Orson Elrington to Appeal de La Rosa Prison Sentence

Jul 13, 2021 Ramiro de la Rosa In court news, a case that sparked outrage in the Cayo District has caught the attention of attorney Orson Elrington. He plans to file for an appeal of a three-year prison sentence given to Ramiro de la Rosa, from Duck Run Two.   Earlier this month De la Rosa pleaded guilty to possession of an unlicensed sixteen-gauge shotgun which belonged to his deceased father.  He did not have an attorney and acted on the advice of a JP and the police in San Ignacio. Elrington told News Five that he will ask the court and Director of Public Prosecutions to review the guilty plea on the grounds it could be argued that De la Rosa was induced, pressured, and misguided into believing he would be released on bail.  Another approach would be to ask the Governor-General to grant pardon to De la Rosa.  Elrington, who is taking the case pro-bono, said the last option would be to ask the Governor-General to pardon De la Rosa under the Supreme Court of Judic

Jul 7, 2021 Ramiro de la Rosa On Tuesday we brought you the story of Ramiro de la Rosa, the twenty-seven-year-old father from Duck Run Two community who received a three-year prison sentence after pleading guilty to a gun charge. De la Rosa’s father had died, but late last week police in San Ignacio got wind that there was a gun in the house, searched the premises and found the shotgun. Ramiro and his wife were taken to the station where Ramiro agreed, after taking advice from a Justice of the Peace and the police but not an attorney, that pleading guilty to possession of an illegal firearm was the right course of action. He apparently wanted to prevent his wife from being charged, and did not know the penalty that accompanies the offence. Jul 6, 2021 Man Sentences to Jail for Gun Found in his Dead Father’s House A recent prison sentence of a father of two young children has drawn fire on social media.  On Friday, Ramiro de la Rosa from Duck Run Two was sentenced to three years in prison after police found a gun inside a house his father had occupied until his recent death.  Although the gun was licensed to his father and would not expire until October, police detained Ramiro.  He was arraigned in the San Ignacio Magistrate’s Court and pleaded guilty to the charge of being in possession of an unlicensed firearm.  News Five spoke with attorney Arthur Saldivar who told us while survivors ought to report guns to the department, he believes the police acted unreasonably and the case is ripe for appeal.  He also talked about what people can do if someone dies leaving behind a gun they would like to keep.
