Over the past few decades, Malaysia has sought to develop a refined and efficient system for alternative dispute resolution. Today, Malaysia has a relatively robust arbitration ecosystem. This article is part of a series that considers how the courts in Malaysia have construed and interpreted sections 8, 37 and 42 of the Arbitration Act 2005 and, in particular, focuses on the notion of a question of a law to be referred to a court for determination pursuant to section 42.

Arbitral awards in Malaysia: challenge and other actions

There is no appeals procedure against an award made in Malaysia under the Arbitration Act 2005. The only recourse is to set aside the award. The application to set aside an award has to be made within 90 days of receipt of the award, and the grounds for setting aside such an award are set out in section 37 of the Act. MPCorp s unit gets notice of application to revise RM115m sum owed to Amanahraya

KUALA LUMPUR (Dec 24): Property firm Malaysia Pacific Corp Bhd s (MPCorp) sub-subsidiary Taman Bandar Baru Masai Sdn Bhd (TBBMSB) has been served with a notice of application yesterday by trustee company Amanahraya Development Sdn Bhd. In a bourse filing, MPCorp said the application has been fixed for case management on Jan 17, 2021 at the High Court. Under the application, Amanahraya is seeking court approval to be given leave to vary the terms of a court order filed on Feb 29, 2016. The trustee company is also seeking to revise the sum owed by TBBMSB amounting to RM115 million as at Jan 31, 2016 to RM155.16 million as at Nov 3, 2020, as well as cost and such other relief that the court deems fit and proper.
