The Fifth District Appellate Court gave Bradley Lavite, Superintendent of the Veterans Assistance Commission of Madison County, until June 1 to file a reply brief in his appeal involving a $1 million funding dispute.
Lavite and the Veterans’ Assistance Commission (VAC) filed a notice of appeal to the Fifth District on Aug. 3 through attorney Thomas Burkart of Hamel. In a previous motion for an appealable order, Burkart wrote that the plaintiffs respectfully disagree with former Madison County Circuit Judge David Dugan’s order granting the motion to dismiss filed by defendants Debra Ming-Mendoza, Mark von Nida and Madison County. Dugan is now a federal judge in the U.S. District Court for the Southern District of Illinois.

EDWARDSVILLE The owner of an Edwardsville commercial property claim the tenants refuse to vacate the premises after violating the lease agreement and failing to pay rent.
Schreiber Farm LLC filed a complaint May 7 in the Madison County Circuit Court against Artistic Gymnastics Institute LLC, Amanda Lee Verhaeg and Gregory M. Verhaeg, alleging breach of promissory note and forcible entry and detainer for past due rent.
According to Schreiber Farm s complaint, the defendants signed a lease agreement on Sept. 1, 2015, and an amended commercial lease agreement on Aug. 30, 2018, to rent a property on Industrial Drive in Edwardsville. The plaintiffs allege they have a right to possession of the property and that the defendants unlawfully withhold possession after their lease has been terminated due to violations.
