One of the men accused of murdering young farm manager Bredin Horner (21) is due in Free State High Court this morning to challenge his bail refusal by the Senekal Magistrate s Court in October.
Advocate Joseph Kgoelenya, who is representing the first accused in the murder, Sekwetje Mahlamba s (32), will ask the High Court judge to set aside Magistrate s Deon Van Rooyen s decision to refuse Mahlamba bail.
Kgoelenya is also set to argue that the evidence against Mahlamba is weak and circumstantial.
This, as DNA samples taken from Horner s bakkie could not be linked to the accused. Police previously indicated that it could take up to 6 months to obtain results from blood samples taken from Mahlamba s bloodied trousers.

Judgement has been reserved in the bail appeal of one of Brendin Horner s murder accused in the Free State High Court.
Judge Celeste Reinders on Tuesday postponed her judgement in the bail appeal of first accused Sekwetje Mahlambi to Friday morning. Mahlambi is part of a duo accused of murder and robbery and he is contesting Magistrate s Deon Van Rooyen s decision for bail refusal.
Advocate Joseph Kgolenya, who is representing Mahlambi says Van Rooyen had failed to take into account all the evidence placed before him. He also told Reinders that Van Rooyen relied on the state s key witness and lead investigator, captain Pieter Myburgh, who he says was evasive in his testimony and didn t have all the details of the case.

One of the suspects in the murder of 21-year old farmer manager, Brendin Horner, is set to argue against his bail denial in the Free State High Court this coming week.
The accused, Sekwetje Mahlamba s (33) legal representative-Advocate, Joseph Kgoelenya says the appeal has been set for this Tuesday, December 15.
Mahlamba was denied bail in the Senekal Magistrate s Court by Magistrate Deon Van Rooyen in October, following claims that he could evade his trial and that he had a prima facie case against him.
However, Advocate Kgoelenya rubbished the claims and argued that the evidence against Mahlamba and his co-accused Sekola Matlaletsa (44) was weak and circumstantial.
