The Free State High Court in Bloemfontein has dismissed a bid by one of the suspects in the Brendin Horner murder trial to appeal the refusal to grant him bail.

The Senekal Magistrate’s Court earlier ruled that Sekwetje Mahlambi remain behind bars.
On Friday, Judge Celeste Reinders said she was not convinced that Magistrate Deon Van Rooyen had erred when he dismissed Mahlambi’s bail application in October.
She said Mahlambi, who stands accused of murder and robbery, failed to prove beyond a reasonable doubt that the state does not have a prima facie case against him.

The state s laboratory is continuing to analyse the DNA sample taken from one of Brendin Horner s murder accused.
This was according to the state prosecutor during yesterday s appeal by first accused Sekwetje Mahlambi in the Free State High Court.
The State informed Judge Celeste Reinders during the appeal that the analysis of the bloodied trousers, which where confiscated at Mahlambi s home in Fateng Tse-Ntsho in Paul Roux near Senekeal, was still in progress.
This, as Mahlambi s legal representative, Advocate Joseph Kgoelenya, appealed against Senekal Magistrate Deon Van Rooyen s decision to refuse his client bail in October - after the latter was arrested for murder and robbery alongside co-accused Sekola Matlaletsa.

Judge Celeste Reinders on Tuesday postponed her judgement in the bail appeal of first accused Sekwetje Mahlambi to Friday morning. Mahlambi is part of a duo accused of murder and robbery and he is contesting Magistrate s Deon Van Rooyen s decision for bail refusal.
Advocate Joseph Kgolenya, who is representing Mahlambi says Van Rooyen had failed to take into account all the evidence placed before him. He also told Reinders that Van Rooyen relied on the state s key witness and lead investigator, captain Pieter Myburgh, who he says was evasive in his testimony and didn t have all the details of the case.
