The high court had observed that police have the statutory right and duty under the relevant provisions of the CrPC to investigate a cognisable offence. It had also said the power of quashing an FIR should be exercised sparingly with circumspection.

After the recusal, Naidu s lawyer, senior advocate Siddharth Luthra mentioned the plea before a bench headed by Chief Justice of India (CJI) D Y Chandrachud which refused to restrain the trial court from hearing a plea filed by Andhra Pradesh Crime Investigation Department (CID) seeking police custody of Naidu.
The Andhra Pradesh CID filed a fresh petition in court on Monday seeking further five-day custody of Naidu in the Skill Development Corporation scam case. After the two-day police custody of Naidu ended on Sunday evening, the court had extended his judicial remand till October 5.
Andhra Pradesh Police CID officials have begun interrogating TDP chief N Chandrababu Naidu in the Skill Development Corporation scam case. Naidu was granted two days police custody by the ACB Court in Vijayawada. The questioning will take place from 9.30 am to 5 pm on both days. Naidu will be allowed legal assistance during the interrogation, and the CID will be permitted to videograph the examination. After the completion of police custody, Naidu will be produced virtually before 5 pm on Sunday.
