Editor s note: This weekly report includes new information about Stearns, Benton and Sherburne county criminal cases previously covered in the St. Cloud Times.
Edward Valentine Forsythe, 39, of St. Cloud, was sentenced May 21 to 12 years and six months in prison for one felony count of first-degree drug possession. He was acquitted of a second count of first-degree drug possession. Forsythe was given credit for 241 days served. Judge Nathaniel Welte presided.
David James Cantillo, 35, of Rush City, pleaded guilty May 18 to one felony count of first-degree drug possession. One felony count of fleeing a peace officer was dismissed. In a separate case, Cantillo also pleaded guilty to one felony count of first-degree drug possession or sale. Judge John Scherer presided.
Kimberly Colt Cuningham, 29, of Rice, was sentenced May 14 to three years and nine months in prison, stayed for five years, for one felony count of third-degree drug possession. She was given credit for one year served in jail. Cuningham will be on supervised probation for five years. If she breaks terms of probation, she could go to prison. Judge Kris Davick-Halfen presided.
Aivan James Updike, 25, of Sauk Rapids, was sentenced May 13 to one year in jail, with 275 days stayed, for one gross misdemeanor count of interfering with an emergency call. Updike will serve 90 days in jail, which could be reduced to 30 days if Updike reports timely, according to court records. Updike will be on supervised probation for two years. Judge Michael Jesse presided. One felony count of domestic assault was dismissed.
Whoever fired that gun used deadly force, Tvedten said.
Tvedten said Priebe s gun was loaded, but it was not fired. Priebe s gun was moved from the scene, he said, but the first person to move it was someone who was not involved in the incident. It was picked up and handed to officers before being placed in the back of a squad car.
Priebe admitted to threatening to shoot Boose during the incident, but he did not shoot, Tvedten said.
Tvedten also emphasized that the trigger and guard on the handgun that was fired did not have much space to have multiple people s fingers in it.

ST. CLOUD, Minn. - Charges were filed Friday against a man accused of holding five employees hostage during a standoff at a Minnesota bank that lasted more than eight hours.
Ray R. McNeary, 35, was charged with first-degree aggravated robbery, five counts of kidnapping and assault in Stearns County District Court, the Star Tribune reported. Judge Nathaniel Welte rescheduled his bail hearing from Friday to Monday after McNeary was âunco-operative and refused to appear for court,â the Stearns County Attorney s Office said. He will be held over the weekend.
