New car accident whiplash rules are an important step and a big win for consumers

The guideline levels rise in three-month increments up to 24 months where the maximum £4,215 payout could be received. Those who suffer an injury for between six months and nine months will receive £840 with those suffering between nine months and 12 months being paid over £1,300. Meanwhile, drivers who have an injury for over 12 months but no more than 15 months will be liable for a payout of over £2,000. The new legislation allows for an uplift of 20 percent in “exceptional circumstances” where courts consider damages should be greater than the original tariff. Government scraps EU Vnuk law requiring insurance for vehicles used on private land

The removal of the law means British drivers can avoid a potential £50 a year insurance hike. The Vnuk law requires a wider range of vehicles than those such as cars and motorbikes to be insured, including ones previously not requiring insurance, including golf buggies, mobility scooters and quad bikes. It also extends to vehicles on private land, meaning people with a ride-on lawnmower at home would require insurance where it would have previously not been needed. Private land owners would have had to insure quad bikes and golf buggies under the Vnuk law If the EU law been implemented in Britain, it would have meant the insurance industry would have been liable for almost £2billion in extra overall costs.

Insurer demands action to meet April s whiplash reform date | News

By John Hyde2021-01-06T13:03:00+00:00 The insurance industry showed its first sign today of anxiety about the prospect of whiplash reforms this year, as a leading player called for progress with just three months remaining until implementation. The portal for RTA claims is set to go live from 6 April, but the rules for the required pre-action protocol have yet to be published. Despite government assurances there are concerns that the starting date might be missed, as it was in 2020. Zurich Insurance today called on the Ministry of Justice to publish the rules and procedures for the new portal as soon as possible to enable the industry to prepare systems and policies. With the government s admission last March that ‘no practicable solution’ could be found for the much-heralded alternative dispute resolution process, the insurer also wants to know what the plans are for sorting disputes of liability and quantum.
