New Delhi: The Supreme Court on Friday ruled that state government officials cannot be made state election commissioners to ensure that the independence of the poll body is not compromised while issuing orders in a case relating to municipal polls in Goa.
“All states and territories in India shall henceforth ensure that it has an Independent State Election Commissioner as mandated under Article 243(4) of Constitution,”
It was a court case regarding uneven reservation of wards in the civic polls of Goa. Going to the root cause of it, the Supreme Court has delivered a historic judgement for the whole country - no government officer can hold the constitutional post of the State Election Commissioner. All should step down immediately.

PANAJI: Goa Chief Minister Pramod Sawant on Thursday welcomed the Supreme Court directive staying the Bombay High Court s order cancelling the elections in five municipalities.
The apex court on Thursday ordered to stay the verdict of the High Court s Goa bench, which had set aside a notification of the state Urban Development ministry on reservation of wards in five municipal councils.

Panaji, March 12 : The Supreme Court on Friday upheld the Bombay High Court s recent order postponing elections to five municipal councils in Goa over irregularities in reservation of constituencies for Scheduled Tribes and women.
Addressing reporters following the apex court order, advocate Carlos Ferreira, who heads the state Congress legal cell, said that the apex court had also faulted the Goa government for appointing the state s serving Law Secretary as a State Election Commissioner (SEC) and had directed other states to ensure that the SEC should not hold dual responsibilities.
