what the attorney general did was put language in of banning muslims and the implementation of the order. the justice department will challenge that basis for suggesting that the order is unconstitutional. it is not unconstitutional on its face. that will be the physical argument and the second. this judge doesn t have the jurisdiction to ban this on a national scale. the judge relied on the texas case where president barack obama s executive order was stated. the administration didn t challenge the jurisdiction. they challenged the merits. i don t know if the justice department is going to suggest that this judge doesn t have the ability to do bha what he did o they are going to focus on the merits. david, quick question for you. something we just mentioned. this is kind of a precedent set by republicans, isn t it? the democratic method of
judge could not do his job and rule fairly in the trump university fraud case because he was of mexican descent. that was donecondemned by democ. the word so-called is disturbing. regardless of who he was appointed by, he is a sitting federal judge. the idea he is so-called suggests that president trump is deliberately with that tweet undermining his authority as a representative of the federal judiciary. going to you, julian, before we get into this entire legal mess, what are the chances likely slim that the white house just might tweak this executive order? would that be a way to prevent a legal crisis? well, it depends what the tweak is. the basic substance of this order in many ways is the
constitution and each personal attack on a judge, president trump raises the bar even higher for judge gorsuch s nomination to serve on the supreme court. his ability to be an independent check will be front and center throughout the confirmation process. this kind of lines up the fact that that confirmation process is going to be a battle. how is gorsuch preparing for this fight. i think this is going to be a confirmation process that s going to be less about gorsuch and his qualifications than the political turmoil that is raging around washington. clearly, an intervention by the judge and the travel ban. speedy confirmation. given the fact that this case might soon or eventually end up in the supreme court.
