A Boston federal appeals court ruled Tuesday against vacating the death sentence and murder convictions of a man who died in prison while appealing his death sentence.
kevin was going to be in jail for the rest of his life. i i lost the woman i was going to grow old with. it was heartbreaking. reporter: but allison miller still believed in kevin and wouldn t give up. murder convictions rarely get overturned, but allison thought an appeal had a solid chance. she d objected to the judge letting in the old 911 call kevin made to get bill in trouble. i argued that should not be admissible. reporter: she said it prejudiced the jury against kevin and an appeals court agreed. two years after his conviction, kevin was granted a new trial. it was a stunning turnabout. allison rushed to phone kevin in prison. so, i called and said, can i speak to kevin kyne? and some very helpful person was like, well, honey, it doesn t work like that. we can t just put him on the phone, you know? you have to schedule an appointment. and i was like, can you just tell him he s getting a new trial? i was astounded. i was extremely happy.

let s go now to georgia where the three men found guilty of murdering ahmaud arbery will have yet another day in court. travis mcmichael, his father, gregory mcmichael, and william bryan were convicted this week on multiple counts in the killing of 25-year-old arbery while he was jogging through a georgia neighborhood last year. now, those three men are preparing for a february hearing on federal hate crime charges of kidnapping and violating arbery s right to use a public street because of his race. the mcmichaels are also charged with using, carrying, and brandishing a firearm. i m joined right now to discuss it by paul butler, a former federal prosecutor and georgetown law professor and kristen gibbons fedden, a civil rights attorney. they are both msnbc legal analysts. i welcome you both wholeheartedly. paul, the murder convictions have been praised by arbery s family, by civil rights advocates and even the president as a sign that our justice system can work. but the trial was lar
just, how did we get here? how did we get here? i know this isn t right. i know this isn t right. their pain was compounded when isaiah was sentenced to 60 years in prison. on appeal the court ruled that three of his four convictions relied on the same evidence in what amounted to double jeopardy. his robbery conviction was reduced to theft, a misdemeanor. and one of his two murder convictions was thrown out. but on the remaining count, the jury s verdict stood, as did isaiah s sentence. we want him to know that we are we love him, and we are going to be there for him, no matter what. we will always love him, regardless of what you, anyone else has to say. s he is my son, as long as i m living. this is a very special place. yeah. you and halee.
