The top court noted that the 2021 amendment to the Medical Termination of Pregnancy Act, does not make a distinction between married and unmarried women.
The top court bench, led by Justice D.Y. Chandrachud, made the following important observations during a ruling where it was interpreting the Medical Termination of Pregnancy Act and its provisions.
The Supreme Court order is significant because it fills in a legislative gap in the MTP Act on an unmarried woman’s right to terminate a 20-24 week pregnancy arising out of a consensual relationship.
