It is not just enough to say the dog has been certified, you need more performance evidence. How would that work . Every time there is a case where drug evidence is used, the prosecution would have to come and and a show, what, there is some sort of test . He has gone out 100 times what would be the evidence that would be enough to convince a judge this dog was reliable . Whats the traditional test for probable cause is the totality of the circumstances. I think the state is advocating, if a Police Officer gets on the stand and says this dog is trained, that should be enough. We are arguing, no, no one should look at the totality of circumstances.
