DELHI: On Tuesday, the Delhi court freed all the 36 foreigners in the Tablighi Jamaat case. The foreigners were facing trial in pretext of their involvement in the contravention of COVID rules. It was reported that these people took part in the Tablighi Jamaat event in Nizamuddin in March. This later led to the spread of COVID infection in multiple states.
Chief Metropolitan Magistrate Arun Kumar Garg called Station House Officer Hazrat Nizamuddin for his statement and evidence. The plea from these accused was seen as a probability. The plea that none of them were present at the given time. All of them went to Markaz at different times. They were picked up from various places. All of this on the directions by Ministry of Home affairs.

New Delhi [India], December 15 (ANI): A Delhi court on Tuesday acquitted 36 foreigners in connection with a case related to attending Tablighi Jamaat religious congregation in Nizamuddin Markaz here amid the COVID-19 pandemic.
Chief Metropolitan Magistrate Arun Kumar Garg acquitted the 36 people from 14 different countries of all charges levelled against them.
The 36 foreign nationals were facing charges under Sections 188 (disobedience to order duly promulgated by public servant) and 269 (negligent act likely to spread infection of disease dangerous to life) of the Indian Penal Code (IPC), Section 3 (disobeying regulation) of Epidemic Act, 1897, and Section 51 (obstruction) Disaster Management Act, 2005.

Chief Metropolitan Magistrate Arun Kumar Garg acquitted the foreigners from 14 countries of all charges.
The court had on August 24 framed charges against the foreigners under sections 188 (disobedience to order duly promulgated by public servant), 269 (negligent act likely to spread infection of disease dangerous to life) of the Indian Penal Code and Section 3 (disobeying regulation) of Epidemic Act, 1897.
The charges were also framed under section 51 (obstruction) Disaster Management Act, 2005.
However, they were discharged for the offences under section 14 (1) (b) (violation of visa norms) of Foreigners Act, sections 270 (Malignant act likely to spread infection of disease dangerous to life) and 271 (Disobedience to quarantine rule) of IPC.

A Delhi court on Tuesday acquitted 36 foreigners, who were chargesheeted for attending Tablighi Jamaat congregation in the national capital by allegedly being negligent and disobeying the government guidelines issued in wake of the novel coronavirus pandemic in the country.
