for marijuana in Idaho, a move that could potentially stymie ballot initiatives to legalize the drug in the state.
The Senate voted 21-14 to send the bill to the House.
The bill is being fast-tracked, with a public hearing earlier in the day before a Senate panel that was held almost immediately after it was posted, giving the public little opportunity to participate.
Lawmakers noted advertising in western Idaho for marijuana across the border in Oregon, where it’s legal.
Lawmakers noted that cigarette and alcohol advertising is banned in Idaho, so advertising for drugs such as marijuana, meth and heroin should also be banned.
Wayne Hoffman Idaho has the most conservative House of Representatives it has ever seen. That is not the doing of House Speaker Scott Bedke. Bedke hasn’t changed at all, clocking in at 66% right now on the Idaho Freedom Index. What’s different is the makeup of the rest of the Republicans serving in the state House of Representatives, which is behaving exactly as I predicted following the May 2020 primary. My expectation then was that Idahoans had elected the most conservative House of Representatives in the state’s entire history. When given an option, voters tended to select the candidate who promised to be more conservative than their opposition. As of today, out of a 70-member House, 42 members have scored more than 70% on the Idaho Freedom Index. Last year, which was also a pretty good year for conservatives in the House, saw 30 members score 70% or better. More dramatic is the way in which the House has attacked spending: As of today, 26 House members have scored highe
But other lawmakers said those concerns are unfounded when it comes to this grant.
The money would instead be spent by local collaboratives made up of parents, faith leaders, teachers and businesses. Programs would also be monitored by the Idaho State Board of Education to ensure compliance.
“Absolutely no money will be used to teach social justice or human sexuality. This bill is about teaching reading and math to our young children,” said Sen. Janie Ward-Engelking (D-Boise).
Sen. Carl Crabtree (R-Grangeville) said it was pushed by conservative business leaders and approved by the Trump administration.
“This is a common-sense approach from business in Idaho and the Trump administration,” Crabtree said. “Makes sense to me.”
