charged with obstructing justice and with taking classified documents, national security documents out of the white house and preventing them from being returned. it s the exact same thought i had when he said that, that it s actually a truth. it s a dark day for the country. and it s obviously an enormous historic moment. but will be looked back as a dark day that this has happened, that it s reached this point, and that the allegations are this serious, and it s of a national security matter this large. and as we await those counts, one thing we should be looking for. you talk about a talking indictment, right, which i know we talked a lot about in the alvin bragg case in new york that would include a lot of detail, all the context. do you think we re going to get something like this? is it going to be documents? i think it might. now look, the justice department almost as a platitude said we speak through our documents, not through the words of the attorney general or jack smi
ledgers that is false, so the fact that there are potentially north of 30. charges here does not necessarily mean that it s a vastly broader indictment than what folks. gatien going on. so it s also possible that there are different charges in there as well. so in this case, if there are, you know, reportedly more than 30 charges. what does this tell you about how the information will be relayed to the court? i ve heard terminology. like what is it a talking indictment that there s a story might be told. what are your expectations? well it s so it s called a speaking indictment and complicated white collar cases. prosecutors do it this way in order to kind of educate anyone reading the indictment about the scheme itself. that s not as typical in state court as it is in federal court, but in a case like this with this much scrutiny on it, i do expect that prosecutors will take the opportunity in the indictment to lay out the scheme a bit to explain how it all came
they can do it by charging conspiracy because there was a conspiracy here between trump and others, including michael cohen and david pecker, to try and catch and kill stories to influence the election potentially they could charge conspiracy which to charge a conspiracy, that s what you you put language in there and tell the language of the story that makes it a talking indictment the other way they can do it, when you file a case, file a statement of facts i think they might do one of those here because there s so much speculation and interest in the case and i suspect that s what they ll do, one of those two things in this case. how much risk do you think alvin bragg is taking by bringing this case, this 7-year-old case about a hush money payment to a porn star do you think it s worth it a lot of republicans say you had
statement already indicates, but he s got to remember that all of his says now can be used against them and will in a trial so he is in a very precarious situation, and i d sounds like brag, is very conscious with john miller s reporting of the importance of this case and the scrutiny this case. case is going to course get so at 34 count indictment is probably a talking indictment. it ll explain to the public why this case is unfolded the way it has . it will present a story about it, and that will have a much more powerful impact. so trump s got to be absorbing. ah that information as well, important that you all seem to be saying that it s not going to be bare bones, which would be the standard but there will be a story because there is in the in the context of where this country is the need for that. i want to go to jeff zeleny jeff as we talk about these next hours and days between now and when the former president would be formally arrested, you just
