The ruling comes the same day another federal judge handed a victory to trans youth in Arkansas when he temporarily blocked the state from enforcing a ban on gender-affirming treatment for minors in the state. LGBTQ advocates swiftly cheered the West Virginia ruling, stressing that it could pave the way for similar decisions in cases concerning other anti-trans laws. So far this year, Alabama, Florida, South Dakota, Mississippi, Arkansas, Tennessee and Montana have enacted similar sports bans. âIt is our hope that courts recognize and address discrimination when they see it, and nowhere is it more visible than in these stark attacks against trans youth,â said Avatara Smith-Carrington, an attorney with Lambda Legal, in a statement.
CHARLESTON The state Board of Education, the state Secondary Schools Athletic Commission and the Harrison County school board all have asked to have a case regarding the state’s impending anti-transgender athlete law dismissed.
All three of the groups say they shouldn’t be included in the lawsuit because the law, which is set to take effect July 8, isn’t one they asked for and isn’t one they’ll be responsible for enforcing, according to court documents.
The groups filed motions last week in federal court in the case brought by 11-year-old Becky Pepper-Jackson and her mother Heather Jackson. They say the law would prevent Pepper-Jackson from trying out for her middle school cross country team for the 2021-22 school year. They seek an injunction to keep the law from going into effect.

Updated May 10, 2021;
A 28-year-old Carbon County man is being held without bail after police found homemade explosives and bomb-making materials following a search warrant served Saturday at his home, Weatherly police report.
On May 1, Anthony Petrone was found to have a “large homemade explosive device” in his backpack in a Dollar Store, police said. The Pennsylvania State Police Hazardous Device and Explosives Section was called in and safely removed the device, borough police said.
The borough had been “plagued with random explosions,” a news release said, and, after the initial contact with Petrone, led to state and borough police serving the warrant in the 300 block of First Street.
