was member of the house judiciary committee that voted for impeachment of president nixon. she now works for harry finestein s practice. pete, who can fire robert muller? it is an unresolved question. many people say the president could do it, he is head of the executive branch, he could fire anybody in it. but that s an untested question. it would have to go to court. secondly, he could direct the attorney general to change the justice department regulations that say who gets to fire the special counsel. or he could order rod rosenstein to do it. if rod rosenstein refused to do it, and remember the regulations say on what grounds a person can be fired, it is basically for not doing the job correctly or misconduct in office. if rosenstein said no and quit, then you would go down the list of order of succession in the justice department. the next person up would be
counsel rules. now the regulations say that when the attorney general is refused, it s the deputy, they don t say beyond that. but the order of succession tells us the answer and it s attorney general, deputy attorney general associate and then various u.s. attorneys around the country. now the next one in the succession line is the u.s. attorney right across the river here in alexandria, virginia in the eastern derriistrict of virginia, and then it goes to the eastern district of north carolina and the northern district of texas both of which have senate confirmed u.s. attorneys. but i think the way to look at this order of succession things is sort of how does the government work on autopilot? if something really bad happens, this is why for example, the order of succession doesn t do what you would normally think it would, which is to go now to
