If you look at the fillmore district and compare it to divisidero and vezation valley, you are having a lot of power shaping our neighborhood deciding what businesses go into the retail spaces, what organizations come to service our community. In the last year and a half theres literally been two meetings in our neighborhood regarding the 800,000, two meetings, and one of the things we agreed to with the Mayors Office when they came in, they would have monthly meetings and they would have it monthly, that way when you have a important topic the community has an opportunity to talk. Instead they only had two meetings in a year and a half and the way they were set up was to cause division in the neighborho
Violations of the emergency escape and rescue provisions under Building Code section 1026. 1 and thats where you got it . That section says the openings that are required shall open directly into a public way or to a yard or court that opens to a public way. The word is directly. Now most of us understand what that means. A line from here to there without a lot of interference or obstacles. Its not over the woods over the hill and through the woods to grand mothers house. And yet if you look at these plans there is no such opening as required for all of the various improvements. Now, its possible that dbi could have made an equivalency determination. The code allows for that, as you know. The equivalency determination has 3 parts. It starts with an application, followed by a determination that, yes, indeed, the building plan actually has protections that are equal to the protections in the Building Code that were not going to enforce, even though the state Building Code says that every
Plans tonight. Obviously thats too high if you are not going to provide egress, so something has to be done about that. We will have an opportunity at dbi but im not sure how i would get that done from our end of things. Im not involved in the plan check process so maybe some condition within an hr2 district. It went through section 311 neighborhood notice at the beginning of this year, 5 discretionary views were filed on the application, the matter was heard in may of this year and not take discretionary review. The Planning Department does not have any complaints on file for the subject file. The appellant has raised concerns regarding section 181 of the planning code that would not apply here. The building is not, it doesnt contain any nonconforming uses. They are allowed to contain two dwelling units, thats what the property contains. A further note, even if the property did contain a nonconforming use, its not a prohibition on an expansion of the building. The Building Code does a
