coming out of the altamont pass. we ll have more details on that plus ace train delays, as well. back to you. thank you. it is 6:01 now. more accusation of police misconduct in san francisco. another video has surfaced that appears to show officers entering an apartment without consent. anne makovec reports it was enough to convince a judge to dismiss a criminal case. she joins us now live. anne, good morning. reporter: good morning. yeah, the judge threw out a felony case. it was a marijuana case, granted, and the man did have a medical marijuana card. but there are concerns now that this new video, this whole case, could show a broader spectrum of police misconduct here in san francisco. the judge tossed out that felony drug case after seeing this video. it s from security cameras of the local apartment building. these are the officers in the garage and in the hallway when they allegedly went into an apartment without consent or a search warrant. the video was shown b
everyone. i m sydnie kohara. hi, everybody. i m frank mallicoat. and we begin this noon with some breaking news. several officers have surrounded a neighborhood in hayward. take a look. these are live pictures from chopper 5. those officers are going house to house searching for at least two suspects believed to have been involved in a burglary earlier this morning. now, police received a call around 9:30 this morning of an intruder inside a home on leeward street. this is in hayward. when police arrived, the suspects tried to take off and smashed into a patrol car. they then took off running. neighbors reported seeing people jumping fences. that s why you see all those officers out in that field. officers also have that large grassy lot covered where the suspects could be hiding. so far, there have been no reports of any injuries. but again, we will have more on this story, the search for two suspects, as soon as any additional information becomes available. more break

we ll see temperatures anywhere from the upper 50s to near 70. san francisco at 64. concord of 68 today. temperatures flirting with records tomorrow. low 80s wednesday and thursday. we ll talk more about that coming up. first a look at traffic. back out to san leandro at the scene of this traffic alert still in effect. it s been there for more than two hours now. one lane is open. one lane remains closed on this major connector ramp southbound 880 to southbound 238. this is the scene of a big rig accident and diesel fuel spill. so delays are minor so far and they are hoping to have everything wrapped up and all lanes re-opened by about 5:15. in the meantime, check out this video that came into our newsroom overnight. an accidental fireworks show in oakland. cross streets of kennedy and frederick, a power outage near 880 and 23rd. we understand that a nearby off- ramp was closed for about one hour. but it produced some pretty spectacular fireworks there in oakland overnight.
