Newman is facing removal from office under G.S. 7A-66 after a group of citizens filed an affidavit in Henderson County Superior Court on Feb. 11.
Judge Robert C. Ervin found grounds to continue proceedings under that statute based on willful misconduct in office and conduct prejudicial to the administration of justice, which brings the office into disrepute.
Proceedings wrapped up just before lunch on the third day of a hearing to remove District Attorney Greg Newman from office, leaving Judge Robert C. Ervin to deliberate on the evidence and decide whether Newman is out as district attorney.
After two days of witness testimony in the inquiry, April 14 kicked off with closing statements, where both sides - independent counsel and defense attorneys for Newman - laid out their cases before Judge Ervin.
