A student has been in jail for over a month cannot be in countenanced and some element if public interest is involved, Bench of Justices Nitin Jamdar and NR Borkar held.
The Bombay High Court has granted interim bail to Nashik student, Nikhil Bhamre, who was arrested after he had posted on social media against NCP chief Sharad Pawar.
Although the post does not name the NCP chief, the police have claimed that it was “defamatory” and “that it promotes enmity between different groups on the basis of religion or race”.
Sharad Pawar's image is unnecessarily being undermined, said Justice SS Shinde, while asking the prosecution to make its stand clear on FIRs related to social media posts about him.
