factual basis of the plea. rob: there were two moments that stood out to a lot of people and a lot of the analysis discussed, one was the judge acting whether or not he may have committed treason which seemed to come almost out of nowhere and the second is when the judge accused him of being an unregistered foreign agent for a foreign nation while he was a national security advisor for the president and he had to backtrack that, admitting flynn stopped working with turkey before the election. what did you make of those moments? the first was a misunderstanding of fact in terms of working with turkey when working for the president. that was a blatant misunderstanding of fact and with respect to the treason comment it was clear he was trying to shut down that narrative. he knew general flynn had not committed treason because he knows what the treason statute
we don t prosecute treason under the treason statute under the constitutional provision when we re not at a time of war, very rarely do, but when you have foreign government assistance of political campaign that violates campaign laws, there s computer hacking laws, with respect to a lot of the information that the russians obtained, of course the false statements, they lied about their contacts with the russians, several of these people now working for the united states government. and i think i ve been a republican for 30 years. they say this isn t collusion. our prior history with the communist party, we cannot accept this. this is collusion. we ve got to stop lying about it. the president needs to disclose any and all of the meetings with the russians so we can move on as a country. but the lies are not helping. so does this reach the level
war, we have the treason statute. in times of undeclared war, and that was throughout the entire cold war period, and today, we have other statutes to address conduct which is essentially treasonous, which is a conduct undermining the american system of democracy. we have statutes that govern computer hacking and computer crimes. we have statutes that govern campaigns, foreign nationals and foreign governments are not supposed to be making contributions in kind or in any way to american political campaigns. we have a wide range of statutes that have been used to address the fundamental problem of people engaged in conduct designed to undermine our democratic system and to assist a foreign power. and that is what that e-mail said, that there was a russian government objective to influence our election. that should have been reported
