Today, Chief Magistrate Sharon Fraser granted a stay of execution in the case of Ramiro De la Rosa. He was sentenced earlier this month after police searched his home in Duck Run Two community and rounded him and his wife up for a loaded shotgun that was licensed to his recently deceased father. De la Rosa, who was ill-advised, pleaded guilty to possession of unlicensed firearm and ammunition, was sentenced the same day to three years imprisonment. His sentence has drawn outrage from residents in the Cayo community who thought it was too harsh. Attorney Orson Elrington now represents De la Rosa filed an appeal of the sentence. Elrington updated us on what happened in court today.

In court news, a case that sparked outrage in the Cayo District has caught the attention of attorney Orson Elrington. He plans to file for an appeal of a three-year prison sentence given to Ramiro de la Rosa, from Duck Run Two. Earlier this month De la Rosa pleaded guilty to possession of an unlicensed sixteen-gauge shotgun which belonged to his deceased father. He did not have an attorney and acted on the advice of a JP and the police in San Ignacio. Elrington told News Five that he will ask the court and Director of Public Prosecutions to review the guilty plea on the grounds it could be argued that De la Rosa was induced, pressured, and misguided into believing he would be released on bail. Another approach would be to ask the Governor-General to grant pardon to De la Rosa. Elrington, who is taking the case pro-bono, said the last option would be to ask the Governor-General to pardon De la Rosa under the Supreme Court of Judic

“I think I mentioned this in a previous interview and I admitted so that I personally did not even know that this was the position of the legislation. I can tell you that immediately upon the legislation was brought to us because of somebody else who was disqualified because of where exactly they resided. And when that was brought to our attention, we reviewed the legislation and it was our opinion that he should be disqualified. This matter is such importance that we felt that it has to go before the court of law so that the court can make a determination. I think that you alluded to it; that there is some confusion, there might be a general confusion. I have seen it all over the internet where persons talk about oh well, if a person is registered at one location, why can’t they run for certain locations, not understanding that the laws are very unique for every municipality. And in fact the law as it pertains to municipal elections is completely different
