MUMBAI: Bombay high court on Monday rejected a plea by Sandeep Lahoriya to transfer on-going trial in the 2013 murder of his father Sunil Lahoriya, a real estate developer, out of Thane Sessions Judge RR Vaishnav s court to any other court. The HC however directed that to address Lahoriya s grievance, the trial court should liberally consider his plea for CCTV footage to be viewed. If the CCTV footage has the necessary section 65-B certificate under Information Technology Act, of authenticity, it may be played towards the end of the trial.
A bench of Justices S S Shinde and Manish Pitale said a case was “not made out’’ to transfer the trial and to revisit an earlier order of the HC of August 2019 by which the trial was transferred specifically to Judge Vaishnav. The SC had confirmed that order.

Bombay High Court has rejected a plea filed by Sandeep Lahoriya to transfer the on-going trial in the 2013 murder of his father Sunil Lahoriya out of Thane Sessions Judge RR Vaishnav s court to any other.
Sandeep s plea alleged bias by the judge and said that the manner in which Judge RR Vaishnav has been conducting the trial, an apprehension is created in the mind of the petitioner that the judge is biased and he is in a hurry to wrap up the trial, as a result of which, procedural and substantive errors are being committed while conducting the trial, which is prejudicial to the prosecution.”
