The legislation would establish a framework for the creation of a retail marijuana market in Virginia administered by the Virginia Cannabis Control Authority. Under the proposed law, retail marijuana sales would begin on Jan. 1, 2024. This is all illegal under current federal law.
The legislation would legalize medical marijuana for patients with qualifying medical conditions as determined by their physicians and establish a Medical Cannabis Production Commission to set up the regulatory structure for a state medical cannabis program, including the cultivation and sale of medicinal cannabis.
The legislation would ban any person, including any public officer or employee of the state and its political subdivisions, from enforcing any past, present, or future federal “acts, laws, executive orders, administrative orders, rules, regulations, statutes or ordinances” that infringe on the right to keep and bear arms.
The proposed law would also bar any Nebraska government entity from utilizing assets, state funds, or funds allocated by the state to engage in any activity that aids a federal agency, federal agent, or corporation providing services to the federal government in the enforcement of the same.
