former attorney general michael mccasey in studio with us. this is as clear as mud would you say. that s one of the things i might say. take a look at what he did and what he was appointed to do. he was appointed to look into whether there was a criminal relationship between the trump campaign and the russians. that s what he was appointed to do. and then to decide whether to charge anybody in connection with that or not. he charged russians. he didn t charge any americans in connection with that. and that obviously didn t find any connection. he was also responsible for deciding to prosecute or not prosecute related cases. and he prosecuted plenty of those. but they were all cases that arose after he took office and in connection with his investigation. for him to say that he couldn t
mueller today just said what the report said. to make this into oh my god, now we have not a single new fact, no smoking gun, not even a single new nuance. it s the same old story. sandra: we have live fox team coverage this morning. judge michael mccasey will join us in a moment with analysis. we begin with catherine herridge live in washington for us. good morning. robert mueller the same ground as the 450 page russia report on alleged collusion and obstruction released in mid april but what he chose to emphasize that shook washington, the house speaker responded urging her colleagues not to overreach. nothing is off the table but we do want to make such a compelling case and iron-clad case that even the republican senate which at the time seems to be not an objective jury, will be convinced of the path
option we could consider. bill: in all of that is already under dispute. put that in english as to how we can understand the difference between what both men are describing. bill barr is sticking within the law. if there is not sufficient evidence to charge somebody, then that person doesn t get charged and that s the end of it. then you don t say that a crime was probably committed, a crime may have been committed. you say that there will be no charges. that s what the attorney general did. the special counsel on the other hand went out of his way to suggest that well, maybe a crime was committed but we couldn t find enough. why was it your job to try to find enough? bill: the debate continues. appreciate your input today. judge michael mccasey, the former attorney general. sandra: john ratcliffe will be here. hogan gidley from the white house joins us top of the hour.
when he was subpoenaed to appear in front of a federal grand jury by ken starr s group, and turned out to be a disaster because he was lying. what is your take on this? a president cannot be indicted while in office. if a president has the power to exercise his rights to fire an individual, and let s say he s presented with a subpoena, what does he do? well, he fights it, he can fight it on a number of ground, including executive privilege grounds, the basic point that gregg s made and you made is that the theory is right, the attorney general or a special prosecutor, in theory operating under the attorney general s supervision cannot indict or summon his own boss who s the president. there is a point worth making that s ignored. people are saying are you saying the president broke the
fired, that he pushed for a special counsel and in his book tour he says he needs to be credited with triggering that event. right. mark: rosenstein appoints mueller. right. mark: i m a little confused about this as i assume the american people are. rosenstein wrote an extensive memo to the attorney general who passed it onto the president of the united states, and in that memo he cites former attorneys general, former deputies attorneys general, former attorney, former whatever at the department of justice and beyond, condemning comey for what he did in hillary clinton s case in the press conference, right? right. mark: well if he s appointing mueller to investigate, among other things, the firing of comey, is that not a conflict of interest? a major disqualifying conflict of interest that is actually mandatory under federal regulations.
