This is the wrong time to be choosing a Supreme Court justice. And judge barrett is the wrong candidate for a seat on that court. The timing for todays confirmation vote is shocking. The majority of americans want to be able to weigh in on who should sit in Justice Ruth Bader ginsburgs seat on the highest court in the land. Mr. Hawley madam president , some months ago, in july of this year, i came to this floor shortly after the conclusion of the Supreme Courts most recent term to lament the ongoing judicial activism, the judicial imperialism that we have seen from this court over this past term and from the Supreme Court for years on end. I quoted the late Justice Scalia who said the imperial judiciary lives, and i said on the floor of this senate it was a shame to say but undeniable that the imperial judiciary continued to live in this country, a judiciary intent, a Supreme Court intent on legislating from the bench, on making up laws that went along with no regard for what the people actually wrote in their statutes or in their laws, and i particularly lamented the position of religious conservatives, people of faith who had seen in this past term for the United States Supreme Court decision after decision, tossing aside the concerns of religious conserv

Constitution . First of all, i think that its improper to even be considering a nominee right now when we are in the middle of an election. Not just an election year, the election is happening right now with half a million ballots already cast in early voting states. Not to mention that we are in the middle of the pandemic and the senate is taking away an important time that should be devoted to dealing with those virgin, crucial issues in these next five weeks. Aside, i thinkt theres a real legitimacy question when you have the public voting right now for the president and the senate, the folks thatof the deal with nomination and confirmation of a Supreme Court justice, and if there is a lack of public space in the way that process works, there is going to be a crisis of legitimacy for ae Supreme Court it relies on really public believe in its legitimacy in order for its ruling to be voluntarily and sometimes for grudgingly, but still happily followed.
