去年7月，美国自由中心（Center for American Liberty）与20名原告提起诉讼，对纽森禁止加州32个县的学校进行面对面教学的命令提出质疑。多位原告表示，纽森越权剥夺了父母对其子女教育的权利。
负责审理这起诉讼的第九巡回上诉庭法官柯林斯（ Daniel Collins ）23日做出裁决：“根据相关判例法，加州强制关闭州内私立学校的命令涉及到一项根本权利，即父母拥有管理自家孩子教育以及为孩子选择受教育论坛的权利。”
他还指出，加州禁止私校进行面对面授课的命令，剥夺了原告受正当程序条款（Due Process Clause）保护的基本自由。而且这种禁令只有在经得起严格审查的情况下才能得到支持。“但加州的禁令经不起这种审查。”柯林斯写道。
然而，法官虽然判处纽森对私立学校的禁令是违宪的，但却维持了对加州在疫情期间禁止公立学校进行面对面
