his fiance saying i showed odin the spot but never allowed to know what that meant. i want to bring in mark o mao ma o mara here. the attorneys will appeal. guilty of first-degree murder. what grounds do they have for appeal? what avenues do you think the defense will take? they will ask the appellate court to review any evidentiary rulings the court made. as paul said, had they allowed information in of the other double homicide, that would have been a focus for appeal. this judge did a good job throughout the entirety of the trial of keeping it very close of doing a good job of being very conservative in the rulings and decisions made and i think very few reasons for appeal. there will be generic ones. circumstantial evidence. there s not enough evidence to support a conviction. there will be some of the objections that were overruled
the circumstantial evidence jury instruction says use your common sense but what you look at when you decide whether or not he s guilty is this circumstantial evidence has to exclude any reasonable hypothesis of innocence. you have to be certain he s not guilty based upon the circumstances. there was an enormous amount of circumstance from phone records to telephone pinging to video evidence. there s a lot that prosecution did without showing the one point they had to aaron hernandez killed odin lloyd and everything else pointed to no other explanation but aaron hernandez was there, he did it, he conspired for it and he was part of it and is guilty as anybody else who did it. mark o mara, standby.
family, odin lloyd s family, have access to that money right now? will there be a wrongful death? there can be a wrongful death case. if he has assets seizable, the family would have the right to recover those assets. they would have a strong case here. they have a finding beyond a reasonable doubt he committed the murder. mark, weigh in on that. what do you think that means going forward? just signed that $40 million. will odin lloyd s family be able to do you expect they ll be seeking damages if you want to call it that, seeking to get a piece of that? absolutely. without question. any asset he had whether the money from the contracts, houses, boats, planes, cars, whatever he has are now subject to a lawsuit and as paul just mentioned, we now have 12 people who found him guilty beyond a reasonable doubt. the standard in a civil lawsuit, a wrongful death lawsuit, is much less than that. we can presume that a civil verdict is going to be entered against hernandez as well and th
long at all. but after only five days of an evidentiary phase in this trial, i think it s long. am i wrong? i don t think it s hard to say. i ve tried 100 times more than 100 times to figure out what they re thinking about in there. and my only response is, it s a false folly to try. 14 hours is a long time. what it does tell us, i think, is that there is a split. there is certainly some controversy between the jurors as to what they re thinking. it may be whether or not it s self defense and may be whether or not it s first degree versus another offense. i said all along, it was never a first degree murder case. and i do think there is a question as to whether or not dunn just became a murderer in a moment s notice or if he acted in self defense. and they have to be wrestling with those big questions before they get to a vote. i ve been ruminating on all of this evidence since i left jacksonville. and the one thing that keeps coming back to me, mark, and i don t know if this i
