is, because you re going to have to come and share that because he has a right to defend himself and because of the nature of who were dealing with the former president. the public should know that this isn t political. we want to know what it s about. share that with us. the timeline here is obviously important, too, because there s not another court date until december. the judge mentioned yesterday, maybe a trial in january, 2024, trump s attorney, said it would at least be spring 2024. that s when he s going to be going to iowa to new hampshire. he s gonna be all over the place in the middle of this campaign. do you think this is something based on what you saw yesterday that a judge will dismiss? maybe i think that s a big leap. it s way too early to make that determination. will they make that determination generally, what s going to happen? now with the next few days, whatever discovery has already been provided in the weeks ahead, more discovery will be shared. so the defense w
that he doesn t even think that this case is going to is going to see a jury. what do you think of that? i think a couple of things. the first thing is, there s no question about it as they should. all of us lawyers attacked the sufficiency of the information. should it even go before the jury are there. legal theories in the indictment that are flawed doesn t make out a crime, etcetera. so there ll be a lot of what we call motion practice. i can tell you that s my former office as a prosecutor there they are very good as it relates to dealing with paper crimes. it s the financial capital of the world. and as a result of that, they did it. then they ll do it now. it also means that no holds barred in the event. we don t get our case dismissed by virtue of making legal motions right by judges saying we re going to throw this out. we re going to take our case to the jury, and we are going to write. not that they have a burden of proof, but give the indication to those 12 members beyond t
this case should not get past the sufficiency of the indictment. bill: alvin bragg did do one thing today, harold, he completed a campaign promise, did he not? i mean, when he was running for office, he was part of the fact he sued donald trump hundred of times, is the quote, going after him again. you couldn t even run for office in new york for a while there unless you said i m going to get trump. today, did he take a step in that direction? harold: i don t know. he obviously took a step because he brought an indictment against the former president. i would say two things. one come all of the points you made, bill, but all of the things happening around the globe, we should focus on that everywhere. there is no shortage of things we sometimes focus on in the media that we should not because i agree with you, that balloon that has been misrepresented about what it was gathering and what has happened in china, that is something we should focus on a lot more. two, i was disappoint
attorney, joe tacopina says he plans to file quote substantial legal challenges to the indictment. sources have told cnn trump faces more than 30 counts here related to business fraud if you step into his world for a moment. what do you think ? trump s strongest argument is here? good morning, martin. thanks for having me. you know, i think that s a normal thing in defense attorney would say in this case, i think the strongest argument is probably going to be that one. there was no underlying, um, criminal fraud that was going on which they needed new york to try to boost this up to a up to a felony. um and that this was not a campaign finance violation. so therefore they ll call it boot strapping on on that allegation that that is not really valid. um i think it s a weak argument, but it is an argument now have a number of arguments they can post put forward like that which will really go to the sufficiency of the evidence and how it and have a look. part of the problem is
counts actually pertained to, but i would just imagine, although you can indict certainly on a misdemeanor that there would be felonies of import, so you know, we re all pundits and you know, trying to even defend or game out. it s tough to do because i don t know what specifically alvin break put in there with respect to the grand jury last point, and that s this. there s a process and we could attack it all we want and talk about alvin bragg and everything else. the end of the day. there are mechanisms you have a grand jury consisting of 23 people a majority vote out an indictment right? it says, is there reasonable cause to believe that a crime was committed? and did donald trump committed and then thereafter? there are emotions. you could attack the legal sufficiency of the charges. you can attack whether or not the legal theories are. appropriate and should they be charged. you can have various hearings. you have a proceeding. where in then, of course, you have a jury where 12 peo
