The Bombay High Court on Thursday expressed hope that the Maharashtra government would take necessary steps to shun the “unscientific and heavily criticized two finger test”.
“It is unfortunate that she had to vividly narrate the whole incident before the court. We deprecate the practice of the learned prosecutors adopting the process of asking the survivor to give minute details of the act of rape,” said the judges.
Observing that death puts an end to the concept of repentance, the Bombay High Court commuted the death penalty of three convicts in Shakti Mills gangrape case of 2013.
"Death puts an end to the concept of repentance. It cannot be said that the accused deserved only death penalty. They deserve imprisonment for life to repent the offence committed by them," the bench said.
