matt whitaker about the mueller probe. would you say special counsel s investigation is a witch hunt? are you overseeing a witch hunt? and family separation. do you know what kind of damage has been done? then new allegations about blackmail and the national enquirer and why it could mean trouble for the president. i have always said, why didn t the national enquirer get the pulitzer prize. and a washington post block buster report. i m going to end illegal immigration. on a pipeline of undocumented workers from costa rica. all in starts now. good evening, from new york, i m joy reid in for chris hayes. when the president appointed matt whitaker to be the acting attorney general last fall, violating the justice department s order of succession and possibly the constitution, democrats feared it had nothing
unconstitutional. tell us about this case. what the senators are alleging is that whitaker s appointment is in violation of what is called the appointments clause. the constitution says that the senate gets to confirm these principal officers. whitaker, of course, has not been confirmed. this is not a legal technicality. it is a central part of the checks and balances of the constitution. ordinarily we have an order of succession at doj, a deputy attorney general who is confirmed, associate attorney general, all the wray down to te heads of the divisions. we have trump not going through the ordinary process, but actually circumventing it all together, reaching outside of the order of succession and putting a person in who never has been confirmed. what these senators are saying essentially is you are denying us our constitutional authority and ability to exercise, you know, our duty to provide advice and consent. everybody stand by. there s more news we are following, more breaking

star general that led the bin laden raid, somebody he praised in 2012 in order to degrade president obama. now he is using him as a foil because he doesn t like what mcraven said, so he is denying an accomplishment he had. he is frankly when asked about journalists and words he uses about journalists, calling them the enemy of the people, and when pointed out that authoritarians are using this around the world, they re copying your language, saying enemy of the people, saying fake news, he brushes it off. he is completely oblivious to reality of the midterms. it seems that everything that s going on if it is counter to the message he wants, by the way, brushing off the cia and khashoggi, if it is counter to the narrative he is building or the narrative he wants to hear, he is undermining the authority. and what that does, it is not just donald trump doing it, it is now a significant portion of the american public that says i
