Published on Jan 28, 2021 12:19pm The Supreme Court of Canada in Ottawa (Jolson Lim/iPolitics) The Supreme Court of Canada granted leave Thursday to hear the appeal of Ross McKenzie Kirkpatrick, who was acquitted at trial for sexual assault after reneging on a promise to use a condom while having sex with a woman he’d met online. The top court may provide some clarity about how to approach “stealthing”, which is when during sex a man deliberately removes or doesn’t use a condom after his partner has insisted on condom use. In 2019, California passed a law that states the act of a victim asking for condom use is not, in itself, evidence of consent to sexual activity.
