A sessions court in Mumbai has rejected two applications filed by Kangana Ranaut seeking transfer of proceedings of the case registered against her by Javed Akhtar. In her plea, she claimed that the Andheri Magistrate grossly misused his power to intentionally cause her injury.
Mumbai sessions court has reserved its order on Kangana Ranaut’s plea seeking transfer of the defamation case filed by Javed Akhtar. The court will deliver the order on March 9.
The reply came in the plea of Ranaut under Section 408 of the CrPC invoking the exclusive jurisdiction of the Sessions Court seeking transfer of proceedings being held before Magistrate RR Khan to any other magistrate.
"It is a settled position of law that the proceeding cannot be transferred from one court to another on mere apprehension," said Additional Chief Metropolitan Magistrate ST Dande while hearing Kangana Ranaut's plea.
